Generally, the following costs shall be allowed in paying for work ordered by the Contracting Officer (CO) on a unilateral Change Order. The Contracting Officer's Representative (COR) shall maintain records to confirm these costs whenever possible. 1. Labor. Record number of laborers and Supervisors on work site including hours worked. 2. Material. Record all material incorporated into the Change Order. 3. Tools and Equipment. Record any machine power tools and attachments, special or heavy equipment used, and standby operating time. 4. Other Cost Peculiar to the Change Order. This may include: a. Site conditions, or weather circumstances at the site, at the time the Change Order is required. b. Peculiar public safety protection requirements, and so forth. 45 - ACTUAL DAMAGES. The COR shall maintain accurate records of the possible actual damages resulting from the contractor's failure to complete the contract within allowed contract time and shall provide this information to the CO at the completion of the contract. The CO shall determine and advise the COR of these costs to be charged. Actual damages may include, for example, the loss of tree seedling stock, or other Government furnished supplies, and excess administration cost such as the COR's and Inspector's salary and travel after the contract time expires. Actual damages do not include remote or conjectural costs not attributed directly to the project. COR or Inspector cost of performing final inspections, contract closing documents, and so forth, is cost regularly incurred in any contract and are not chargeable as excess regardless of expiration of contract time.
