Regular Meeting Minutes January 13, 2015 President Anthony Alford called to order the Regular Meeting of the Terrebonne Levee and Conservation District at the TLCD office located at 220 Clendenning Road, Houma, Louisiana, 6:00 o'clock P.M. on January 13, 2015.l Angela Rains led the opening prayer, and Commissioner Henry led the Pledge of Allegiance to the American Flag. Upon roll call by Ms. Rains, Commissioners recorded as present were : Alford, Chauvin, Guidry, Moore, Ledet, and Henry. Commissioners Daisy, Pinkston, and Shaffer are recorded as absent. President Alford recognized the family of Jimmy Dagate as present in the meeting. Under Public comments, Representative Gordon Dove, and CPRA Director Jerome Zeringue addressed the board. Under disposition of minutes, there was a motion by Commissioner Henry, seconded by Commissioner Chauvin, to accept and ratify the minutes of the Regular Meeting dated December 9, 2014. The motion passed. There was a motion by Commissioner Ledet, seconded by Commissioner Guidry, to accept and ratify the minutes of the Special Meeting dated January 7, 2015. The motion passed. There was a motion by Commissioner Henry, seconded by Commissioner Chauvin, to accept and ratify the minutes of the Finance Meeting dated January 7, 2015. The motion passed. There was a motion by Commissioner Guidry, seconded by Commissioner Moore, to accept and ratify the minutes of the Planning & Projects Meeting held on January 7, 2015. The motion passed. Under Management's Report, Ms. Rains asked the board for approval of the second warrant listing for the month of January. There was a motion by Commissioner Chauvin, seconded by Commissioner Henry, to approve the second warrant listing for January 2015, as presented. The motion passed. President Alford, Commissioners Guidry and Moore, all commented on Mr. Dagate's skills as TLCD's Board Attorney through the past years. He will be greatly missed by all who knew and worked with him. Under Executive Director's Report, Mr. Dupre spoke of the creation of the TLCD years ago and the appointment of Mr. Dagate as Board Attorney at that time. Regular Meeting January 13, 2015 Page Two Program Manager Mitch Marmande commented on how fundamental Mr. Dagate was to the legal decisions affecting the District throughout the years. Mr. Dagate's steady demeaner and immense knowledge will be missed by all. Executive Director Reggie Dupre read the following Memorial Resolution for Board Attorney James Dagate into the official records of the Terrebonne Levee and Conservation District: "WHEREAS, Almighty God, in His infinite wisdom, has seen fit to summon to eternal rest, our dear friend and colleague, Mr. James Dagate, and WHEREAS, Mr. Dagate practiced law for over 36 years, where he served as an Assistant District Attorney for Terrebonne Parish since 1997, was a coordinator and teacher for District Attorney Joe Waitz, Jr.'s Project LEAD school program, and served as general counsel for the Terrebonne Economic Development Authority and the Houma Housing Authority, and WHEREAS, Mr. Dagate served as the chief legal counsel for the Terrebonne Levee & Conservation District since its inception in 1997, and through his guidance and dedication, played a critical role in allowing the District to move forward for flood protection efforts through construction of Morganza to the Gulf Hurricane Protection Project, and WHEREAS, Mr. Dagate further served his profession as President of the Terrebonne Parish Bar Association in 1994, the Louisiana State Bar Association Disciplinary Hearing Committee Member (1993-2001), Chairman (1998-2001), Louisiana State Bar Association Disciplinary Board Member (2004-2007), former Special Assistant Attorney General, Ad Hoc Judge of the City Court of Houma, former Teacher of Criminal and Constitutional Law at Terrebonne and Lafourche Parish Sheriff's Training Academy, and was a Certified Mediator of Legal Disputes, and WHEREAS, Mr. Dagate was an active civic and community leader, a member of the Board of Directors of Terrebonne General Medical Center and the Terrebonne Council on Aging, as well as a member of the Houma-Terrebonne Chamber of Commerce and the Houma-Terrebonne Rotary Club (1990 President and Rotarian of the Year), and served as host of HTV's "Law and Government", "The Truth", and "Bayou Time" television shows, and WHEREAS, Mr. Dagate was a devoted husband, father, grandfather, and friend who will be missed by all who knew him. NOW, THEREFORE BE IT RESOLVED, by the Terrebonne Levee and Conservation District Board of Commissioners, that the passing of James R. Dagate has been duly noted in the records of the Terrebonne Levee and Conservation District, this 13th day of January, 2015, and that all in attendance stand for a moment in observance of the passing of this kind servant." Regular Meeting January 13, 2015 Page Three There was a motion by Commissioner Moore, with a unanimous second, to pass the Memorial Resolution in memory of Attorney James Dagate. The motion passed. Under Management's Report, there was nothing more to report. Under Executive Director's Report, Mr. Dupre asked the board to accept the recommendation by District Attorney Joe Waitz to appoint Attorney Jacob Dagate as Legal Counsel for the Terrebonne Levee and Conservation District. There was a motion by Commissioner Moore, with a unanimous second, to approve the recommendation by District Attorney Joe Waitz to appoint Attorney Jacob Dagate as Legal Counsel for the TLCD. The motion passed. Jacob Dagate voiced his thanks to District Attorney Joe Waitz, and the TLCD board for allowing him to represent the District in this capacity. Mr. Dupre asked the board for authorization to accept ownership of the 90 x 30 foot Parish spud barge. Operations Supervisor Greg Gautreaux told the board to what capacity the barge will be used. He also said there will be modifications and improvements made to the barge. There was a motion by Commissioner Chauvin, seconded by Commissioner Ledet, to authorize the acceptance of the 90 x 30 foot Terrebonne Parish spud barge. The motion passed. Mr. Dupre discussed the District's 2015 list of priorities. Representative Gordon Dove spoke to the board regarding the timeline of the HNC Lock Complex construction. Under Engineering Reports, there was nothing to report. Under President's Report, Mr. Alford told everyone to keep up the good work. There being no further business to come before the board, it was moved by Commissioner Henry, seconded by Commissioner Moore, to adjourn the January 13, 2015 Regular Meeting of the Terrebonne Levee and Conservation District at 6:50 o'clock P.M.
