On joint motion of all Councilmembers present, the following resolution was
offered:
RESOLUTION NO. 119414
A resolution calling for the Board of Commissioners of the
Jefferson Parish Housing Authority to terminate the
employment contract of the Executive Director for cause due
to allegations of misconduct and failure to comply with
Federal regulations and procurement processes as reported
in the U.S. Department of Housing and Urban Development
Office of the Inspector General’s report. (Parishwide)
WHEREAS, the Jefferson Parish Housing Authority was created by the Parish
pursuant to La. R.S. 40:392; and
WHEREAS, the Jefferson Parish Council and President, pursuant to La. R.S.
40:531(c), appoints members to the Board of Commissioners of the Jefferson Parish
Housing Authority; and
WHEREAS, according to La. R.S. 40:401, the powers of the Authority are vested
in the Board of Commissioners; and
WHEREAS, in 2010 the Authority entered into an employment contract with its
current Executive Director; and
WHEREAS, the employment contract between the Authority and the Executive
Director gives the Authority the right to terminate the employment with cause for refusal
or inability to carry out job duties as specified in article 2, section 2.02 of the contract;
and
WHEREAS, the Executive Director, as provided in article 2, section 2.02 of his
employment contract, is responsible for and has the duty to manage Authority assets
and comply with all the rules and regulations of HUD as well as state and local laws;
and
WHEREAS, as a result of a recently released report by the U.S. Department of
Housing and Urban Development Office of the Inspector General it has become clear
that various federal regulations and procurement processes may have been violated by
the Authority and specifically by the Executive Director; and
WHEREAS, the Authority and Executive Director have previously been the
subject of allegations of impropriety in procurement processes by the U.S. Department
of Housing and Urban Development Office; and
WHEREAS, in order to maintain public confidence in the Authority, the
employment contract with the Executive Director should be terminated.
NOW, THEREFORE, the Jefferson Parish Council, acting as the governing
authority of the Parish of Jefferson, Louisiana, hereby resolves:
SECTION 1. That the Executive Director of the Jefferson Parish Housing Authority
should be terminated for cause by the Board of Commissioners.
The foregoing resolution having been submitted to a vote, the vote thereon was
as follows:
