On motion of___________, seconded by_________, the following resolution was
offered:
RESOLUTION NO.
A resolution requesting and authorizing the Planning
Department and the Planning Advisory Board to conduct a
study of the text of Chapter 8 Buildings and Building
Regulations, Chapter 33 Unified Development Code, and
Chapter 40 Zoning of the Code of Ordinances of the
Parish of Jefferson, specifically of the provisions related to
fences, with the intent of establishing definitions and
regulations including, but not limited to, height, height
measurement methods, materials, and setbacks;
establishing interim development standards during the
study; and providing for related matters. (Parishwide)
WHEREAS, appropriate fencing and screening standards promote quality
development, ensure adequate buffering and screening, and promote public health,
safety and welfare and the overall quality of life in the Parish; and
WHEREAS, after Hurricane Katrina, FEMA adjusted Base Flood Elevation (BFE)
that affects the elevation of new homes and businesses; and
WHEREAS, the Parish Council amended regulations regarding fences in the Old
Metairie Neighborhood Conservation District (OMNCD) post-Katrina to account for
properties using fill or pier construction to elevate residential structures; and
WHEREAS, as was done in the OMNCD, fence height regulations should be
evaluated parishwide in light of revised BFE requirements.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council,
Jefferson Parish, Louisiana, acting as governing authority of said Parish:
SECTION I. That the Planning Department and the Planning Advisory Board are
hereby authorized to conduct a study of the text of Chapter 8 Buildings and Building
Regulations, Chapter 33 Unified Development Code, and Chapter 40 Zoning of the
Code of Ordinances of the Parish of Jefferson, specifically of the provisions related
to fences, with the intent of establishing definitions and regulations including, but not
limited to, height, height measurement methods, materials, and setbacks; and
providing for related matters.
SECTION II. That the following interim development standards for fences in
residential zoning districts or for dwellings are hereby established:
1. A fence shall not exceed a height of eight (8) feet;
2. On a site where the dwelling or principal building(s) is raised a minimum
of two (2) feet higher than eighteen (18) inches above the crown of the
street or Base Flood Elevation as determined by the FEMA Flood
Insurance Rate Maps in effect, whichever is higher, a fence in
combination with a retaining or chain wall may extend an additional foot to
no more than nine (9) feet in total height, provided that the fence does not
exceed a height of eight (8) feet, the retaining or chain wall does not
exceed a height of two (2) feet, and all applicable provisions of Chapter 8
including engineering requirements are met.
SECTION III. The interim development standards set forth in this resolution are
in accordance with and by the authority of Sec. 33-2.23 and Sec. 40-880 of the
Jefferson Parish Code of Ordinances providing, in pertinent part, that when a zoning
or land use study has been initiated by resolution of the Jefferson Parish Council and
pending final disposition of said amendment, supplement, change, zoning or land
use study, interim development standards may be established that provide for
reasonable approval conditions for certain types of development applications that
would be otherwise affected by the study for one (1) year, which may be extended by
the Jefferson Parish Council for not longer than one (1), six (6)-month period.
