On joint motion of all Councilmembers present, the following resolution was
offered:
RESOLUTION NO.
A resolution ratifying an Agreement with Burk-Kleinpeter,
Inc., with support from Shaw Environmental & Infrastructure
Group, Krebs, LaSalle, Lemieux Consultants, Inc., Eustis
Engineering Services, LLC and BFM Corporation, LLC, for
professional
engineering
services
related
to
Maplewood/Pailet Drainage Improvements for a total fee of
$919,085.00, with this cost not to be exceeded by a factor of
more than ten (10) percent without an amendment to the
contract authorized by resolution of the council. (Council
District Nos. 2 and 3)
WHEREAS, on August 18, 2010 by virtue of Resolution No. 114997, the
Jefferson Parish Council selected the firm of Burk-Kleinpeter, Inc. for professional
engineering services for Maplewood/Pailet Drainage Improvements; and
WHEREAS, the project consists of upgrades to subsurface drainage in the
Maplewood/Pailet Subdivision along Dogwood, Estalote, Esther, Maplewood, Marian,
Pailet, Redwood, Shirley, 7th, 36th and 38th Street, including necessary street and utility
replacements; and
WHEREAS, Jefferson Parish is receiving FEMA funds under a Hazard Mitigation
Program towards the design and construction of this project; and
WHEREAS, the Department of Capital Projects has negotiated a basic lump sum
fee of $507,600.00 for services necessary for professional engineering services for
Maplewood/Pailet Drainage Improvements and a not-to-exceed fee of $411,485.00 for
supplemental services; and
WHEREAS, Attachment “A” to the Standard Professional Services Agreement for
Jefferson Parish has been deleted from the agreement in order to meet FEMA funding
requirements; and
WHEREAS, classifications and fixed rates will be provided under the Payment
Section of the agreement as a substitute to Attachment “A”; and
WHEREAS, Burk-Kleinpeter, Inc. is authorized to provide these services with
support from Shaw Environmental & Infrastructure Group, Krebs, LaSalle, Lemieux
Consultants, Inc., Eustis Engineering Services, LLC and BFM Corporation, LLC.
NOW, THEREFORE, BE IT RESOLVED, by the Jefferson Parish Council, the
governing authority of said Parish:
SECTION 1. That the Council does hereby ratify the terms of the Engineering
Agreement with Burk-Kleinpeter, Inc. to provide professional engineering services
related to Maplewood/Pailet Drainage Improvements for a total fee of $919,085.00.
SECTION 2. That Burk-Kleinpeter, Inc. is authorized to provide these services
with support from Shaw Environmental & Infrastructure Group, Krebs, LaSalle, Lemieux
Consultants, Inc., Eustis Engineering Services, LLC and BFM Corporation, LLC.
SECTION 3. That the cost of these services is to be charged as follows:
$649,085.00 to Account No. 21410-1240-281-7451(14123.001) and $270,000.00 to
Account No. 21410-1240-281-7455(14123.001).
SECTION 4. That the fixed amount of compensation stated in the contract shall
not be exceeded by a factor of more than ten (10) percent without an amendment to the
contract authorized by resolution of the council.
SECTION 5. That Attachment “A” to the Standard Professional Services
Agreement for Jefferson Parish has been deleted from the agreement in order to meet
FEMA funding requirements.
SECTION 6. That classifications and fixed rates will be provided under the
Payment Section of the agreement as a substitute to Attachment “A”.
SECTION 7. That the Chairman of the Jefferson Parish Council, or in his
absence the Vice-Chairman, be and they are, authorized to execute any and all
documents necessary to give full force and effect to this resolution.
The foregoing resolution having been submitted to a vote, the vote thereon was
