1. Non-commercial Recreation Use

Authorization is not required for the non-commercial use of occupancy of N.F.S lands or facilities for camping, picnicking, hiking, fishing, hunting, horse riding, boating or similar recreational activity unless the use is a group event, or authorization for such use is specifically required by the Code of Federal Regulations (see 36 CFR 251.50.6). For the purpose of this policy, an activity is non-commercial if it fulfills all of the following criteria:

(1) There is a bona fide sharing of actual expences by all participants, including on forest transportation to and from the site.

(2) The cost of the activity does not include provision for payment of salaries, etc., of any person(s) to help with the activity or its logistics.

(3) The cost that is shared my include replacement of lost or damaged equipment, and purchase of minor equipment needed, etc., but does not include amortization of equipment or the acquisition of new equipment to the advantage of an individual or group.

If the activity is judged commercial, the required Special Use Permit will be of a type most closely fitting its nature, e.g. 149 (Group Event). 153 (Outfitter/Guide), etc.
