Authority Delegated In accordance with the authority granted by the Regional Forester in 2710.44, the Forest Supervisor delegates and authorizes District Rangers to take certain actions on recreation residence term permits. District Rangers may reissue and make prior approved amendments to existing recreation residence permits on approved tracts. They may also modify and approve Operating Plans associated with these permits. Modification of the standard permit clauses and the addition or deletion of clauses is permitted with prior written approval of the Forest Supervisor. Responsibility for the handling of annual billings, fee appraisals, forest land use reporting, and terminations shall remain with the Forest Supervisor. 2. Improvements and Structures One recreation residence, one storage building, and an outhouse are the only structures that will be authorized for each recreation residence lot. For lots that have additional structures that were constructed prior to January 1, 1989, the improvements will be allowed to remain as long as improvements are used and maintained or until the permit is transferred. If they are destroyed or need significant repair, the permittee must remove the structure and restore the area. New guest cabins will not be permitted. Existing guest cabins will not be rebuilt if destroyed or if needing structural repair. Satellite dishes are not in keeping with the rustic setting of the lots and will not be approved. A site map will be attached to each permit. This map is a required supplement to the written description of the land permitted and is cited in the first paragraph of the permit as a legal exhibit and part of the document. This map will be drawn to scale and will show existing structures, above ground and below ground improvements (including driveways, power lines, water lines, drainfields, etc), completed title block (owner, lot number, date), and approximate boundary lines. New permits will be issued only after an updated site map has been received. 2721.23--1 MBS SUPPLEMENT 2700-89-23 EFFECTIVE 7/89 2721.23 Page 3 of 3 3. Construction The District Ranger has the authority to approve construction plans for facilities. The maximum square footage that a home may have is 1200 square feet measured on the outside of the foundation. A full second story is not permissible, however a loft is allowable provided that the maximum height of the building is less than 25 feet as measured from the foundation to the highest point of the roof. A single one story storage building for storing firewood may be approved. Maximum size is 300 square feet and no higher than 20 feet to the highest point of the roof. Prior to construction approval, the permittee must comply with one of the following alternatives: (1) Supply to the District Ranger a copy of the building permit from the county, or (2) Supply to the District Ranger construction drawings stamped by a licensed engineer and certifying that building codes are met, PLUS supply authorization from the respective County Health Department that sewage and drainfield requirements meet standards for the proposed construction. If a residence is destroyed by fire or other catastrophe, the permittee will be required to clean up and secure the area within 30 days unless a time extension in writing is granted by the District Ranger. Hazards must be remedied immediately. A permittee may rebuild on the same lot provided, (1) the applicable standards, including visual, are met, and (2) reconstruction is completed within three years. Empty lots will not be kept under permit indefinitely as this leads to "selling rights to build". If a permittee chooses not to rebuild a destroyed cabin within three years, the permit will be terminated and the lot will be considered for open space. 4. Water and Sewage The following clause will be inserted in all new recreation residence permits: If a community (public) water or sewage system should become available to the residence, the holder must disconnect from any private systems within 12 months. No new wells, alternate water systems, drainfields and other related improvements will be approved once a community system comes on line. Drainfields will not be permitted off of the resident lot. Vault toilets or other facilities that meet code will be authorized for those lots that are unable to meet drainfield standards.
