Item 15 b. Land Acquisition – Title Adjustment Act, July 8, 1943 (pl –120): Forest
Supervisors may execute pertinent documents after submitting case for Regional Forester
approval.

Executive Exchange approval documents contingent upon: 1) having an approved
Landownership Adjustment Plan (or Map and Narrative) which displays Forest Plan
direction (Standards and Guidelines) for Land Adjustments; 2) after approval of a Land
Exchange Feasibility Analysis by Regional Office for all cases, and further case review

and approval by National Land Adjustment Team for land exchange cases exceeding
$500,000 or proposed as a Categorical Exclusion under 1909.15 31.1b(7).

Sign Agreement to Initiate after approval of Land Exchange Feasibility Analysis by
Regional Office for all cases, and further approval by the National Land Adjustment
Team for land exchange cases exceeding $500,000. Execute Exchange Agreements for
land exchange cases exceeding $150,000. Signing of Exchange Deeds is reserved for the
Regional Director of Land and Minerals.

Delegated authority is contingent upon securing Land Adjustment skills and Regional
Office approvals.
11. Only the Forest Supervisor, Deputy or the designated acting Forest Supervisor has
the authority to sign certain land adjustment documents, i.e. Options, Agreements to Initiate,
Exchange Agreement, etc., that convey an interest or document compliance. This authority may
not be delegated further.
Such documents include, but are not limited to, the following.
Land Purchase
a. Land Purchase Option and Contract, Form FS-5400-36
b. Certificate of Use and Consent, Form FS-5400-29
c. Land Transaction Screening Process Summary
Land Exchange
a. Feasibility Analysis
b. Agreement to Initiate
c. NEPA Decision documents, i.e. Decision Memo, Decision Notice, ROD
d. Exchange Agreement
e. Certificate of Use and Consent Form FS-5400-29
f. Mineral Statement (regarding consideration/acceptance of mineral
reservation/outstanding right). May be included on FS-5400-29
g. Land Transaction Screening Process Summary
