All these factors have a bearing on each subsequent step in the process. Estate and Financial Planning is not a once off process and in most instances the scope of the planning will lie somewhere between the elementary and the comprehensive depending on the size and the complexity of the planning that has to be done. It is however important that all concerned in the Estate Planning Process should have a good understanding of: Marriage and matrimonial property law which is the starting point of the estate planning process; The law of succession, limited rights and the calculation of limited rights (usufructs, fideicommissum and annuities) Estate Duty, Capital Gains Tax and Donations Tax implications in Estate Planning Generally used Estate Planning Techniques Massing of estates: the practical implications with reference to the Estate Duty, Donations Tax, Transfer Duty, VAT and Capital Gains Tax Implications Inter Vivos Trusts with reference to their use in the estate planning process, the legal structure, the tax implications as well as the potential pitfalls to avoid. This two day course aims to give you an overview of all of these and is suitable for newcomers to the profession as well as those who have already been in the business for some time and want to have an update on developments in the industry and techniques. Melanie obtained her initial qualifications at the University of Stellenbosch. After completing her LLB she obtained the LLM degree in Property Law. She completed her articles and was admitted as practicing attorney in 1992. She joined Old Mutual as Legal Advisor in 1992 and here she provided Legal and Tax support to Financial Planners and their clients. She focused on and specialized in Business Structuring, Drafting of Contracts, Tax Planning, Estate Planning, Retirement Planning (Pre- and Post Retirement) as well as Advising on Tax Implications of Investment Solutions. Whilst at Old Mutual she obtained her CFP®. She also subsequently obtained a Post Graduate Diploma as well as her Masters Degree in Tax Law at UCT. In 2003 she obtained her third Masters Degree from UNISA, specializing in Commercial Law. She joined Momentum in 2006 as Business Development Manager, Recurring Investment Solutions and moved to Absa Wealth in 2008 where she joined as Advisory Specialist. Here she was responsible for providing Legal and Tax advice to ABSA Wealth Clients and Bankers. In 2009 she obtained the Advance CFP® qualification specializing in Estates Planning and Personal Risk Management. In this she was recognized by the FPI as the National Top Student for Personal Risk Management. She established Silwerbeeck Financial Services CC and re-established Melanie Louw Attorneys in 2010 and aims to provide quality risk management and investment advice to clients and businesses.
