SUBJECT :

The elements of civil law and involvement of civil contracts in public administration

TEACHER: mgr Agata Ludera-Ruszel (lecture and tutorials)

COURSE DESCRIPTION:

1.

The subject matter and sources of civil law. Spacial and temporal application of civil law. The civil law as a subject of public administration.

2.

Subjects of civil law.

3.

Legal capacity and capacity to undertake legal actions.

4.

Legal events – the notion and typology. Acts of law.

5.

Limitation and peremptory dates.

6.

Representation.

7.

The elements of law of obligations – the definition and subject of obligation, sources of law of obligation, type of civil contracts involved in public administration, type of torts related to public administration,

8.

The elements of property law;

9.

The elements of succession law.

LEARNING OUTCOMES:

At the end of the course the students will achieve the following:

Knowledge:

Upon completion of the course, students will be able to:

know the fundamental concepts of the Polish civil law, as well as its place in polish justice system;

know the main differences between public and private law;

identify subjects of the Polish civil law and their ability to undertake actions governed by this law;

understand the nature of all property laws recognized by the Polish civil law;

recognize how the various elements of the legal system in this area are interconnected;

know the international aspects of transactions with a Polish component;

understand the meaning of fundamental legal concepts of Polish law of obligations and law of succession.

Skills: upon completion of the course, students will be able to:

read and understand texts of normative acts;

interpret and analyze legal provisions;

use legal collected in the form of codes;

properly use the legal language;

Verify binding force of various provisions.

Final course output-social competences:

Upon completion of the course, students will be able to:

develop and complement the knowledge and skills acquired in the classroom;

logically explain legal issues arising in everyday life to people in non-familiar with legal issues;

formulate their own judgements on particular legal issues;

take part in discussion on specific issues of the polish civil law.

GRADING POLICY:

Lecture – exam grade is determined by the number of points received by the student; positive assessment requires more than 50% correct answers.
