Professor Hanri Mostert (BA LLB LLM LLD (Stell)) joined the UCT Law Faculty in 2008, having been a
member of Stellenbosch University’s Law Faculty from 2001. Her teaching and research interests are
focused on the public law aspects of property law, in particular how they relate to matters of land and
minerals.
Hanri completed her doctoral studies in 2000, having benefitted from NRF and DAAD (Deutscher
Akademischer Austauschdienst) scholarships, which enabled an extensive sojourn in Germany. Her
doctoral dissertation on constitutional property protection was published internationally, as a monograph in
the reputable “Schwarze Reihe” of the Max Planck Institut für ausländisches Öffentliches Recht und
Völkerrecht. Since then, she has published nationally and internationally, on land law and mineral law. As
author she participates in national and international collections such as Silberberg & Schoeman’s Law of
Property; the Mineral and Petroleum Law of South Africa and the Nomos Anwaltskommentar (Band III:
Sachenrecht).
Hanri’s research projects are united by a concern about the layers of responsibility that should underpin the
proper functioning of property law. She defends the notion of engaged citizenship, as an aspect of
responsibility, in the enhancement of freedom and quality of life for the individual and the collective. She
emphasizes the state’s duty in achieving better living standards and ensuring freedom of its subjects in the
property law context. She comments on the achievements of the judiciary in building a society that
subscribes to the notions of accountability and dependability in property law.
Hanri is rated as an established researcher by the National Research Foundation in South Africa. She is a
Georg Forster Fellow of the Alexander Von Humboldt Foundation in Germany and a fellow of the
Commonwealth Scholarship and Fellowship Programme in the United Kingdom. She has recently been
appointed visiting professor by the University of Groningen in the Netherlands.
