Determination of eligibility for special education and related services
(b) In making a determination of eligibility for special education and related services, a student
shall not be determined eligible if the determinant factor is due to a lack of instruction in
reading or math or due to limited English proficiency.

Individualized education program
(c) When developing the IEP, the IEP team shall:
4. In the case of a student with limited English proficiency, consider the language needs
of the student as related to the IEP.
