IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY
HOMECOMING LAWN DISPLAY PARTICIPATION AGREEMENT
This Agreement is made and entered into by Iowa State University of Science and Technology,
(hereinafter referred to as ISU) on behalf of Homecoming Central Committee (HCC) – Student Alumni
Leadership Council (SALC), a recognized student organization, and
__________________________, (hereinafter referred to as Fraternity).
(NAME OF FRATERNITY)
Purpose
This Agreement outlines the conditions for Fraternity participation and provides permission for property
use in Lawn Display activities during ISU Homecoming 2008.
Term
The term of the Agreement shall begin upon the signing of the memorandum and end November 2, 2008.
Conditions
1.
Designated Property Area
The property authorized for Lawn Display use is located at

2.
Property Access
ISU representatives will have access to this property for review of compliance with Homecoming
Lawn Display requirements.
3.
Fraternity Responsibilities
a. Fraternity is responsible for complying with all requirements as outlined in the Homecoming
Activities Guide and presented at the Lawn Display Safety Meeting.
b. Fraternity is responsible for complying with all local, state, and federal rules and regulations and
Iowa State University policies.
4.
Insurance
Fraternity shall submit a certificate of insurance to verify commercial general liability coverage in the
amount of $1,000,000 each occurrence. The insurance policy shall be issued by a reputable
insurance company duly authorized to engage in the insurance business in the State of Iowa and
with an AM Best rating of A+. The certificate must include the following additional insureds: the
State of Iowa, Iowa State University, Board of Regents - State of Iowa and Iowa State University
Alumni Association.
The certificate must be sent by Friday, September 5, 2008, to:

Fraternity assumes all risk of loss or damage to the property and understands that the Fraternity’s
insurance policy will be considered primary.
5.
Release from Liability
Fraternity hereby RELEASES FROM LIABILITY, WAIVES, DISCHARGES AND COVENANTS NOT
TO SUE Iowa State University Alumni Association, Homecoming Central Committee – Student
Alumni Leadership Council (SALC), Iowa State University, the State of Iowa, the Board of Regents –
State of Iowa and any of the officers, servants, agents, volunteers and employees of any of the
above-mentioned entities (hereinafter referred to as RELEASEES) for any liability, claim and/or

cause of action arising out of or related to any loss, damage or injury, including death, that occurs
as a result of participation in the above-described activities.
6.
Indemnification and Hold Harmless
Fraternity agrees to hold harmless Iowa State University, Homecoming Central Committee –
Student Alumni Leadership Council (SALC), Iowa State University Alumni Association, Board of
Regents - State of Iowa, State of Iowa and their officers, employees, agents and students, from any
and all liability, including claims, demands, losses, costs, damages, and expenses of every kind and
description or damages to persons or property which arise out of the negligent act or omission of an
employee, officer or agent of the Fraternity arising out of or in connection with or occurring during
the course of this Agreement.
7.
Construction Supervision
Construction supervision is not provided by Iowa State University, Iowa State University Alumni
Association nor HCC. Individual pairings are responsible for managing the construction and
presentation of displays in a safe and responsible manner.
8.
Disqualification
Any pairing that does not meet the Homecoming Lawn Display requirements may be subject to
disqualification from Lawn Displays at any time.
This agreement signed by the respective party at the address indicated constitutes the entire agreement
between the parties and may not be amended or modified without mutual written consent of both parties.
