E. Dyer Jail has 11 vending machines and 11 beverage machines.
Q9) What type of facility space will be provided to the vendor for staging orders and receiving deliveries?
A9) There is a caged staging area near the loading dock at the Santa Rita Jail and one at the Glenn E. Dyer Jail.
Q10) If the County provides office space what is the cost to the vendor?
A10) Space is provided by the County at no cost to the vendor.
Q11) Does the County currently use scanners?
A11) The County does not use scanners .

The Sheriff’s Office will provide two desktop computers, a matrix-type printer, telephone access, LAN access, restricted AJIS access, and computer technical support.
Q15) How will the inmate’s account balance information be sent to the vendor to process orders?
A15) The bidder must provide a proposed method of obtaining the inmate’s account balances electronically. Currently the commissary vendor logs in to the AJIS which contains updated inmate account information.
Q16) How will credits be issued and within what time frame?
A16) The bidder must provide a proposed method of issuing credits and a timeframe describing when they will be able to issue them. Currently the commissary vendor updates the AJIS system with credits and payments due to inmates within 24 hours.
Q17) Will the County allow the vendor to keep delivery vehicles on site during the delivery/distribution process?
A17) Yes, the County will allow the vendor to keep delivery vehicles on site during delivery and/or distribution.
Q18) Are there any vehicle height restrictions?
A18) There are no vehicle height restrictions.
Q19) What parking will be available for the vendor’s associates who will deliver orders?
A19) Parking is available in the rear of the facilities for associates delivering orders.
Q20) How long does it take the County to perform background checks on vendor personnel?
A20) There are two different types of background investigations: 1) contract employees who deliver the commissary product to inmates (once or twice a week), and, 2) contract employees who are assigned to the Santa Rita Jail/Glenn E. Dyer Jail facilities.
Contract delivery employees must submit a Site Clearance Form to the Santa Rita Jail
Classification Unit. The site clearance background may take up to seven business days to complete. Contract employees, who are assigned to the facility, must also submit a
Site Clearance Form. Additionally, the contract employee (assigned to the facility) must submit to a thorough background investigation, including fingerprinting VIA
“Live Scan” to the Alameda County Sheriff’s Office Backgrounds and Recruiting Unit within five days of submitting the Site Clearance Form. The assigned contract employee will continue to work at the facility until the background investigation is completed. The investigation may take up to three to five months to complete. In the event the contract employee is deemed “unsuitable” for employment at a Sheriff’s
Office facility, the employee’s site clearance will immediately be revoked.

A70) No. In order to adhere to the strict timeline for this bid, questions may not be submitted after the last Bidder’s Conference.
Q71) The County stated an Addendum will be released containing all the questions pertaining to this bid, as well as the County’s official responses to those questions. Once that Addendum is released, can Bidders submit follow-up questions for clarification purposes?

Q72) What is the approximate breakdown of the housing units in the jails in terms of minimum, medium, and maximum
A72) Minimum security: two tier, dormitory style. Medium: two tier, two person cells.
Maximum, two tier, one or two person cells.
Q73)
What type of housing units’ do the two facilities have?
A73) The Santa Rita facility is a rectangle with a line running down the middle cutting it in half. The minimum side is one-half of the jail, which is roughly ten (10) housing units; but on that side, there might be one or two units that are structured like a combination of dorms and individual cells. The other side is the medium and maximum side, which has eight (8) housing units. Each housing unit is split into six (6) sections, which the
County calls pods. The pods are designated A-pod, B-pod, C-pod, D-pod, E-pod and Fpod. Each pod has a lower level and an upper mezzanine level, but deliveries will only be made to the bottom level of the pods.
The Glenn E. Dyer facility is a multi-story building. There are six (6) housing floors, but because of the mezzanine levels on the floors, the building itself is actually 13 stories tall. Access to those housing unit floors will be by elevator. There are three (3) elevators: one is strictly for emergencies (and security), and two (2) that are used to get up and down the floors.

Q74) Can the County provide a list of vending equipment by type (i.e., beverage units, snack units, type of units, etc)?
A74) There are a total of 125 machines; 25 beverage units, and 100 snack units all of which are Energy Star rated.

A75) No, the inmates order once a week.
Q76) Are there any dietary restrictions on commissary ordering?
A76) No.
Q77) Does the County want healthy snack alternatives and options as part of this proposal?
A77) Bidders are encouraged to include healthy snack alternatives and options for informational purposes only. Healthy snack alternatives and options, however, will not be evaluated for award purposes.
Q78) Under the current contract and current vendor, are any SLEB requirements being met?
A78) No. When the current contract was awarded SLEB participation was waived. SLEB participation, however, is required by this RFP. The provisions regarding SLEB participation can be found in the RFP (pages 25-27, Section IV, Paragraph W.
COUNTY PROVISIONS).
Q79) According to the Calendar of Events on page 13 of the RFP, there is a scheduled date for vendor interviews. Will all vendors that submit a bid response be invited for a vendor interview? Or, will the County narrow its selection, for example, to its top three (3) vendors? How will the County determine which vendors will be invited for a vendor interview?
A79) All bid responses will be evaluated by the County and given a preliminary score. The top three (3) bid responses will be invited to a vendor interview.
Q80) Are debit cards delivered with the commissary orders?
A80) Yes.
A80) Can the County clarify how inmate trust fund account balance information is being sent to the current vendor to process orders?
A80) The current orders are sent electronically.

Q81) On page 15 of the RFP, Section III, Paragraph K, Item 9 states:
Only one bid response will be accepted from any one person, partnership, corporation, or other entity; however, several alternatives may be included in one response. For purposes of this requirement, “partnership” shall mean, and is limited to, a legal partnership formed under one or more of the provisions of the California or other state’s
Corporations Code or an equivalent statute.
Can the County clarify what is meant by “several alternatives may be in included in one response,” and how will the County evaluate such a response with multiple alternatives?
A81) Each alternative bid response will be accepted on an alternative bid form, as long as it meets the requirements in the RFP. The County will evaluate each alternative submitted individually.
Q82) To clarify, award of the contract is based strictly upon the evaluation criteria as stated in the
RFP. Is that correct?
A82) Yes.
Q83) According to the RFP, inmate balances are currently kept on the County’s proprietary AJIS system, and the commissary ordering process needs to interface with that system. Is the
County interested in a replacement to the County’s AJIS system?
A83) No.
Q84) How was the County’s signing bonus issued for the current contract?
A84) The signing bonus was $100,000 amortized over 5 years.
Q85) Can the County provide the total commission amount paid for the last fiscal year?
A85) The total commission paid for the last year was $2,139,254.
Q86) Are both Bidders’ Conferences the same?
A86) Both Bidders’ Conferences follow the same format and cover the same issues.
Obviously, attendees may differ as well as the questions asked.
Q87) Will attendees of both Bidders’ Conferences be listed in the Addendum?
A87) Yes. The Addendum will include a list of attendees, as well as the questions and answers, for both Bidders’ Conferences. All questions asked and answers given at both conferences will be stated in the Addendum.
Q88) Are stamps and stamped envelopes the only non-commissioned items?
A88) Yes, stamps and stamped envelopes are the only non-commissioned items.
Q89) Can background checks be fast-tracked, at least for the initial hires?
A89) The department can fast-track, if necessary, but there should be enough time to conduct normal background checks for the transition.

Q90) The County did say it would continue to use its current jail management system (AJIS) and that a replacement system was not wanted since it was not part of the RFP. Likewise, the
County said bid proposals will only be evaluated on what is being asked for in the RFP, and not any ancillary services that might be offered and desired (e.g., system upgrades, future enhancements, new technologies, etc.). But on Pages 18-19 of the RFP, the following is listed:
D. Technical Criteria:
In each area described below, an evaluation will be made of the probability of success of and risks associated with, the proposal response:
1. System Design - A comparison will be made of the proposed inmate accounting systems. Additional credit will be given for features of the proposed design that offer enhanced utility, ease of use or ease of integration with existing accounting equipment and systems.
2. Software Design and Development - The evaluation will compare the proposed software capabilities with the requirements of this RFP in terms of the software’s compatibility with existing inmate accounting and vending equipment, management and data processing systems
3. Ancillary Services - A comparison will be made of the proposed services with the requirements of this RFP.
Credit will be given for convenience, responsiveness and technical expertise and enhancements not specifically required in the Specific Requirements.
10 Points
This section seems to contradict what was previously said. Can the County please clarify what the County wants and how bids will be evaluated?
A90) The County wants a bid for basic commissary services delivered to both facilities. The bid should include a description of how the bidder intends to interface with existing
County systems as described in section D, Technical Criteria. The viability of the proposed interface will be evaluated per Evaluation Criteria D, Technical Criteria.
Q91) How do the inmates currently get amount balance information?
A91) The inmates must make a written request to the Sheriff’s staff to receive their balances.

Q92) Is the vendor or the County responsible for recycling?
A92) The vendor will be responsible for recycling.

Q93) Are the metal supports that hold and/or affix the vending machines to the wall supplied by the vendor or the County?
A93) The metal supports are to be provided by the vendor. However, oversight for the installation is conducted by Alameda County Sheriff’s Office.
Q94) How many inmates can be held in one housing unit (Housing Unit 31, Minimum Security)?
A94) The maximum capacity is 296.
Q95) Are the housing units in the jails currently wired? Do they have conduits to pull wire?
Should the winning bidder recommend kiosk ordering in these areas?
Q96) Electrical wiring and conduit to power three commissary machines on each side of the housing unit (six machines per housing unit) was installed when the vending machines were mounted to the walls. Jail staff has the ability to turn on and turn off the machines from the control room.
A96) Per the RFP, the winning bidder is required to pick up the recycling bins at each location.
Does the contractor deposit the recyclables to a central location on-site, or is the vendor responsible for taking the recyclables to an off-site location?
A96) Vendor will be responsible to remove recyclables off site. Vendor will need to provide the recycling containers that are California State Fire Marshal (CSFM) approved. The containers must be approved by ACSO and GSA prior to installation.
Q97) Are the large blue recycle bins (located by the receiving/loading dock) and the Pepsi recycle bins in the housing units supplied by the vendor or the County?
A97) Currently they are provided by the County.
Q98) Does the money from the recycling program go back to the County or does the vendor keep it?
A98) Since the vendor is removing the recyclables from the site the vendor will keep the money.
Q99) What are the dimensions of the storage area at the receiving/loading dock?
A99)
The loading dock dimensions are 20’ wide by 16’ feet deep, with a 3 ½’ staircase.
Building Maintenance Division, mailroom staff and the current commissary vendor, shares the loading dock.
Q100) There is an office space inside the receiving/loading dock. Does that office belong to the vendor? Is it a shared space?
A100) The space is shared between Global Tel Link and Canteen.
Q101) There is a floor mounted safe in the receiving/loading dock. Does that belong to the vendor or to the County?
A101) The safe located in the receiving area belongs to the County.

Q102) What is the County’s procedure for inspection of commissary orders? Does the County inspect the bags, frisk the employees, etc.? Is there an average amount of time required to clear commissary for delivery?
A102) All persons entering the facility are subject to search. This includes their person, belongings, and vehicle. There are signs posted at all entrances to the facility. Jail staff will conduct a visual inspection of all commissary bags before they are delivered to inmates. On occasion, and without notification, a Sheriff’s Office Certified Narcotics
Canine may conduct a search of the commissary bags, storage bins and vehicles. The total wait time is approximately 20 to 30 minutes.

COUNTY OF ALAMEDA, GENERAL SERVICES AGENCY-PURCHASING EXHIBIT A – BID ACKNOWLEDGEMENT
RFP No. 900644, Addendum No. 6
The County of Alameda is soliciting bids from qualified vendors to furnish its requirements per the specifications, terms and conditions contained in the above referenced RFP number. This Bid Acknowledgement must be completed, signed by a responsible officer or employee, dated and submitted with the bid response. Obligations assumed by such signature must be fulfilled.
1.
Preparation of bids : (a) All prices and notations must be printed in ink or typewritten. No erasures permitted. Errors may be crossed out and corrections printed in ink or typewritten adjacent and must be initialed in ink by person signing bid. (b) Quote price as specified in RFP. No alterations or changes or any kind shall be permitted to Exhibit B, Bid Form. Responses that do not comply shall be subject to rejection in total.
2.
Failure to bid: If you are not submitting a bid but want to remain on the mailing list and receive future bids, complete, sign and return this Bid
Acknowledgement and state the reason you are not bidding.
3.
Taxes and freight charges: (a) Unless otherwise required and specified in the RFP, the prices quoted herein do not include Sales, Use or other taxes. (b) No charge for delivery, drayage, express, parcel post packing, cartage, insurance, license fees, permits, costs of bonds, or for any other purpose, except taxes legally payable by County, will be paid by the County unless expressly included and itemized in the bid. (c)
Amount paid for transportation of property to the County of Alameda is exempt from Federal Transportation Tax. An exemption certificate is not required where the shipping papers show the consignee as Alameda County, as such papers may be accepted by the carrier as proof of the exempt character of the shipment. (d) Articles sold to the County of Alameda are exempt from certain Federal excise taxes. The County will furnish an exemption certificate.
4.
Award: (a) Unless otherwise specified by the bidder or the RFP gives notice of an all-or-none award, the County may accept any item or group of items of any bid. (b) Bids are subject to acceptance at any time within thirty (30) days of opening, unless otherwise specified in the
RFP. (c) A valid, written purchase order mailed, or otherwise furnished, to the successful bidder within the time for acceptance specified results in a binding contract without further action by either party. The contract shall be interpreted, construed and given effect in all respects according to the laws of the State of California.
5.
Patent indemnity: Vendors who do business with the County shall hold the County of Alameda, its officers, agents and employees, harmless from liability of an nature or kind, including cost and expenses, for infringement or use of any patent, copyright or other proprietary right, secret process, patented or unpatented invention, article or appliance furnished or used in connection with the contract or purchase order.

Samples: Samples of items, when required, shall be furnished free of expense to the County and if not destroyed by test may upon request
(made when the sample is furnished), be returned at the bidder’s expense.
7.
Rights and remedies of County for default: (a) In the event any item furnished by vendor in the performance of the contract or purchase order should fail to conform to the specifications therefore or to the sample submitted by vendor with its bid, the County may reject the same, and it shall thereupon become the duty of vendor to reclaim and remove the same forthwith, without expense to the County, and immediately to replace all such rejected items with others conforming to such specifications or samples; provided that should vendor fail, neglect or refuse so to do the County shall thereupon have the right purchase in the open market, in lieu thereof, a corresponding quantity of any such items and to deduct from any moneys due or that may there after come due to vendor the difference between the prices named in the contract or purchase order and the actual cost thereof to the County. In the event that vendor fails to make prompt delivery as specified for any item, the same conditions as to the rights of the County to purchase in the open market and to reimbursement set forth above shall apply, except when delivery is delayed by fire, strike, freight embargo, or Act of God or the government. (b)Cost of inspection or deliveries or offers for delivery, which do not meet specifications, will be borne by the vendor. (c) The rights and remedies of the County provided above shall not be exclusive and are in addition to any other rights and remedies provided by law or under the contract.
8.
Discounts: (a) Terms of less than ten (10) days for cash discount will considered as net. (b) In connection with any discount offered, time will be computed from date of complete, satisfactory delivery of the supplies, equipment or services specified in the RFP, or from date correct invoices are received by the County at the billing address specified, if the latter date is later than the date of delivery. Payment is deemed to be made, for the purpose of earning the discount, on the date of mailing the County warrant check.
9.
California Government Code Section 4552: In submitting a bid to a public purchasing body, the bidder offers and agrees that if the bid is accepted, it will assign to the purchasing body all rights, title, and interest in and to all causes of action it may have under Section 4 of the
Clayton Act (15 U.S.C. Sec. 15) or under the Cartwright Act (Chapter 2, commencing with Section 16700, of Part 2 of Division 7 of the
Business and Professions Code), arising from purchases of goods, materials, or services by the bidder for sale to the purchasing body pursuant to the bid. Such assignment shall be made and become effective at the time the purchasing body tenders final payment to the bidder.
10.
No guarantee or warranty: The County of Alameda makes no guarantee or warranty as to the condition, completeness or safety of any material or equipment that may be traded in on this order.
