Planning Appraisal: This application seeks planning permission for the erection of an extension and alterations to the external finish of Y Fron Bungalow, Cilcain. 1 The application site is located within the open countryside as defined within the adopted Flintshire Unitary Development and within the Clwydian Range and Dee Valley Area of Outstanding Natural Beauty. The building is currently the subject of an application for a certificate of lawful use as it does not benefit from planning permission for its use as a dwelling. The application is under consideration. The proposal comprises a small extension to provide a bedroom; the external finish to be painted render with stone quoins; and, the existing roof line to be raised and the corrugated sheet roof to be replaced with roof tiles. Given that the current use of the building as a dwelling is unauthorised, it is not possible to assess the proposal against the relevant policies relating to extensions and alterations to dwellings, i.e. HSG12. As such, it is considered that the proposal is not acceptable as it does not relate to an unauthorised dwelling. Notwithstanding the above, if the building did benefit from a lawful use as a dwelling house the proposed external finish would be unacceptable. The proposed render and stone quoin exterior and tile roof would be unsympathetic to the traditional utilitarian building and would have an adverse impact on the character of the AONB. Recommendation Code: / REFUSE Conditions/Reasons: The proposal relates to a building which does not benefit from a lawful use as a dwellinghouse. As such, the proposal would be contrary to policies GEN1 and GEN3 of the adopted Flintshire Unitary Development Plan. The proposed external materials would be unsympathetic to the character of the existing building and have a detrimental impact on the character of the Clwydian Range and Dee Valley Area of Outstanding Natural Beauty, contrary to policies GEN1 and L2 of the adopted Flintshire Unitary Development Plan. In considering this planning application the Council has acted in accordance with the Human Rights Act 1998 including Article 8 of the Convention and in a manner which is necessary in a democratic society in furtherance of the legitimate aims of the Act and the convention.
