Learning about unfair dismissals
Taken from the ABC News website Thu 21 Nov 2013
Read the following article and answer the questions below.
Ex-council CEO wins unfair dismissal case
The former chief executive officer of the Barunga West Council, Nigel Hand, has won an unfair dismissal case in
the Supreme Court.
Mr Hand claimed his employment was unfairly terminated in November last year, after almost 35 years of
service.
The trial heard the relationship between Mr Hand and Mayor Dean Dolling had broken down, which resulted in
negotiations over Mr Hand’s departure also breaking down.
Justice Michael David found Mr Hand had not acted inappropriately in his role as CEO, nor was he given
reasonable notice of his termination.
He was awarded more than $27,000 in damages.
1. Since the dismissal was found to be unfair, why do you think Mr Hand did not insist on having his job
back?

Optional Oral Communication Exercise – Group Discussion
Your facilitator will determine whether you participate in this exercise.
Effective oral communication is about more than just listening and speaking. It is also
dependent on elements such as facial expressions, body language, eye contact, using
appropriate words, responding well, encouraging others and many more …….
In this exercise, you will participate in a group discussion about the scenario described
below. Your facilitator will let you know how long the discussion will last.
Scenario
You have started in a middle management role after a rigorous interview process. After starting you
discover that the person who had been ‘acting’ in the role for the last few months had expected to get
the job. This person continually undermines you and turns other staff against you. What should you
do?
