Seminar content summary
Attorneys often need to advise clients on difficult and
ambiguous legislative provisions as well as terms in
contracts, wills and deeds. In order to provide the best advice
against the background of the Constitution, attorneys need to
resort to a variety of aids, including the rules of interpretation.

The practical learning experience is designed to put
participants in a position to cope with everyday experiences

Outcomes
 Understanding the various theories and techniques
applicable to the interpretation of statutes and other legal
documents, including contracts, wills and deeds;
 Practically apply the different approaches and techniques
when interpreting legislative enactments and contracts,
wills as well as deeds.
 Acquire a good working knowledge and understanding of
how the Constitution impacts on legal interpretation.
Presenters
Dr Henry Lerm is an attorney with a wide range of
knowledge both in practice as well as academically. He has
been involved at the School for Legal Practice at Nelson
Mandela Metropolitan University since its inception. He has
lectured there in both procedural subjects as well as
substantive law, including Constitutional Law. Dr Lerm has
presented legal training for attorneys on behalf of LEAD in
Contract Law and Medical Law.
Professor Nan van den Berg is an Honorary Professor
(Nelson Mandela Metropolitan University) and Professor
Emeritus. His LLD thesis concentrated on interpretation of
statutes and legal language. As expert in legislative drafting,
he initiated the Commonwealth Secretariat drafting
programme in the South Pacific, and has trained officials of
about 25 countries in drafting skills and statutory
interpretation. Various authors refer to his publications on the
interpretation of statute.

Cancellation of seminar (workshop)
Any person who has registered for a seminar and fails to
cancel (in writing) at least 48 hours prior to the seminar
starting, shall be held liable for the payment. All refunds
must be claimed in writing not more than 15 business days
after cancellation.
LEAD reserves the right to cancel a learning activity should
the number of delegates not justify the costs involved.
Registered delegates will be given reasonable notice of
cancellation.
