Shedding light on Administrative Scrutiny: Tenders and Licencing in areas involving public administration Two World-Class Presenters Geo Quinot is professor of law and Vice Dean in the Faculty of Law at Stellenbosch University. Prof Quinot holds the degrees BA (Law) LLB (Stellenbosch) LLM (Virginia) MA (Free State) LLD (Stellenbosch). He mainly teaches administrative law and constitutional law in the LLB degree programme. He also teaches administrative law and public procurement law at Master’s level in the School of Public Leadership of Stellenbosch University and the professional development programme of the UCT Law Faculty. Prof Quinot is the Director of the African Public Procurement Regulation Research Unit and editor of the African Public Procurement Law Journal. Prof Quinot has published widely in the fields of administrative law and public procurement regulation, including the recent books Public Procurement Regulation in Africa (with Sue Arrowsmith) (2013) Cambridge University Press and Administrative Justice in South Africa: An Introduction (2015) Oxford University Press. Aadil Patel is a director and national head of Cliffe Dekker Hofmeyr's Employment practice. He holds a BProc LLB LLM HDip (Company Law) from the University of the Witwatersrand and was admitted as an attorney in 1999. With wide-ranging experience in administrative law, Aadil maintains his focus on legislation impacting the public sector; specifically energy and water which are critical to South Africa's economic development and growth. About this seminar The presenters will deal with different elements of the topic. Prof Geo Quinot will bring practitioners up to date on the most recent developments in administrative law as it applies to a range of regulatory practice areas. The focus in this part of the seminar will be on general administrative law as applicable across the public administration and without venturing into the details of a particular area of administration. The developments discussed in this part will thus be relevant to all areas of public administration. Aadil Patel will focus on the law relating to government procurement. Seminar content Prof Geo Quinot will focus on the main principles of administrative justice as guaranteed in section 33 of the Constitution of the Republic of South Africa, 1996 and further given effect to in the Promotion of Administrative Justice Act 3 of 2000. These are the requirements that administrative action be lawful, reasonable and procedurally fair and that reasons be given for administrative action. Particular issues that have emerged from recent developments under each of these headings will be discussed. In addition, developments around the scope of application of administrative law and the continuing development of the constitutional principle of legality will be discussed as well as the remedies that are available to address administrative-law disputes.
