FINANCIAL MANAGEMENT
DISPOSAL OF SCHOOL DISTRICT PROPERTY WITHOUT A VOTE
The Board is authorized to dispose of a site, building, or any other real or personal property of the
District, that is or is about to become abandoned, obsolete, undesirable, or unsuitable for school
purposes.
To effect proper disposal, the trustees shall pass a resolution stating their decision concerning property
disposal. The resolution will not become effective until fourteen (14) days after the resolution is
published in a newspaper of general circulation in the District.
Should any taxpayer properly protest the resolution during the fourteen (14) days after the date of
publication, the trustees shall submit testimony to the court with jurisdiction.
Once the resolution is effective, or if appealed the decision has been upheld by the court, the trustees
shall sell or dispose of the real or personal property in a reasonable manner determined to be in the
best interests of the District. Proceeds from the sale of fixed assets can be deposited to the general,
debt service, building, or any other appropriate fund.
SCHOOL PROPERTIES DISPOSAL PROCEDURE
(Obsolete Instructional Materials and Equipment)
Instructional materials adopted by the Board of Trustees shall be determined to be obsolete or surplus
when any one of the following criteria has been met:
1.
The material has been in use for five years after the date of its purchase and after review has been
determined to be inappropriate.
2.
The material has been designated obsolete by the Board of Trustees.
3.
The material has been found to be in violation of content requirements of any law (eg. Title IX).
4.
The material exists in quantities exceeding the possibility of effective educational use by West
Yellowstone School District #69.
5.
The material is educationally unsound, out of date, inaccurate or in unusable condition.
Determination as to whether any of these criteria applies to material currently possessed by the
District shall be made by the Superintendent who may delegate this responsibility to qualified
personnel.
Choices of methods of disposal shall be made in the best interest of the children and patrons of
West Yellowstone School District #69.
Trade in Property
Where new property is purchased by the Board of Trustees in accordance with law on condition
that property of a similar nature, owned by the school, is to be traded in or exchanged as a part of
such purchase in reduction of the price, such trade in shall be approved without appraisal or notice
of sale.
Sale of Property
1.
A notice of sale shall be published at least once. This notice shall set out the terms of the sale, by
written sealed bid or by auction, and state the date, time and place the bids shall be received.
a.
Written sealed bids sale--prior to the date of the bid opening, written sealed bids clearly
marked shall be received from all interested parties by the Clerk of the Board of Trustees.
The highest responsible bid shall be accepted.
b.
Auction bids--at a set, advertised time and place, sale shall be to the highest oral bidder.
Any interested party who cannot be present at the auction may submit a written bid,
accompanied by the amount of the bid in cash or by check, to the Clerk of the Board of
Trustees.
2.
The Board of Trustees may sell the property to the highest bidder or may reject all bids
received.
