(AMENDMENT) (ENGLAND) ORDER 2013

Request for Prior Approval:-

Class J – change of use from Class B1(a) (offices) to C3 (dwellings)

Class K – change of use from Classes B1, C1, C2, C2A and D2 to state funded school

Class M – change of use from Agricultural to flexible use A1 / A2 / A3 / B1 / B8 / C1 & D2

For proposals within Class J and K, and for proposals under Class M where the floorspace subject to the change exceeds 150 square metres and does not exceed 500 square metres, the local planning authority will have to consider the following (see the Classes in brackets below):-

(a) Transport and highways impacts of the development (J, K and M)

(b) Contamination risks on the site (J, K and M); and

(c) flooding risks on the site (J and M)

(d) noise impacts of the development (K and M)

The 56 day determination period for the Council to make a decision, provides limited time for applicants to respond to any request made by the Council to submit any further information in respect of the issues set out in (a) to (d) above. Without sufficient information being provided to fully consider the impact of the development, the Council will not be in a position to make an informed judgement on whether prior approval should be given. Hence, it is strongly recommended that full supporting information is provided at this stage, if a decision based on the absence of sufficient information is to be avoided.
