Tender Instructions
The contents set forth herein shall be prepared by the Los Angeles Office of the Tourism
Bureau of the Ministry of Transportation and Communication ( hereinafter "TTB" or
"Governing Authority"). Bidders are not allowed to amend or correct the contents herein.
TTB shall complete the tender instructions based on each bidder.
1. This procurement is made in accordance with the R.O.C. Government Procurement Act
(hereinafter referred to as “Act”) and the regulations of the entity in charge.
2. Project Name: 2010 ~ 2011 Tender for North America Region Public
Relations/Marketing Plan commissioned by the Los Angeles Office of the Tourism
Bureau of the Ministry of Transportation and Communication
3. Type of procurement:
(1) Construction
(2) Property (i.e., material goods): � purchase; � rent; � manufacture/customize;

4. Procurement amount:
(1) Less than one tenth of the amount released to the public ("Public Amount").
(2) More than one tenth of the Public Amount but less than reserved amount of
Procurement ("Reserved Amount").
(3) More than Public Amount but less than appraised Reserved Amount of
Procurement ("Audited Amount").
(4) More than the Audited Amount of Procurement but less than the amount for
large procurement.

5. This Procurement is:
(1) Joint supply contract.

6. Estimated budget of the Procurement (Non-public bidders need not submit an
estimated budget of their procurement; provided, however, public evaluation and
selection shall be based on (non-public bidders' qualifications and special or Large
Procurement) Article 5, item 3 of the Act or procurements over such non-public bidders'
Audited Amount, selective bids and limited bids of the procurement, except where such
procurement is for the purposes of commercial resale, resale after
manufacturing/customization, or estimated budgets containing commercial secrets. The
total sum of the procurement expenditure shall be USD $625,000.00 (NTD

$19,690,000, tax and service fee included), which includes annual public relation fees
and out of pocket expenses for advertising and media marketing fees).
7. The estimated budget of the procurement (Non-public bidders need not submit an
estimated budget of their procurement):
The total expenditure of the procurement shall be USD $625,000.00 ( NTD
$19,690,000, tax and service fee included). Such expenditures include annual public
relations fees and out of pocket expenses for advertising and media marketing fees).
The governing authority shall be TTB.
8. Pursuant to Article 4 of the Act, bidders accepting assistance from and any judicial
personnel or organization and TTB shall provide their name and address (Bidders not
falling under this category will not need to complete this section).
9. Pursuant to Article 5 of the Act, any individual or entity representing the bidder or
delegated authority shall provide his/her/its name and address (Bidders not falling
under this category will not need to complete this section).
10. Pursuant to Article 40 of the Act, any individual or entity representing the bidder or
intermediary shall provide his/her/its name and address (Bidders not falling under this
category will not need to complete this section).
11. Pursuant to Article 75 of the Act, the supplier objecting ("Objecting Supplier") such
procurement should provide its name, address and telephone number: the same entity
(In the event of a different entity, such different entity shall submit in writing its name,
address and telephone number).
12. Pursuant to Article 76 and 85-1 of the Act, the name address and telephone number of
the responsible member of the Complaint Review Board for Government Procurement
(“GRBGP”) reviewing the supplier's objection (for procurement value of less than the
Public Amount) or compliance dispute (no procurement amount limitation): Public

13. The procurement:
(1) has been processed as a whole.
(2) has been processed in sections, namely: the procurement value being over the
Public Amount, approval by the necessary governing authority (approval number),
calculation of the aggregate sum of procurement value, processing of the Public
Amount or Appraised Amount pursuant to the application sections of the Act.

(3-4) Processing according to Article 22, item 1, subparagraph __ (please

suppliers and to invite suppliers to compare and negotiate prices.
(4) Obtain public written price quotations or business proposals pursuant to the
regulations set forth in Article 49 of the Act. (Except for proposals of
procurement value not reaching the Public Amount).
15. This procurement:
(1) Shall be governed by the regulations set forth in the treaties or agreements to
which this nation is a party; the names of the treaties or agreements: (please
indicate) GPA – Government Procurement Act.
Suppliers of non-treaty foreign countries:
May not participate in the bidding.
May participate in the bidding, and participate in a fair and reasonable
manner (shall indicate the names of foreign countries or regions. If TTB

participation process should be governed by related import and transaction
regulations between Mainland China and Taiwan).

Can participate in the bidding, but shall accord with the following differential

of procurement).

16. The procurement:
Process the procurement as a whole according to Article 24 of the Act.
Process the procurement not on a whole.
17. The procurement:
According to the requirements of Article 25 of the Act, TTB may permit joint bidding
(the agreement of joint bidding shall be included in bidding documents); the
maximum number of suppliers: 2; 3; 4; 5.
TTB may not permit joint bidding.
18. Should suppliers have inquiries regarding the contents of the bidding documentation,
such inquiries shall be submitted in writing to TTB before the deadline as set forth for
the purpose set forth in the bidding documentation. The time period for submitting
such inquiries shall be one quarter of the period commencing from the publication
date or invitation date to the bidding date. In the event the period is not a whole day,
the period shall be rounded to the next full day.
19. The reasonable time-limit for TTB to respond in writing for the above requests to the
inquiring suppliers: one day before the deadline for the bidding.
20. Procurement Meeting: to provide suppliers with an explanation of the procurement, a
procurement meeting will be held on August 10, 2010, 15:00p.m. at the conference
room of Hilton Los Angeles / Universal City ( Room 6A, 555 Universal Hollywood dr,
Universal City, CA 91608.) TTB shall provide all related information and caution
particulars of the procurement. Suppliers are allowed to attend the meeting; Absentee
suppliers may not request TTB to hold another procurement meeting for any reason.
21. According to Article 33, item 3 of the Act:
Suppliers are permitted to amend or supplement an essential part of its bid before
opening of bids.
Suppliers are not permitted to amend or supplement an essential part of its bid

22. According to Article 35 of the Act:

(1) Suppliers are allowed to submit alternatives to shorten construction period,
save expenditures, or increase the efficiency of the construction, provided that the
original purpose is not impaired (please indicate the permissible alternatives).
(2) Suppliers are not allowed to submit alternatives.
23. Validity period of the bidding documents: from the bidding date to 60 days after bidding
date.
24. The number of bidding documentation the supplier shall submit:
(1) One copy per set.
(2) Two copies per set.
(3) Three copies per set.
(4) Four copies per set
(5) Five copies per set.
(6) Miscellaneous (The procuring authority should enumerate.): certified documents
of suppliers, one copy per set; and service proposal, eight copies per set.
25. The language used in the bidding documentation:
(1) Chinese.
(2) English and other language required set forth in the bidding documentation.
(3) Miscellaneous (the procurement entity should specify).
26. The date of publicly opening the bidding shall be (not applicable to non-public bidders
according to the Act):
(1) Evaluation for the qualification of the supplier:
i.

After opening the bid for this procurement, the qualification and certified
documentation of the suppliers shall be reviewed. The supplier who passes
the qualification evaluation shall be submitted to the Professional Service
Proposal for evaluation. The supplier who does not pass the qualification
evaluation may obtain its bidding documentation with a receipt issued by
TTB.

untrue, forged or altered, whether the supplier has been awarded with the
contract or not, TTB shall cancel the supplier's qualification and take care of
the forgery/misrepresentation pursuant to the applicable law.
If a collusive tender conducted by a supplier (or person) for illegal gains is
found during the opening bidding period, such supplier's tender qualification
shall be immediately voided and forwarded to the applicable judicial entity.
The same shall also be applied to those found guilty after the contract has
been awarded.

The suppliers participating in a tender shall send a staff (not more than 2
persons) to attend the bid opening. One of them should be an authorized
representative or duly authorized agent (the authorized representative or
duly authorized agent should present with the proper documentation).
The bidding documentation shall be deemed void if the submitted bidding
documentation are found in any of the following circumstances during the bid
opening period:
1. Where the envelope is not sealed.
2. Where the certificates are not placed in the envelope.

Where one supplier turns in two different sets of bidding documentation
or more.
If TTB has any questions about the information submitted by suppliers, TTB
shall ask the supplier to answer the questions during the tender opening
period. If the supplier refuses to answer or is not willing to be cooperative,
the tender qualification of suppliers shall be deemed as abandoned.
According to Article 38 of the Act, a political party and a supplier which is
affiliated to a political party shall not participate in tendering.
(2) Evaluation of the Professional Service Proposal:
1. Time and place: all the suppliers who pass the qualification evaluation
shall be advised of the time and place for presentation and evaluation of
the Professional Service Proposal.
2. Evaluation items, standards and measures refer to Article 9 in Tender
Specifications.
27. The address of the public bid opening (non-public bidders not required to complete
according to the Act): the conference room of TTB (address: 3731 Wilshire Blvd.,
Suite 780, Los Angeles, CA 90010, U.S.A.).
28. The bid opening procedure of this procurement is:
(1) One step opening of bids.
(2) Multi-step opening of bids (please check the following items); suppliers
participating in a tendering shall separately seal tender envelops for each tendering
step (same as Article 26, item 1, subparagraph 2).

34. The bid bond and guarantee bond shall be deposited by bidders in the form of cash,
financial institution’s promissory notes, financial institution’s checks, certified checks,
postal money orders, bearer’s government bonds, certificates of deposit pledged to
the procuring entity, irrevocable stand-by letters of credit issued or confirmed by a
bank, or bank guarantees or insurance policies under which the bank or insurer
shares the liability with the bidder jointly and severally, and deposited under the
regulations which govern the payment of bid bond, guarantee bond, and other
guarantees.
35. Bid bonds shall not be refunded to the bidder or the refunded bid bonds shall be
returned in the following circumstances:
(1) The bidder used forged or altered documents to bid;

(2) The bidder borrowed the name or certificate of another to bid;
(3) The bidder assumed the name or certificate of another to bid;
(4) The bidder withdrew its bid before expiration of the bid;
(5) After opening of bids, the bidder refused to be awarded or refused to
execute a contract;
(6) After being awarded, the bidder failed to deposit sufficient guarantee bond
or to provide other guarantees sufficiently within a prescribed time-limit;
(7) A bid bond has been served as a guarantee bond; or
(8) The responsible entity found that there is a violation of laws and
regulations which affects the fairness of the procurement.
36. Suppliers may reduce their bid bonds according to the 「Regulations for Bid Bond,
Guarantee Bond, and Other Guarantees」. If circumstances necessitates non-return
of the amount of bid bonds, the Supplier shall make up such additional amount which
was reduced or deducted by the Supplier.
37. The procurement:
(1) Set the lowest price, but such price shall not be released to the public.
(2) Set the lowest price and such price shall be released to the public. Lowest price:

(3) The reasons for not setting the lowest price are: � where there are material
difficulties in setting the lowest price due to special or complex circumstances;

39. The procurement:

(2) Adopts multiple contract award, reserves the right of combining the choice of
items or quantity (the measures of the choice of items or quantities combinations are
prescribed in the supplement documentation).
40. The measure of contract award shall be based on:
(1) overall price.

(3) separate team.
(4) quantity.
(5) single price (determination of the bid winner is based on the product of the unit
price multiply by the estimated quantity).

41. Whether negotiations should be conducted according to Article 55 and 56 when the
contract cannot be awarded:

42. The procurement reserves the awarded supplier’s right of extending purchase, the

43. The procurement shall be conducted in accordance with the Act:

44. The certificate documentation of basic qualification of suppliers participating in bid are:
(1) Basic qualification: advertising company, public relations company or
travel company.
(2) Copies of certified documentation of basic qualification:
1. Certified documentation of company formation.
2. Valid proof of credit shall include the following: proof provided by a
banking or financial institution within 6 months before the bid
solicitation deadline, that supplier was not black listed for any
banking purpose, or proof that no record exists as to
bounced/cancelled checks in the last three years. Credit reports

issued by an accountant in the manner of a certified financial
statement, by a financial institution or by a credit bureau.
45. TTB shall notice suppliers to provide the original copies of the certified documentation
in time for TTB to evaluate when necessary, when the original copies of the certified
documentation are found to be different from the copies or forged documents or
documents with unauthorized modifications provided before the evaluation, the
suppliers shall be treated according to the requirements of Article 50 of the Act.
46. The documents of tender qualification and other related qualification documents
provided by foreign suppliers should be notarized and translated to Chinese (foreign
suppliers prohibited to participate in the procurement need not fill this form): if the
foreign suppliers have any difficulties in providing certain sections of the preceding
documents under the circumstance of their countries, they should describe the
circumstance in the bid documents or substitute by other related qualification
documentation.
47. The instructions of efficiency, conditions, criteria, quantity or the place of the bids and
the successful bidder’s contractual duty: provided by the bidding entity in the
supplement 「Contract」.
48. Should a requirement or reference to a particular trademark or trade name, patent,
design or type, specific source of origin is required, the suppliers are allowed to
provide the “equivalent”, in which:
(1) Suppliers shall provide in advance in the bid documentation should describe the
brand, price and performance, efficiency, criteria, or conditions and other related
information of the “equivalent”, in order to evaluate.
(2) Before using the “equivalent” by the successful bidder, the suppliers should
describe under the contract to TTB about the brand, price and performance, efficiency,
criteria, or conditions and other related information of the “equivalent”, in order to
evaluate.
49. The suppliers’ conditions for the awarded price:
(1) Delivery to the designated place provided by the procurement entity (the
procurement entity should provide the address).
(2) Complete the work at the designated place provided by the procurement entity
(the procurement entity should provide address): United State of America.
(3) Miscellaneous (prescribe by the procurement entity).
50. The currency used by the bidder:
(1) New Taiwan Dollar.
(2) Foreign currency: US Dollar (the category of designated currency should be
enumerated by the procurement entity).

(3) New Taiwan Dollar or foreign currency: ____ (type of foreign currency to be
designated by the procuring agency, the total amount of the foreign currency should
be calculated based on the exchange rate for the last selling transaction of the foreign
exchange board of the Bank of Taiwan the day before the contract award date).
51. When the subject of the procurement involves intellectual property, TTB shall:
(1) own all the rights to such intellectual property.
(2) own partial rights to such intellectual property (the procurement entity should
describe parts of the authorization process).
(3) be authorized to use such intellectual property (the procurement entity should
describe the authorization process). (no need to complete the section if the subject of
the procurement does not involved any intellectual property).
52. The maintenance of the subject of procurement (no need to complete this section if
maintenance is not required):
(1) Shall be conducted by the bid winner for a fixed period of time, maintenance
expense should be included in the awarded contract price (the procurement entity
should describe the required maintenance period):
(2) The procurement entity shall be responsible for the maintenance.
(3) Initiate another procurement process by way of bid solicitation.
53. In the event any of the following circumstances occurs to a supplier, the supplier is
prohibited from participating in bidding, or being awarded a contract or subcontracted or assisting the supplier:
(1) Where the supplier is one who drafted the bidding documentation for
another supplier for the same procurement.
(2) Where a supplier who provides the service of bid evaluation for the
procurement related to the service.
(3) Where because of performing the contract, a supplier gains secret
information that other suppliers are not able to gain and uses such
information to obtain the contract.
(4) Where a supplier who provides professional project management for the
procurement which is related to the service.
In the event of solicitation of design by the procuring entity, such supplier may
participate in the provision of design service for the follow-on stage work,
where such supplier would lose its competitive advantages if its planning
product for the initial stage work were to be published.

55. The bidder shall fill (use pen only) the statement form attached in the bidding
documentation required by regulations; the bid with the qualification documentation
and related documentation pursuant to the applicable law shall be sealed and

the date stated above would not be considered. Please make sure the documentation

57. Regulations which are not written in the instruction should be governed by the
Government Procurement Act or other related laws.
