Motion by Smith, second by Juhl to approve minutes of the last meeting. All ayes, motion carried. At 9:00 Chairman called to order IA DOT Purchase Agreement Public Hearing per Section IA Code 331.361. Present: Eric Anderson, Emmet County Conservation and Mike Tidemann, Estherville News. Anderson voiced concerns regarding potential damages to the Jim Hall Habitat Area and who would be responsible and if any of the easement payment would be distributed back to the County Conservation Board. According to the DOT Purchase Agreement, all damages will be taken care of by the DOT and the payment is basically rent. If necessary, the Board agreed that any damages would be paid first and the remainder divide according to the original Jim Hall Habitat Area funding sources. Motion by Schumacher, second by Smith to close hearing. All ayes, motion carried. Motion by Martyr, second by Schumacher to approve Resolution No. 14-07: County Political Subdivision Certification of Resolutions Sale of Real Property and Delivery of Conveyance. Roll call vote. Resolution No.14-07 COUNTY POLITICAL SUBDIVISION CERTIFICATION OF RESOLUTIONS SALE OF REAL PROPERTY AND DELIVERY OF CONVEYANCE Parcel No. 2 Emmet County Project No. STPN-004-6(32)--2J-32 Primary Road No. 4 I, the undersigned, Michele Erickson, County Auditor of Emmet County, Iowa, a political subdivision duly organized and existing under the laws of the State of Iowa, DO HEREBY CERTIFY that notice of a pending sale of real estate has been published at least once, not less than four or more than twenty days before the date of the hearing in a newspaper published at least once weekly and having general circulation in Emmet County, Iowa, in accordance with the Code of Iowa; that a public hearing has been held and the following is a true and exact transcript of certain resolutions duly adopted by the members of the Board of Supervisors on the 10th day of June, 2014, by the call of yeas and nays recorded below and these resolutions are now in full force and effect: RESOLVED, that this political subdivision is hereby authorized to grant and convey a permanent easement to certain County property to the State of Iowa for the purchase price of $1,825.00 plus $6,915.00 for damages, and other certain benefits, terms and conditions as set forth in a Purchase Agreement signed by Alan Madden, Chairman of the Board of Supervisors, and Michele Erickson, County Auditor, 10th dated June, 2014, relating to Emmet County Project No. STPN-004-6(32)--2J-32, Parcel No. 2, and as more particularly described in a certain Easement for Public Highway and the Acquisition Plat designated Exhibit “A” attached to said easement. RESOLVED FURTHER, that Alan Madden, Chairman, and Michele Erickson, Auditor, are hereby empowered and directed to execute and deliver in the name of this political subdivision, the Easement for Public Highway and any other instruments of title required by law or which may, in the judgment of such officers, be necessary or desirable to effectuate the sale, grant and conveyance of the property to the State of Iowa. In the past 5 years, the fund has provided more than $1.65 million in low income housing repairs with $171,678 in Emmet County. Both Zinn and Keizer expressed their thanks to Jon Martyr and Mike Tidemann for their support as Housing Trust Fund board members. All ayes, motion carried. Madden reported engineer applications to close mid-June and requested interview questions for engineer hiring committee by June 24th. Nancy Danielson, Blum Leonard Insurance, provided information on Emmet County’s casualty, liability and property insurance, Iowa Communities Assurance Pool (ICAP). Danielson explained that unlike the county’s previous insurance ICAP (effective December 1, 2013) does not pull driving records for present or new employees and instead allows the county to make their own risk management decisions. Danielson also discussed cell phone policies for both employees driving county owned vehicles and driving their own vehicles for work. Of interest, CDL operators are required to use hand free devises, one-touch dialing and prohibited from texting. The Board canvassed the results of the June 3, 2014 Primary Election. Motion by Smith, second by Juhl to approve the results as listed in the canvass book. The canvass book is on record in the Auditor’s office for review. All ayes, motion carried.
