Smart bought a car from Puff Cars. A week later he returned to ask Puff Cars
to install a remote controlled alarm system. He was asked to sign an invoice
which read:
“Puff Cars will not be liable for breach of any conditions or warranties
express or implied by statute or otherwise in respect of parts supplied.
We promise to take all reasonable care of vehicles left on our premises;
However, customers should note all cars are left at owners’ risk.”
Smart collected the car from the garage and parked it in the forecourt so that he
could go and pay for the alarm. When he returned to the car and switched the
alarm the alarm failed to function. Smart called the manager and started to
complain. At that point a mechanic who was driving another car into the
garage negligently hit Smart’s car and damaged the wing on the passenger side.
Smar wants Puff Cars to replace the alarm and repair the damaged wing but
Puff Cars point to the invoice and dispute liability.
