TENDER NOTICE
SUB: WASTE/ RECOVERED SULPHURIC ACID
We are having about 1000 MT of Recovered / Waste Sulphuric Acid annually for sale
on ex-works basis in our factory, Udyogamandal , Cochin. We invite your competitive offer
for the purchase of the same.
The price is to be quoted on the basis of per tonne ex–our works . The acid will be dark
in colour of concentration not less than 60-65% .. The material is a bye product acid from the
DDT plant.
Please send your offer in sealed envelope superscribed “ Tender for Recovered
Sulphuric Acid” to reach here on or before 2.00 pm on 16.09.2014. The offer is subjected to
the terms and conditions given below:-
GENERAL TERMS AND CONDITIONS
1. Contents: Total suspense carbon and organics in the Recovered Sulphuric Acid will be
less than 3% by weight of Acid.
2. Guarantee for lifting material: The tenderer shall take delivery of the material daily
subject to availability unless otherwise advised.
3. Period : The Period of contract shall be normally for one year from the date of offer but
can be reduced at the discretion of HIL.
4. HIL reserves the right to sell the acid to any customer, any quantity at the discretion of
HIL .Since there is limited storage capacity and immediate clearance of material is
required first come first serve will be basis of supply. Quoting highest rate will not
confirm right on the respective tenderer that material has to be sold to him only. However
preference will be given to highest tenderers as far as possible.
5. Inspection: The purchaser shall have to satisfy himself regarding quantity strength etc of
the acid prior to taking delivery of materials. HIL shall not entertain any compliance in
this regard once the material is delivered to the tenderer or his agent.
6. Delivery: The acid shall have to be taken by the purchaser at HIL works in the purchasers
own tanker lorries.
7. Payment: 100% cost of the material , Sale Tax and other duties has to be remitted in
advance , drawn in favour of HIL, Payable at Udyogamandal or Kalamassery.
8. Insurance: The responsibility of HIL ceases the moment the acid is delivered to the truck
of Contractor. We cannot held responsible for any loss thereafter at sight or during
transit. The contractor may arrange for insurance at him own cost if he so desires.
-29. The company reserves the right to accept or reject any or all offers without assigning any
reason
10. The tender should be valid from acceptance for one month from the date of the offer. The
contractor must give, authorization to the transporter each time for collecting the material.
HIL is not responsible for non-delivery / shortage/ loss of material.
11. The successful tenderer herein after called contractor is bound to obey the instructions
from our security personnel.
12. The contractor will be liable to insure his employees under personal injuries
(Compensation Insurance Act ) 1963 and any other such legislation for the being in force
applicable to such employees and intimate the company the name of the Govt. agent with
whom the insurance has been taken. The contractor shall also supply to the company all
such information with regards to insurance under the personal injuries ( Compensation
Insurance Act 1963) are required to be supplied under the said act and scheme formed
therie under. The contractor will be liable to intimate the compensatory against any claim
made or action taken against in respect of his failure to adhere to the provisions of said
act and the scheme.
13. HIL reserves the right to cancel the contract at any time with out assigning the reason by
giving one months notice .
14. The offer is subject to force majure. HIL shall not be responsible for any failure or delay
in performance of this contract caused by the accident fire wind storm ,flood, strike or
sabotage, civil commotion, confiscation or preface to loss or regulations imposed by any
govt: or local authorities De-jure or De-fact to or any other act caused or matter which
may be considered as an act of God or or Force-Majure.
15. ARBITARION:All dispute difference s arising between the parties in respect of contract
or breach thereof will be decided by arbitration by General Manager HIL or any one
appointed by him. The arbitration by is to be persuaded. Under the Indian Arbitration Act
and the rules framed there under. The decision of the arbitration on questions as to
whether there is a concluded contract will be final and binding all parties to the
proceedings. The law applicable will be the law of India.
16. JURISDICATION: All disputes or cases arising out between the parties and HIL is
subject to the jurisdiction of Cochin Court.
17. Safety while transportation : The buyer must ensure that his transporter of acid is to be
collected from as on his behalf, with all the regulations and conditions , statutory or
otherwise on safety In particular the transporter should move the vehicle on the roads if
the tanker with the material is in a leaking condition or if leakage is found, all precautions
must be taken to avoid, damage to public properties , nuisance and injure to the public. In
such situation the tanker must be kept alone in a safest place possible and all action must
be taken to prevent leakage. The buyer must ensure that the tanker crew must know about
the hazardous nature of the acid and procession of necessary materials in order to prevent
leakage etc..if it arise.

18. It is the responsibility of the buyer to arrange only those tankers which are in fit condition
for carrying the material. Needless to say that transporter must comply with statutory
regulations such as road transporter must comply with statutory regulation such as road
permits etc. The buyer is responsible along with the transporter in case of violation of any
statutory requirements.
19. The buyer should send his authorization letter giving the name of the transporter with
attestation of the signature of the driver.
20. Please return the terms and conditions duly signed along with your offer, in each pages as
token of acceptance of the same.
