The Ministry of Foreign Affairs hereby announces its desire in the above bidding in
accordinnace with the terms conditions and specifications stated in the document of legal
conditions and technical specifications.
1. The documents may be obtained from (Cashier Section, Administrative &
Financial Department) during the official working hours against a nonrefundable fee of KD 74/-.
2. The closing date for offer submission shall be at 1.00 p.m. on the fifth day
calculated from the pre-tender meeting date. Any offer to be submitted after
this date will be rejected. Also any change or modifications in the quoted offer
rates will not be considered after the closing date.
3. A pre-tender meeting shall be held ten days from the announcement of this
notice.
4. The initial guarantee shall be KD 2000/-, which is the announced amount in the
official gazette, to be submitted in the form of a letter of guarantee or certified
cheque issued by a local accredited bank in the same amount in favour of the
Ministry of Foreign Affairs. This guarantee shall remain valid for the entire
offer period (90 days) pursuant to Article 5 of the bidding documents. This
guarantee will be refunded to unsuccessful bidders when the successful bidder
provides the final guarantee and signs the contract. No interest shall be
payable for this guarantee and the bidder creditors shall have no right to retain
this amount. The amount of the final guarantee is 10% of the total contract
value. This guarantee shall be valid until the completion of the works under
this bidding throughout the entire contract period in addition to 36 months
which is a warrantee period for the devices according to the conditions of the
Central Authority. Any penalties, administrative expenses, indemnities or the
like which may be due for the Ministry of Foreign Affairs shall be deducted.
5. The successful bidder shall pay 10% of the contract value, after signing the
contract, as a final guarantee as mentioned in Article 3 of the tender conditions.
6. The term of this contract is one full calendar year effective from the contract
signing date and the bidder shall commence his work satisfactorily according
to the conditions stated therein under the supervision of the competent
authority in the ministry (Administrative and Financial Department).

7. The penalties payable by the bidder to the ministry against the violations
committed by it shall be pursuant to Article 15 of the bidding documents
showing the value of these penalties against every violation.
8. The offer shall be valid for 90 days as from the date of opening the envelope.
9. The successful bidder shall pay 10% of the contract value, after signing the
contract, to be used as a final guarantee as mentioned in Article 3 of this
bidding conditions.

11. The bidder shall purchase his requirements from the materials, tools, devices or
goods from the national products or such products of national origin according
to the Minister of Commerce & Industry Resolution No. 6 of 1987 amended by
his Resolution No. 23 of 1987 and Resolution No. 282 of 2000 whose
provision shall be an integral part of this contract, any violation to this
obligation shall be subject to the application of a penalty of not less than 20%
of the purchased items value in addition to the other penalties prescribed for
the breach by the contractor of his contractual obligations, together with the
complying with the provision of the Cabinet Resolution No. 412 taken its
Meeting No. 23/99 dated 13.6.2000 on the support of the National Products
and Local Contractors.
12. The bidder shall observe the Cabinet resolution adopted in its Session No. 2/85
dated 13.1.1985 on the training of Kuwaiti Technical Cadres, because he shall
comply, in case of supply of technical devices requiring a continuous technical
maintenance and management, with providing training for the staff to be
appointed by the ministry to carry out the task of the management and
maintenance, provided that the ministry shall provide the bidder with the lists
of the number and names of those employees it would like to train on the
devices under this contract.
13. All the bidding documents are personal for the bidders who have already
collected the same, and shall not be transferred to third parties in any way
whatsoever.

The third party insurance shall be KD 25000/- (Twenty Five Thousand Kuwaiti
Dinars).
The bidder shall undertake to fully and expressly to implement all the terms and
conditions stated in this bidding as a basic condition for accepting his offer and
deciding on it.
Implementation for this tender works shall be 24 months from the date of work
commencement order.
The final guarantee (contract bond) shall be 10% of contract value in a form of a
bank guarantee in favor of PAHW issued by a local accredited bank and valid
throughout the contract works implementation period. The bidder has no right
claim for any interest against this guarantee and the bidder creditor has not right
reserve the same.
