On motion of Mr.,seconded by Mr., the following resolution was offered:
RESOLUTION NO.
A resolution ratifying Amendment No. 15 to the Engineering
Agreement between the Parish of Jefferson and BCG Engineering &
Consulting, Inc. (formerly Brown, Cunningham & Gannuch, Inc.), which
Agreement was authorized by Resolution No. 70611, adopted
December 4, 1991, to establish a new contract termination date of
June 30, 2015 for all services associated with the Drainage Capital
Improvements Program Management Services for the Parish Wide
Southeast Louisiana Urban Flood Control Project (SELA), LCDA and
other drainage related tasks, and to decrease the contract cap by
$95,000.00 from an annual not-to-exceed fee of $1,415,000.00 to an
annual not-to-exceed fee of $1,320,000.00. (Parishwide)
WHEREAS, there is an Engineering Agreement between the Parish of Jefferson
and BCG Engineering & Consulting, Inc. (formerly Brown, Cunningham & Gannuch,
Inc.) dated March 13, 1992 and authorized by Resolution No. 70611 dated December 4,
1991, to provide engineering services for Drainage Capital Improvement Program
Management Services for the Parish-Wide Southeast Louisiana Urban Flood Control
Project (SELA) as amended by Amendment No. 1 through 14; and
WHEREAS, the currently estimated Total Project Costs of the improvements to
the storm water flood protection system in Jefferson Parish under the SELA Project is
$995,741,000; and
WHEREAS, $700,000,000 of the said improvements are scheduled to be
constructed through June 2013; and
WHEREAS, an additional $160 million of the said improvements are scheduled
to be constructed in the two years from June 2013 through June 2015, respectively;
and
WHEREAS, construction of the 14 remaining SELA projects will be funded by the
Federal Government with the Jefferson Parish share to be paid back over a 30 year
period; and
WHEREAS, the current agreement expires on June 30, 2013; and
WHEREAS, it is necessary to continue Drainage Capital Improvements Program
Management Services to provide Jefferson Parish oversight of the remaining work; and
WHEREAS, the current contract completion date must be extended from June
30, 2013 to June 30, 2015; and
WHEREAS, basic and supplemental service fees have been revised based on
the current level of services being provided; and
WHEREAS, the annual not to exceed fee shall therefore be reduced to
$1,320,000.00 for expenditures related to drainage improvements, which includes
SELA, LCDA and other drainage related tasks.
NOW, THEREFORE BE IT RESOLVED by the Jefferson Parish Council of
Jefferson Parish, Louisiana, acting as governing authority of said Parish:
SECTION 1. That the Jefferson Parish Council does hereby ratify Amendment
No. 15 to the Engineering Agreement between the Parish of Jefferson and BCG
Engineering & Consulting, Inc. (formerly Brown, Cunningham & Gannuch, Inc.) which
Agreement was authorized by Resolution No. 70611, adopted December 4, 1991, to
establish a new contract termination date of June 30, 2015 for all services associated
with the Drainage Capital Improvements Program Management Services for the Parish
Wide Southeast Louisiana Urban Flood Control Project (SELA), and to decrease the
contract cap by $95,000.00 from an annual not-to-exceed fee of $1,415,000.00 to an
annual not-to-exceed fee of $1,320,000.00.
SECTION 2. That all other terms, provisions, and conditions of the Agreement
dated March 13, 1992 as amended by Amendments Nos. 1 through 14, except as
specifically modified by this Amendment No. 15 shall remain in full force and effect.
SECTION 3. That the annual not-to-exceed costs will be charged to Budget
Account No. 45270-4090-7451(52710.001), Contract No. 55-00005509.
SECTION 4. That the Chairman of the Jefferson Parish Council or in his absence
the Vice-Chairman, be and they are hereby authorized to sign and approve all
documents necessary to implement this resolution.
The foregoing resolution having been submitted to a vote, the vote thereon was
