Hurstwood Farm Equestrian Centre Short Livery Agreement 2014 For horses accompanying Owners on a Horse Holiday Hurstwood Farm Equestrian Centre Short Term Livery Agreement THIS AGREEMENT is made the BETWEEN [ day of ] trading as Hurstwood Farm Equestrian Centre ("HFEC") and Name……………………………………………….. Address…………………………………………………………………………………. ("the Owner"). This Agreement is for short term Stable/Grass Livery as hereinafter defined in the Schedule. Short term livery agreements are only available to Owners renting a holiday cottage for the same period as the livery agreement and paying for the agreed livery in advance. It is agreed between HFEC and the Owner as follows:1. Yard opening and closing times are from 8.00 a.m. until 7.00 p.m. This may be varied from time to time as necessary by prior agreement. 2. All horses are required to have third party and public liability insurance and satisfactory evidence of this will be required by HFEC. 3. All horses must be Passported and have up to date Flu/Tet vaccination. 4. All tack equipment belonging to the Owner is stored at HFEC entirely at the Owner’s risk. HFEC accept no liability for loss or damage to tack and equipment left in the stable yard or farm environs. 5. All Owners will have free use of the Arenas, subject to availability and prebooking 24 hours in advance. 6. The Owners of all livery horses must liaise with the Yard Manager before altering any feeding routines, i.e. replenishing hay nets etc 7. Livery is paid in advance with the associated cottage rental. 8. Rugs are to be supplied by the Owner. Their maintenance and repair is the responsibility of the Owner. 9. Vet and farrier visits will normally be arranged and paid for by the Owner. If the Owner is unable to be present, HFEC should be notified of such visit in good time and a cheque payable to the appropriate person should be left prior to such visit. However HFEC reserves the right to call the vet on the Owner's behalf and cost in an emergency if the Owner is not contactable. 10. The Rules for the use of the facilities at Hurstwood Farm are attached or available in the Office. These rules are for the safety of all concerned and must be adhered to at all times. 11. The Arena rules must be adhered to. All jumps must be put away after use and any manure is to be picked up immediately your horse has been untacked. 12. Reasonable use of the Cross Country Course is available free of charge to Full Livery clients only. Grass livery clients are to pay a nominal £10.00 per use. 13. Use of permits to hack on Ashdown Forest are available at a daily charge of £15. Permits must be pre-booked 24 hours in advance. 14. Any damage caused at HFEC by the Owner, their horse, their property or their visitors will be the Owner's responsibility. 15. Although HFEC take the utmost care to ensure the safety of all horses no responsibility is accepted for any personal injury or loss or damage to property (including horses, equipment or vehicles) except where caused by the negligence of HFEC. 16. Riding hats to the current BHS standard must be worn at all times whilst mounted. This includes visiting instructors. 17. HFEC reserves the right to allocate grooms and accommodation as it thinks fit. 18. Any disputes between Owners or any disputes between the Owner and HFEC will be determined by HFEC acting reasonably and whose decision will be final and binding on all parties. 19. If any sums due to HFEC under this agreement are due but unpaid the Owner must pay HFEC on demand interest @ 7% above the base rate of the Bank of England, on those sums until payment in cleared funds. 20. The owner and its visitors must comply with all regulations imposed by HFEC from time to time for the proper management of HFEC. 21. The Owner must not do or omit or allow or permit anything to be done at HFEC which may expose HFEC to any liability to pay damages compensation costs charge or expenses and must indemnify HFEC against all such liabilities. 22. This agreement can be terminated by HFEC at any time in the following circumstances:22.1 By HFEC giving notice in the event of any breach by the Owner of the terms of this Agreement; 20.2 By HFEC, on giving notice to the Owner where HFEC acting reasonably considers it in the best interests of good management to do so. 23. The Owner must remove their horse and property upon termination of this agreement. 24. THE OWNER CAN CONFIRM THAT THEIR HORSE HAS NOT HAD, NOR BEEN IN CONTACT WITH ANY HORSE THAT HAS HAD, STRANGLES IN THE LAST 3 MONTHS. 25. THE OWNER CAN CONFIRM THAT THE HORSE WILL ARRIVE AT HFEC CLEAR OF ANY CONTAGIOUS DISEASE E.G. RINGWORM THE SCHEDULE LIVERY PRICES AND DEFINITIONS: STABLE LIVERY £50.00 Comprehensive Daily care Inclusive of stable, grazing, bedding, feed and hay. Suplements to be supplied by the Owner.
