The Consent to the Transfer of Author's Economic Copyrights along with Granting a Power of Attorney
As the co-Author of the work under the title “…………………………………………………………………………” being a
textbook/monograph……………………………… (hereinafter referred to as the Work) I hereby agree to the
publication of the Work by the University of Gdansk –University of Gdansk Press, based on the terms agreed
by the Chief Editor in Publishing contract with the science editor, concluded with University of Gdansk
(hereinafter referred to as the Contract), and also I give my consent to conclude the Contract on my behalf.
In particular, I agree to the transfer of economic copyrights to the above mentioned part of the Work of my
authorship to University of Gdansk (hereinafter referred to as the Publisher) for an indefinite period , on the
basis of exclusivity and without restrictions, for the following fields of exploitation:
a.
Fixation, in particular: on paper, machine-readable data (diskettes, compact discs and others),
in the electronic form (in the form of the PC hard-copy) in all formats, including .DOC, .PDF,
b.
Publication and distribution of the Work in any number of copies (in paper and in the
electronic form), in any way, whether for a consideration or free of charge, including the book
publishing (printed books) and electronic publishing (e-books), multimedia databases and networks, in
particular the Internet, local networks (Intranet), on-line, as well as computer printouts and making it
available to libraries (including digital libraries),
c.
Reproduction of the Work by any technique, includingprinting and digital , free of any
quantitative restriction, including book publishing (printed books) and electronic publishing (e-books),
multimedia databases and networks, in particular the Internet, local networks (Intranet), on-line, as
well as computer printouts,
d.
Distribution of the Work as a whole or in parts (including summaries/abstracts) in IT networks,
including computer networks (the Internet, local networks),
e.
Saving into a computer memory,
f.
Adding the Work as a whole or in parts, along with its summaries in Polish and English into
resources of digital libraries, and submitting the Work as a whole or in parts along with its summaries
in Polish and English into the electronic databases (including indexing) with the possibility to share the
content in the Internet, as well as in the resources of digital libraries, without any restrictions
whatsoever,
g.
Distribution of fragment(s) of the Work in publications (paper and electronic), coveringstrictly
defined issues used for didactic purposes for students/academic staff, and for fixation and distribution
of fragment(s) in above mentioned forms,
h.
Distribution in any form, including placing on the market (the sale) ,in paper or electronic
form, with no limit in time, as well as distribution as w whole or in parts for the advertising and
promotional purposes, within the territory of the Republic of Poland, and within all other countries,
i.
Further transfer of economic copyrights to the Work, as well as granting all types of licenses,
whether for a consideration or free of charge – based on the terms at the Publisher's discretion,
including the fields of exploitation in above mentioned points.
At the same time, I hereby declare that the part of the Work that I have written:
1.
is an original work, does not infringe or violate any third party’s copyrights and it has never
been published before,
2.
in terms of its content, including illustrations (photographs, graphs, tables etc.) enclosed to
the Work, does not infringe any third party’s copyrights, personal rights and other rights.
At the same time, I hereby declare that I shall be exclusively and fully responsible to the Publisher for
any potential infringement of third party’s rights caused by enclosing to the Work, in my own,
authorial part of the Work, contents or illustrations (photographs, graphs, tables etc.) to which they
have certain rights.
In case of submitting a justified claim by the third party against the Publisher for infringement of
rights, including copyrights, concerning the fragment of the Work of my authorship, I undertake to
satisfy above mentioned claims without any delay, and in case of adjudication of claims from the
Publisher (or in case of reaching a settlement between the third party and the Publisher), except for
the payment of the adjudicated amounts (agreed upon in the settlement) from the Publisher, I also
undertake to cover all costs of proceedings, including legal representation costs, incurred by the
Publisher.At the same time, I hereby appoint Sir/Madam ….................................(the Science Editor)
as my authorised representative entitled to make declarations of will concerning the Work, on my
behalf to the Publisher , including the conclusion of the Contract, accepting such declarations of will,
exercising the authority and responsibilities concerning the Work and the Contract, as well as
representing me in any contacts with the Publisher.
The above power of attorney encompasses the authorisation to collect the renumeration that I am
entitled to receive from the Publisher, in accordance with the concluded Contract.
