Resolution Pursuant to N.J.A.C. 7:15-3.4(g) 4.ii
Consent for Treatment Works Application (“TWA”)
Application for Ecological Solutions’ Mine Brook Road Development
WHEREAS, Ecological Solutions’ has proposed the construction of a new on-site environmentally friendly
sanitary treatment system in lieu of multiple individual residential septic systems for its residential
development on Mine Brook Road in Bernards Township; and
WHEREAS, the New Jersey Department of Environmental Protection (“DEP”) regulations require that
Ecological Solutions’ Mine Brook Road Development obtain a Treatment Works Approval from the DEP
with consideration from the municipality in which the project is located; and
WHEREAS, The Ecological Solutions Mine Brook Road Development engineer BioHabitats Inc. has
provided the project information and made such a request pursuant to a letter dated January 31, 2014, to
Township Engineer Thomas Timko, P.E..
NOW THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Bernards, that
pursuant to N.J.A.C. 7:15-3.4(g) 4.ii, the Township consents to Ecological Solutions’ Mine Brook Road
Development request for a TWA and authorizes the Township Engineer to sign the application.

EXPLANATORY STATEMENT
The NJDEP requires the consent or denial of Treatment Works Applications by the municipality. Ecological Solutions’
project requires a TWA to construct an environmentally friendly multi-home sewage treatment system in lieu of separate
septic systems. The project was previously approved by the Planning Board
