PURPOSE 1.1 The purpose of this document is to define and document a Photography and Video Filming policy for GCJRL covering still photography and filming of and by District members. 1.1. It is not the intention of GCJRL to prohibit those with a legitimate interest in filming or photographing children, young people and helpers/officials participating in sport related activities associated with GCJRL. 1.2. The purpose of this policy is: 1.2.1. To ensure that GCJRL players, coaches, managers and parents have control over the images and recorded data of children/young people; 1.2.2. To deter unsuitable people/persons from misusing sporting activities to obtain images or recorded data of members of GCJRL; 1.2.3. To prevent unsuitable images or recorded data of GCJRL members, or inappropriate representation of the sport from being produced; 1.2.4. To protect the identity of GCJRL members who may be made (to feel) vulnerable or compromised through the publication of their photos or personal details; 1.2.5. To define processes for GCJRL members, professional and amateur photographers to obtain permission to record GCJRL events; 1.2.6. To ensure that all GCJRL players, parents, coaches, managers and officials are aware of these guidelines and accept and agree to abide by the guidelines. 1.3. This policy takes effect on the date it is endorsed by the GCJRL Executives and one (1) representative of all affiliated clubs and bodies. 2. SCOPE 2.1. This policy applies to all Officials, coaches, managers, players, parents of all affiliated clubs of GCJRL. 2.2. This policy does not limit or restrict the application of any other policies in place from GCJRL, Affiliated clubs, QRL or other governing bodies. 2.3. The scope of this policy covers all forms of technology that can be used to record images of Club players, coaches, managers, players, parents and club officials involved in activities associated with GCJRL. 2.4. These technologies include all forms of film based and digital photography, including video, and mobile phone cameras. 3. GOVERNANCE 3.1. The GCJRL Executive will provide overall governance of the policy. 3.2. GCJRL gives Governance rights and responsibilities to all Affiliated Clubs Executives and duty officials. 3.3. Governance activities include: 3.3.1. Approval and release of this document and subsequent versions; 3.3.2. Ensure a coordinated and documented approach to all aspects of this policy including; ownership, accountability and responsibility of all components of the policy; 2 Gold Coast Junior Rugby League Photography and Video Filming Policy 2012 3.3.3. Provide the final decision in any complaint/dispute either with the policy or as a result of the application of this policy; 3.3.4. Provide a focal point for the process discussions and communications. 4. PHOTOGRAPHY/VIDEOGRAPHY DURING GCJRL GAMES 4.1. Any person, with a legitimate interest, wishing to take still photography or video filming during any GCJRL must seek permission from both the home team manager and opposing team manager or duty official before undertaking any such photographing or videoing. 4.2. A team manager or duty official has the right to refuse photography or videography for a legitimate reason only. 4.3. Legitimate reasons include but are not limited to: 4.3.1. A child/young person on the team is protected by a court order; 4.3.2. A professional photographer or videographer has been hired by either team or home club; 4.3.3. A child/young person or team official wishes for identity protection, or is made to feel vulnerable or compromised through the publication of their photos or personal details. 5. LEGITIMATE INTEREST IN PHOTOGRAPHING AND FILMING 5.1. Legitimate interest in filming and photographing of players, coaches, managers, officials and parents involved in sporting activities associated with GCJRL covers: 5.1.1. Parents, carers, siblings, family members and friends wishing to record a child/children participating in a sporting event as a personal memento or as a record of competition; 5.1.2. Officials, committee members or agreed participants of GCJRL or affiliated clubs who wish to record a player’s participation in a sporting event as a memento or record of competition for GCJRL or affiliated club; 5.1.3. Designated and approved GCJRL or affiliated club photographer who wish to record participation in a sporting event to publish on the District website or affiliated club’s website; 5.1.4. Designated coaches, managers or GCJRL or affiliated club officials who wish to record child/children as a legitimate coaching aid; 5.1.5. QRL, the GCJRL or the affiliated club has permission to use the player’s image (photograph, film, and video) for promotion and publicity of Rugby League for which the player will receive no payment. 6. THE USE OF PROFESSIONAL PHOTOGRAPHERS OR VIDEOGRAPHERS 6.1. The home club or either of the participating teams may choose to hire a professional photographer to record any game or sporting event of GCJRL. 6.2. If a professional photographer or videographer is hired the home club or either competing team may deny any request for others to take photos or videos. 6.3. If requests are denied GCJRL or affiliated club that hired the photographer must make copies of videos or photos available for purchase by any other party who can display a legitimate interest in the photograph or video (as outlined in section 5). 3 Gold Coast Junior Rugby League Photography and Video Filming Policy 2012 7. DUTY OF DISCLOSURE 7.1. A participant must promptly report to the affiliated club where any breach of this policy or any unethical incident involving others who are bound by this policy takes place. 8. NOTICE AND RIGHT TO BE HEARD 8.1. GCJRL or any affiliated club may enforce the terms of this policy and invoke sanctions only if it has been given that the party alleged to have breached the policy: 8.1.1. Reasonable and sufficient notice of each and every particular of the alleged breach; 8.1.2. Notice of possible sanctions; 8.1.3. The opportunity to be heard and to make submissions in relation to that alleged breach. 9. GRIEVANCE PROCEEDURE 9.1. If a participant disputes the home club or competing teams purported action taken under this policy that party must give notice to the home club Secretary: 9.1.1. Within 14 days after the date on which purported action was taken; and 9.1.2. Specify the reason for the dispute and any relevant facts. 9.2. Any grievance that cannot be solved though the home club may be referred to GCJRL for an appeal. 4
