Key Risks!

Does your Client understand what he is asking for?

Control Client expectations. Don’t oversell the benefits
particularly on first BIM projects.

Appointments should detail the scope and objectives of the
BIM.

Include a Schedule of BIM Deliverables (programme).
(Ensure that you allow for a time overhead on the set up of a
first BIM project (particularly 5D).)

Agree where the BIM database is to be located and the
security responsibilities thereof.

Appointment Documentation should refer to the drawing up
of BIM protocols between contributing parties (this too
should be programmed) .

LOD 300
collaborative BIM projects.


architect.

LOD 400

Where sub-contractors are
contributing to the BIM a
detailed CDP Matrix
becomes vital.

Clear definition of
construction modelers
roles and responsibilities.
`

If the architect is
construction modeling for
the contractor,
unambiguous agreement of
responsibility for these
portions of the work must
be documented.

Appointment by the Contractor

Define at the outset what rights your client has to use project
information.

Joint rights?

Grant of non exclusive rights to all users for the purpose of
the project only?

Use by owners for facilities management?

Use of Data rather than the model itself?

SMARTBIM Solutions
Intellectual Property Rights

Detail permissible uses of the model. No party to
have liability resulting from use of Model beyond
uses set out.

If you provide for the re-usage of the BIM ensure
that appointment documents allow only for reusage in exactly the same way / relationship as in
the original design.

If IPR rights are not confined to single usage
ensure that you are paid more. Your insurers will
charge you more!
