This unit standard is for people working within the dairy industry
in a supervisory or team leader role responsible for managing
the impacts of intellectual property considerations on the dairy
supply chain.
People credited with this unit standard are able to: analyse the
impact of intellectual property considerations on the dairy
supply chain, and apply intellectual property considerations to a
selected business area of the dairy supply chain.

Explanatory notes
1
Evidence is required of the application of intellectual property requirements to one
business area of the dairy supply chain. This could involves sales, processing or
marketing and apply to dairy products, milk or cheese.

This unit standard must be assessed using evidence from experience in an
organisational context. This could include a work-related case study.

Legislation relevant to this unit standard includes but is not limited to – Human Rights
Act 1993, Privacy Act 1993, Copyright Act 1994, Patents Act 1953.

Definitions
Infringement – deliberate or inadvertent misuse or non-compliance with legislation,
regulation, policy or codes of conduct.
Intellectual property – the output of the mind or intellect rather than tangible objects.
It may include but is not limited to – copyright, trademarks, patents, designs or trade
secrets.
Internal and external stakeholders – other people who may be affected by intellectual
property including employees, contractors and service providers.
Organisational requirements – instructions to staff on policies and procedures which
are documented in memo, electronic or manual format and are available in the
workplace. These requirements include but are not limited to – site specific
requirements, and company quality management requirements.

Outcome 1
Analyse the impact of intellectual property considerations on the dairy supply chain.
Evidence requirements
1.1
Intellectual property considerations that impact on the dairy supply chain are
identified and explained in terms of organisational requirements.
1.2
Consequences of intellectual property infringement are explained in terms of the
impact on the dairy supply chain.
1.3
The relationship between providing information and advice to internal and
external stakeholders and intellectual property considerations is explained in
terms of organisational requirements.
Outcome 2
Apply intellectual property considerations to a selected business area of the dairy supply
chain.
Evidence requirements
2.1
Existing and potential intellectual property implications within a selected
business area are identified and outlined in terms of the impact on the dairy
supply chain.
2.2
Consequences of intellectual property infringement are explained in terms of the
impact on the selected business area and personnel involved.
2.3
Policies and procedures that protect the selected business area’s intellectual
property are applied to activities within the business area to minimise risk of
infringement of intellectual property requirements in accordance with
organisational requirements.
2.4
Opportunities for maintaining currency and/or improving the operation of the
intellectual property policies and procedures are identified and applied to
activities within the business area.
Range
opportunities may include but are not limited to – changes to
legislation or regulations, aspects of intellectual property not
covered by existing procedures, communication about intellectual
property within the business area, monitoring of protection period,
use of someone else’s intellectual property;
evidence of two is required.
This unit standard is expiring. Assessment against the standard must take place by
the last date for assessment set out below.

before they can report credits from assessment against unit standards or deliver courses
of study leading to that assessment.
Industry Training Organisations must be granted consent to assess against standards by
NZQA before they can register credits from assessment against unit standards.
Providers and Industry Training Organisations, which have been granted consent and
which are assessing against unit standards must engage with the moderation system that
applies to those standards.

to this standard are outlined in the Consent and Moderation Requirements (CMR). The
