REASONS FOR DELAY OF PROJECT NH 24
1.
Forest Clearances :- The proposal was submitted to DFO on 03Aug 2009.Final
sanctions obtained:(a) District Shahjhanpur was received on 14-12-2011 .
(b) District Sitapur 14 Jun 2012.
(c) District Bareilly, Khiri and Hardoi on 13 Aug 2012.
2. Processing for Tree felling permissions commenced thereafter.
3. Rate of cutting of trees is slow. Concessionaire was exploited by Ban Nigam to assist in
tree felling to achieve pace in cutting of trees .Orders to fell tree were received in Jun
and Aug 12.Approximate 1400 trees yet to be felled.
4. Financial Closure Agreement was signed on 22Jun10,however it was complete in May
11 much beyond permissible six months (Clause 24.1.1.)
5. Appointed date Appointed date fixed by authority as 01 Mar 11 on basis of first MPR
received from Concessionaire. However the same has been contested and denied till
date by Concessionaire.
6. Land Acquisition Dates for 3A Notification for 425 hects (Additional required for four
lanes) was 16 -11-09. Similarly the dates for 3D Notification were14-5-10, 18-5-10 , ,255-10, 08-10-10,12-10-10,01-09-11,25-11-11. However till date the 3G awards of 15 hect
still pending. Possession for 175hects is pending and mutation for 365 hects is pending.
7. ROB
there are four ROBs, however construction work yet to commence. Minimum
two years are required.
8. Royalty For earth District administration has been slow and randomly issued
clearances. This kept machinery idle at times.
9. Utilty Shifting
UPPCL took time to submit estimates and in according permission
for supervision charges.
10. Encroachments
Civil administration avoids direct involvement in encroachment
removal until compelled by courts or higher authorities.
11. Financial Mismanagement This has been one of the major cause, where issues
related to over payment of advances, unclear equity by concessionaire and non
involvement of Authority by the bankers and Lender Engineer resulted in improper
utilsation of loan disbursed by the bankers. This led to abandoning of entire project site
,closure of four camps,general strike by the employees, complete stoppage of work for
six months and stoppage of further release of loan installments by the bankers. As well
as it led to non maintenance of equity debt ratio.
12. Inflation and Economic Slow Down Over the last three years or so ,there has been
steep hike in prices of petroleum products, banning of mining by various Supreme Court
Rulings, slow clearances related to tree felling, rise in prices of construction materials
etc. The compounding effect of all this led to making ongoing projects economically less
viable.
13. State Support Agreement
As per Clause 47.3 of CA . UP State Govt was to provide
state support Agreement for providing support and services. However the same has not
been done till date.
14. Org Set Up and Unprofessional subcontractors of Concessionaire Concessionaire
has been employing subcontractors without intimating Authority who are petty and
lack skilled manpower for maintaining quality and safety norms. Similarly there have
been major changes in staff of concessionaire after strike, this has also caused delay for
lack of continuity.

 Based on the Appointed date as on 01st March 2013, the construction period of
910 days is completed on 26th August 2013. The Concessionaire has not been able
to achieve the Milestone-I, II, III and scheduled completion date. Concessionaire
response related to Shifting of Milestone (if any) is awaited.
 NHAI has issued the Cure Period Notice on dated 11.11.2013. Concessionaire
response related to Termination of Contract Agreement is awaited.

Action by Authority on Cure period Notice has been kept in Abeyance for
additional 3 Months vide NHAI HQ letter No NHAI/BOT/11019/15/2008/UP/BSNH/24 /48167 dated 22 Jan 14.

Draft Termination notice forwarded in May 14.Discussed with MV Kini. Under
process.

Concessionaire received approximately 59 Crs in phases from bankers May onwards
and arrived in Project area with limited manpower 20 May onwards. He has undertaken
maintenance and has commenced earth work, casting two slab of bridge at Behgul,DBM
work approximately 800m in camp 4 area .Approximately four to five small subcontractor
have moved in over last ten days.

Programe for the balance work including resource mobilization
requirement/procurement not yet submitted by the concessinaire.

3. PROGRESS:
A) FINANCIAL PROGRESS: The Project is completely stand-still even after issue of Cure Period
Notice by NHAI. All the site camp offices are completely closed and there is no sign of reviving
the Project.

Note:- The tree cutting work has been completed in about 24 km length in Bareilly, 55 km
length in Shahjahanpur district, 22 km length in Kheri, Full 08 km length in Hardoi & 36 km
length in Sitapur district. Total – 145 Km. 30880 numbers of trees has been cut against the total
of 32,278 to be cut. The balance No of trees to be cut is 1398 nos.
5.
STATUS OF MAINTENANCE:

The Concessionaire is repairing the potholes with bituminous material. Out of total
151.2 kms length, potholes in 112.7kms are required to be filled as in rest length
either two lane DBM-I is available on one side (26.5 kms) or the carriageway has
been repaired by Authority in towns in 12 kms length.

Out of total 112.7 kms, appx 100 kms length has been repaired till date.

In the stretch repaired as above the Concessionaire has left many small potholes.
Also the approaches of the diversions have not been repaired.

In the month of Dec 2013, the Concessionaire has submitted detailed maintenance
work programme according to which they agreed to execute following works:
i. Pot hole repair
=24555sq.
ii. Resurfacing by Overlay
= 18.6 Kms
iii. Repair of Earthen Shoulder = 126 Kms.
However the Concessionaire has taken up only Pot hole repair work. They have not shown any
intention to carry out the work of overlay and earthen shoulders.

Note:- Utility Shifting Revised Estimates Revised Estimates for left over Electric Items
were reworked out at PIU in consultation with IE and Concessionaire rep for four
Districts namely Bareilly, Hardoi, Khirie and Shahjhanpur. These were submitted to RO
for his Approval. Revised Approval received on 31 Mar 14 . Revised Estimates for
Sitapur District can only be submitted on assistance from Concessionaire. The delay on
account of non shifting of Utility is squarely of Concessionaire.
8.
MAIN COMMENTS OF CONCURRENT AUDITOR AND INTERNAL AUDIT
Concurrent Auditor report from Apr 13 to Nov 13 as well as Internal Audit carried out in
Dec 13 at PIU Bareilly has adversely commented upon both on Physical progress &Financial
progress achieved by the Concessionaire . Major amount of Rs 206,33,17,314/ which is
almost equivalent to Capital contribution of promoter has been passed on to EPC and still
standing intact. Contrary to same Concessionaire has brought project to stand still for want
of finances. This is a significant mismatch. Also, there is variation in Physical progress reported
by IE ie 26.17% Vs 31.03% adjusted in accounts of Concessionaire. The same is serious breach
of Agreement.
9.
ROBs
Test pile drawing of 318 / Structural drawing of 289 submitted to NR,
Railways in July2013. Revised Estimates for three ROBs for approval of supervision
charges by Railway Authorities submitted to Rly Auth Moradabad by Concessionaire
through PIU letter 12051/7/2013/PIU Bareilly /2904 dt 07 Dec 13. Actual Construction of
ROBs would require minimum 2 to 3 yrs. Concessionaire has shown some interest and
has liaised with railway authority at Moradabad. Approximately 13 Lakhs supervision
charges being deposite by him.
