Throughout history, people have been forced to fight and die for the rights and freedoms that we enjoy each day as Canadian citizens. Even today in many parts of the world, people live in fear, as they are unable to practice their religion, talk freely, gather with friends, or come and go as they please. Luckily, as Canadian citizens we are fortunate enough to have certain rights and freedom guaranteed to us as a result of The Canadian Charter of Rights and Freedoms.

In an attempt to familiarize ourselves with The Charter of Rights and

Freedoms, each student will analyze and critique a human rights case of their choice. Students will have the opportunity to choose a case, from either the textbook or online, which is of interest to them. As long as the case discusses the violation of one of the rights and freedoms outlined in Charter, students are free to choose as they please.

Each student will be responsible to complete the following:

1.

A formal case citation. Examples can be found throughout the textbook or online.

2.

A summary of the case. This should be written in paragraph form and must include; a description of the incident, the division of law that the case falls under, the parties involved, the right or freedom that has been violated, as well as the courts decision. Using the four-step guide, answer each of the following questions: a.

Does the Charter apply? b.

Has a charter right or freedom been infringed? c.

Does the reasonable limits clause justify the infringement? d.

If not, is there a remedy provided under the charter?

3.

Do you agree with the courts decision? Why or why not? Be sure to include a minimum of two supporting arguments.

4.

Is there an alternative solution? How would you have dealt with the situation if you were the judge?
