‫شروط العطاء‪- :‬‬

‫يلتزم من يرسو عليه العطاء بكافة إجراءات والنقل والتركيب إلى مخازننا بالجامعة بغزة ودفع الرسووم‬
‫المقررة دون أي مطالبة إضافية‪.‬‬
‫تشتمل األسعار المقدمة من المتعهد على خيارين‪ :‬أ‪ -‬سعر غير شامل الضريبة ويلتزم بونن يقودم فواتورة‬
‫صفرية‪،‬ب‪ -‬سعر شامل الضريبة ويلتزم بنن يقدم فاتورة ضريبية‪.‬‬
‫يلتزم من يرسو عليه العطاء بتوريد األصناف المطلوبة وفو الشوروا البوابقة خودة مودة شوهر ) مون‬
‫تاريخ تكليفه رسمياً‪.‬‬
‫تلتزم الجامعة اإلسدمية بدفع جميع استحقاقات من يرسو عليه العطاء‪ -‬خارج الوان‪ -‬بعد االنتهواء مون‬
‫تنفيذ كامل ما ورد بهذا العطاء‪.‬‬
‫في حاة تنخير من يرسو عليه العطاء في إتمام بنود هذا العطاء في مواعيده المحددة يلتزم بودفع غراموة‬
‫تنخير مقدارها ‪ ) $100‬مائة دوالر أمريكي عن كل يوم تنخير‪.‬‬
‫إذا زادت مدة التنخير في التوريد عن أسبوعين يح للجامعة اتخاذ كافة اإلجراءات التوي تراهوا مناسوبة‬
‫بح المتعهد ويعتبر أي إجراء تتخذه الجامعة قانونيا ً دون أن يكون له ح االعتراض‪.‬‬
‫جميع األسعار يتم تقديمها بـالدوالر األمريكي ‪.$‬‬
‫آخر موعد لتبليم العطاء في ظرف مغل الباعة الواحودة ظهور يووم األربعواء الموافو ‪2009/8/12:‬موـ‬
‫ويرف معها كفالة بنكية بقيمة ‪ ) %5‬كضمان جدية دخوة المناقصة وتكون سارية لمدة ‪ 3‬شوهور مون‬
‫تاريخ التقديم‪.‬‬
‫يرف و بالعطوواء الكتالوجووات والنشوورات الخاصووة بوواألجهزة التووي ينوووي المشووار توريوودها إضووافة ألي‬
‫توضيح يرى انه ضروري تقديمه بالعطاء‪.‬‬
‫يتعهد من يرسو عليه العطواء عنود الحاجوة إلوى الصويانة خودة مودة الضومان بالقودوم إلوى الجامعوة بغوزة‬
‫وعموول الوودزم خوودة يديووة أيووام موون تواريخ إشووعاره إذا كانووص الصوويانة داخليووة وخوودة أسووبو فووي حالووة‬
‫الصيانة الخارجية وبتقديم الجهاز البديل إذا زادت مدة الصيانة عن أسبو من تاريخ اإلشعار‪.‬‬
‫تحتفظ الجامعة بحقها في رفض أي عرض دون بيان األسباب واستدراج عروض من الخارج فوي حواة‬
‫رفض العروض المقدمة‪.‬‬
‫من ح الجامعة زيادة الكمية المطلوبة من األجهزة عن الكمية الموضحة في عرض البعر‪.‬‬
‫الجامعة غير ملزمة بنقل األسعار‪.‬‬

‫التعليمات الخاصة بالعطاء‪-:‬‬
‫‪ )1‬يمكن للمتعهدين الراغبين في المشاركة بهذا العطاء أن يتقدموا للحصوة على نبخة كاملة من ويائ‬
‫العطاء مقابل دفع المبلغ المقرر من الجامعة اإلسدمية بغزة ‪.‬‬
‫‪ )2‬ينبغي على كل من يرغب دخوة هذا العطاء أن يقوم بدراسة دقيقة لكافة المواصوفات وجوداوة الكميوات‬
‫والشروا العامة وأن يتفهم ماهيتها والظروف المحيطة بهوا وسوائر العوادات المحليوة والرسووم واألموور‬
‫التي لها عدقة بها‪.‬‬
‫‪ )3‬يلتزم المتعهد بتقديم عروض األسعار على نفس نموذج كراس العطواء المقودم مون الجامعوة وبنمكانوه أن‬
‫يضوويإ إليووه المبووتندات والويووائ التوضوويحية األخوورى الدزمووة للعطوواء علووى أن تكووون كافووة األورا‬
‫والمبتندات موقعة ومؤرخة في األماكن المحددة لذلك‪.‬‬
‫‪ )4‬تعتبر كافة األسعار التي يضعها المتعهد أمام كافة بنود العطاء على أنها القيمة الكاملة والشواملة إلنجواز‬
‫المطلوب في ذلك البند وأنها تشمل كذلك أرباح العطاء وتعويضوه عون أي التزاموات أخورى قود يتحملهوا‬
‫المتعهد وفقا ً لهذا العقـد‪.‬‬
‫تقدم كافة ويائ العطاء وما يتصل بها من هذه التعليمات في ظرف مختوم مكتوب عليوه مون الخوارج‪-:‬‬
‫عطاء ‪/17‬ل‪( 09-08/‬لتوريد أجهزة لمختبرات كلية الهندسة والعلووم بالجامعوة اإلسوالمية‪-‬‬
‫غزة ) يبلم باليد إلى دائرة اللوازم والمشتريات بالجامعة اإلسودمية فوي موعود ال يتونخر عون البواعة‬
‫الواحدة ظهر يوم األربعاء المواف ‪2009/8/12:‬مـ‪ ،‬وتفتح المظاريإ البواعة الواحودة والنصوإ ظهور‬
‫نفس اليوم ويمكون للجامعوة اإلسودمية تنجيول موعود تقوديم العوروض بنشوعار خطوي يبعون إلوى كول مون‬
‫المتعهدين الذين حصلوا على ويائ العطاء ولن تنظر الجامعة)في أي عطاء يصلها بعد الوقص المحودد‬
‫لذلك‪.‬‬
‫‪ )5‬يعتبر العورض المقودم ملزموا ً للمتعهود وال يجووز سوحب هوذا العورض بعود تقديموه ويظول العورض ملزموا ً‬
‫للمتعهد الذي تقدم به لفترة ‪ 3‬شهور ابتداء من أخر موعد تم تحديده لتبليم العروض ‪.‬‬
‫‪ )6‬ال يجوووز إدخوواة أي تعووديل أو إجووراء أي تبووديل فووي نموووذج العوورض للعطوواء أو أي موون ويووائ العطوواء‬
‫المرفقة به من قبل المتعهود باسوتاناء تعب وة المواقوع المطلووب تعب تهوا وإذا أجورى المشوتر أيوا مون تلوك‬
‫التعديدت أو التبديدت أو إذا أخل بني من هذه التعليموات فيجووز للجامعوة اإلسودمية ) إهمواة عرضوه‬
‫وإذا أراد المتعهوود الووذي يرغووب فووي تقووديم بعووض الشووروا أو التحفظووات التووي يراهووا ضوورورية فوونن‬
‫باستطاعته تضمين كل ذلك أو يرغب باإلشارة إليه في مذكرة خاصة منفصلة ترف بالعرض ‪.‬‬
‫‪ )7‬وفي حالة الب الجامعة) من المتعهد المشار عليه أن يرف البيانات التالية بعود تصودي موا يلوزم مون‬
‫قبل الجهات المختصة‪-:‬‬
‫‪ ‬خبوورة المتعهوود وكفاءتووه والوكوواالت التووي عنووده إن وجوودت وغيوور ذلووك موون التفاصوويل والمعلومووات ذات‬
‫العدقة التي من شننها أن تقنع الجامعة) بقدرته علوى أداء التزاماتوه بهوذا العطواء وتنفيوذها علوى أفضول‬
‫وجه‪.‬‬
‫‪ ‬عنوووان المتعهوود الكاموول الرسوومي فووي غووزة أو خووارج غووزة أمووا إذا كووان مقوور المشووتر أو مكووان إقامتووه‬
‫الرسمي خارج غزة فنن عليه أن يحدد عنوانا ً له في غوزة يعتبور عنوانوه الرسومي الوذي توجوه إليوه كافوة‬
‫الرسائل واإلشعارات وكل إشعار أو رسالة تبعن مبجلة على هذا العنوان تعتبر أنها سلمص رسميا ً إليوه‬
‫‪.‬‬
‫‪ ‬على المتعهد تقديم أي معلومات أو بيانات أخرى وإرفاقها بعطائه إذا ورد لهوا ذكور فوي الشوروا العاموة‬
‫أو الخاصة أو المواصفات أو غيرها من ويائ العطاء‪ ،‬ولصاحب العمل الح في إهمواة أي عورض ال‬
‫يشمل هذه األمور‪.‬‬
‫‪ )9‬علووى المتعهوود الفووائز بالعطوواء أن يتقوودم إلووى صوواحب العموول خوودة فتوورة أسووبو موون توواريخ إبدغووه بنحالووة‬
‫العطاء عليه أو تلزيمه له لتوقيع العقد وعلى المتعهد أن يقدم إلى الجامعة) كفالة حبون األداء قبول توقيوع‬
‫نموووذج االتفاقيووة وحبووب نموووذج الكفالووة أو التوونمين المرف و وتكووون قيمووة هووذه الكفالووة الصووادرة موون أحوود‬
‫المصارف المبجلة في البلد بالمبلغ المحدد ‪ )%10‬من إجمالي قيمة‬

‫العقد وذلك ضمانا ً لتنفيذ العقد تنفيذا ً تاما ً ولدفع ما قد يترتب على المتعهد وفاء ألغراض العقود وإذا تونخر‬
‫المشتر أو استنكإ أو رفض توقيع االتفاقية أو عجوز عون تقوديم الكفالوة المطلوبوة لحبون التنفيوذ فعنودها‬
‫يح للجامعة) مصادرة قيمة التنمين الذي أرفقه بعرضه دون الرجو إلوى القضواء وال يكوون للمشوتر‬
‫أي ح في المطالبة به أو بني تعويض بشننه‪.‬‬
‫‪ )10‬إذا استنكإ الفائز بالعطاء عن تنفيذ العطاء أو تنخر في تقديم اللوازم كلهوا أو أي جوزء منهوا عون الموعود‬
‫المحوودد لووذلك أو خووالإ أي شوورا موون شووروا العطوواء أو يبووص أن المتعهوود قوودم للجامعووة لوووازم ال تتف و‬
‫ومواصفات العطاء‪ ،‬فعندها للجامعة اتخاذ أي من اإلجراءات التالية أو جميعها معا وذلك دون حاجة إلوى‬
‫إخطار أو إنذار‪.‬‬
‫‪ ‬مصادرة التنمينات المقدمة من المتعهد‪.‬‬
‫‪ ‬شراء اللوا زم من األسوا باألسعار البائدة بالطريقة والتكلفة اللتين تراهموا الجامعوة مناسوبتين وتضومين‬
‫المتعهد فر البعر و التكاليإ‪.‬‬
‫‪ ‬إحالة العطاء على المتعهود الوذي كوان قود قودم سوعرا أعلوى منوه فوي العطواء إذا قبول ذلوك وتحميول المتعهود‬
‫المبتنكإ الفر في البعر أو التكاليإ باإلضافة إلوى إلوزام المبوتنكإ بتعوويض الجامعوة عون أي عطول‬
‫وضر لح بها نتيجة الستنكافه‪.‬‬
‫‪ ‬حرمان المتعهد المبتنكإ من االشترا في مناقصات الجامعة‪.‬‬
‫‪ )11‬إذا كان هنا أي إلتباس أو تناقض في ويائ العطاء أو كانص هنا أي حاجة الستفبار عن أي توضيح‬
‫في ويائ العطاء فعلى المتعهد أن يتقدم بطلب خطي لدستفبار مون أجول توضويح أو إزالوة االلتبواس أو‬
‫التناقض في موعد يبب التاريخ المحدد لفتح العطاء بما ال يقل عن خمبة أيام ) ويقوم صواحب العمول‬
‫بتوزيع جواب االستفبار على كافة المشتركين المتقدمين للعطاء وال يجوز أن يتخوذ ماول هوذا التوضويح‬
‫مبررا ً لطلب تمديد الموعد المحدد لتقديم العروض‬
‫‪ )12‬إذا وجد أي من العروض المقدمة نقصا ً أو خطن أو تناقضا ً بين حباب جملة أي مبلغ وما يجب أن تكون‬
‫عليه هذه الجملة بتطبي البعر الموضو ألي بند في جودوة الكميوات فللجامعوة الحو فوي تعوديل جملوة‬
‫المبلغ بما يتفو وتطبيو البوعر الموضوو علوى الكميوة الموضووعة لوذلك البنود وبالتوالي تعوديل حاصول‬
‫الضرب أو مجمو البعر أو المبلغ المقدم للعطاء وإذا حدث خودف بوين العودد الموذكور باألرقوام كتابوة‬
‫بالحروف فتعتبر الكتابة بالحروف هي الملزمة وكذلك إذا حدث خطن في جموع قيموة مختلوإ البنوود فونن‬
‫الجامعووة لهووا الح و فووي تصووحيح المجمووو ويك وون المجمووو المصووحح فووي ماوول هووذا الحوواة هووو الملووزم‬
‫للمتعهد‪.‬‬
‫‪ )13‬تحتفظ الجامعوة) بحقهوا فوي إهمواة أي عورض غيور متقيود بكول موا ورد فوي هوذه التعليموات كموا تحوتفظ‬
‫بحقها في رفض أي عرض دون بيان األسباب ويح لوه اختيوار العورض الوذي توراه مناسوبا ً لهوا وإحالوة‬
‫العطاء دون التقيد بنقل العروض قيمة ويكون كل ذلك دون أن يكون ألي متعهد لم يفز بالعطاء أي حو‬
‫في مطالبة الجامعة) بني تعويض‪.‬‬
‫‪ )14‬يح للجامعة) إلغاء جميع العروض المقدمة من المتعهدين وإعادة ارح الويائ مرة يانيوة إموا بشوكلها‬
‫الحالي أو بعد إجراء أي تعديل عليه وفي هوذه الحالوة يحو لجميوع المتعهودين الوذين اشوتروا العطواء فوي‬
‫الموورة أو الموورات البووابقة مقابوول الووامن أن يحصوولوا فووي الموورة أو الموورات القادمووة التاليووة علووى الويووائ‬
‫المطروحة مجددا ً وكاملة بدون مقابل‪.‬‬
