Observations
HISTORY
Greenbank is located approximately 1km south of the centre of Chagford, situated between Meldon
and Nattadon Commons. Planning permission was granted in November 2009 for a 'traditional
timber-frame linhay (108sqm) with farmyard' on land to the south of the main house. The Design
and Access Statement submitted with that application states that the proposed building was
needed to "manage and service a flock of sheep and some steers", "to house farm machinery and
a tractor" and to provide "adequate storage of hay, straw and other feed stuffs".
Permission was also granted in November 2006 to 'create farm track with gravel finish and widen
existing gateway' to facilitate access to the approved barn and yard area.
THE DEVELOPMENTS
A visit to the property in July 2012 noted little if any agricultural use of the barn with many domestic
items being stored inside including kayaks, furniture, electrical appliances (fridge/freezer and
washing machine) and a joinery workshop on the ground floor at its western end. To the rear of
the barn was noted an attached lean-to conservatory type extension being constructed into an
enclosed vegetable garden. A gas bottle, water and electricity supply were also noted serving the
barn. At the top of an external staircase and through a pair of french doors was a unit of
accommodation occupying approximately half the first floor of the building. Part of the front, north
east elevation of the barn had been enclosed with timber boarding to facilitate these unauthorised
uses.
The landowners, Mr & Mrs Goudge, stated that the residential accommodation in the barn was only
a temporary arrangement to provide a home for their son and daughter-in-law who had recently
returned home from travelling and were expecting their first child within the next couple of weeks.
Mrs Goudge acknowledged that this development required permission but explained that they
could not find any alternative accommodation.
Mr & Mrs Goudge were advised that the change of use of the barn was considered to be
unacceptable and that in order to avoid the risk of legal action being taken against them by the
Authority, they should cease the unauthorised use of the barn. This was acknowledged by Mr &
Mrs Goudge.
It was not considered expedient to take legal action at that time, however, a further visit in
November 2013 noted that the barn is still occupied.
Mrs Goudge stated that her son and daughter-in-law had recently bought a property that is in need
of substantial renovation and that they are currently in discussion with officers about its renovation.
They intend to move into a mobile home on site when permission/consent has been granted in
order to carry out the necessary works.
POLICY
The barn is not a historic building. The unauthorised uses for residential purposes, domestic
storage and as a joinery workshop are not necessary for the needs of farming, to sustain an
important building at risk, assist in the growth of an existing business or promote National Park
purposes and are therefore contrary to policies DMD9, DMD23, COR2, COR15 and COR18.
The HUMAN RIGHTS ACT 1998
The occupiers have said that the development is their home. As such, the courts will view any
decision to take enforcement action as engaging the occupiers’ rights under Article 8 ECHR (right
to respect for private and family life and home) and Protocol 1 Article 1 (peaceful enjoyment of
possessions). The service of an Enforcement Notice requiring the unauthorised residential use to
cease would represent a serious interference with these rights. However, it is permissible to do so
"insofar as is in accordance with the law and necessary in a democratic society for the protection of
rights and freedoms of others".
The courts have held that provided a balanced and proportionate approach is taken, having regard
to all relevant considerations and not giving irrational weight to any particular matter, the UK
planning system (including the enforcement process) is not incompatible with the Human Rights
Act.
Tackling breaches of planning control and upholding Local Plan policies is clearly in accordance
with the law, protects the National Park from inappropriate development and enshrines the rights
and freedoms of everyone to enjoy the natural beauty and special qualities of the National Park.
There are not believed to be any overriding welfare considerations at this time:
• The personal circumstances of the occupiers have been checked and fully taken into account.
• There are not understood to be any current education issues
• There are not understood to be any current health issues
• There is no known social services involvement
Members are therefore advised that enforcement action would be:
(i) in accordance with law – s.178(1) T&CPA 1990
(ii) in pursuance of a legitimate aim – the upholding of planning law and in particular the
Development Plan policies restricting development in the open countryside of the National Park
(iii) proportionate to the harm
and therefore not incompatible with the Human Rights Act.
SUMMARY
In view of the time that has passed since the initial site visit, it is now considered expedient to
commence legal action to secure the cessation of the non-agricultural uses of the barn, including
use as a dwellinghouse, domestic storage and as a joinery workshop, and to secure the removal of
the unauthorised alterations to the barn.
The Authority generally gives an extended period of time for compliance when seeking the
cessation of a residential use of a building, often six months. Officers will take the occupants'
personal circumstances fully into consideration when issuing any Enforcement Notice and setting
an appropriate compliance period.

The proposal is for a residential development of 18 houses with associated
works; 5 market dwellings and 13 social rented properties. The site is located
on the eastern edge of the settlement and is presently in agricultural use with
a number of buildings on the land. The National Park boundary flanks the
western edge of the site along Dunsford Road.
The Authority has requested that the District Council seek a number of
amendments on the proposed scheme.
The application proposes the removal of the hedge banks along both road
frontages and the Authority has requested that these features are retained as
part of the scheme (especially along Dunsford Road), to maintain the rural
character and setting of this part of the village at the entrance to Dartmoor
National Park.
The Authority has also requested that the timber cladding is omitted on the
elevations of the proposed dwellings, as this does not reflect the local
vernacular, and that further consideration is given to the design of the long
unbroken roofline of the northern terrace.

The Inspector considered that the main issue was the effect of the development on the
character and appearance of the area and the special qualities of Dartmoor National Park.
He noted that there had been no objections from the Parish Council or through public
representation, and found that the limited number and small scale of the yurts allowed them to
fit unobtrusively into the landscape. The Inspector took the view that the proposal would run
alongside other activities at the farm, and would be an acceptable form of farm diversification.
The Inspector took the view that the development would provide diversity and choice of tourist
accommodation, to promote understanding and enjoyment of the special qualities of the
National Park, including the conservation of its cultural heritage. The Inspector noted the
proximity of the site to local services at Poundsgate and the presence of a bus service along
the nearby B3357, and took the view that the proposal represented a sustainable form of
development for which there is a presumption in favour under the NPPF.

The Inspector considered that the main issue was whether the proposed development should
be permitted in the light of local and national planning policies on sustainable development in
rural areas.
The appeal related to a two-storey barn in open countryside to the north of Horrabridge.
Planning permission has recently been granted for the conversion of the barn to holiday letting
use and although the Inspector accepted that there was some evidence to suggest that the
permitted holiday letting use may not be viable, he expressed concerns over some of the
detailed figures provided by the appellants.
He stated that the proposed use of the dwelling for open market housing was in clear conflict
with the Authority's adopted policies which only permit affordable housing, which he stated that
the appellants had rejected without giving it detailed consideration.
The Inspector was mindful of the policy to enable development to secure the future of heritage
assets, however although he considered the building to be of local significance he did not
consider it to be of exceptional quality and he also considered that its rural setting would not
be significantly improved by the development. He also stated that it could be argued that
permanent residential use would have a more urbanising effect than the approved holiday
letting use.
The Inspector concluded that there were no special circumstances to make an exception to
the normal presumption against permitting new isolated homes in the countryside.

The Inspector confirmed that in this appeal, the onus of proof was firmly upon the appellant
and the issue was whether on the balance of probabilities the change of use to two separate
dwellinghouses had taken place on or before 24 October 2008.
The Inspector concluded that the oral and documentary evidence about when and how
Foxgrove Farm was occupied and used as a separate single dwelling house, lacked sufficient
precision and clarity. He concluded that the lack of unambiguous evidence combined with the
lack of precise documentary evidence, significantly undermined the likelihood that the Building
was used as two separate single dwellinghouses on or before the relevant date and was
continuously used as such for the relevant period in the manner claimed. The use as two
dwellinghouses had not therefore been shown to be immune from enforcement action due to
the passage of time and the appeal was dismissed and the enforcement notice was upheld,
with minor corrections.

The appeal was made in respect of the unauthorised engineering works and building
operations to create a level surface on part of the land, erect a building on that land, and
create a level surface adjoining the north east side of the building.
The enforcement notice required that the building be removed from the land, including all
debris and material and the restoration of the land to its former condition, including
reinstatement of the parts of the land which have been levelled.
The appellant appealed under ground (a) that planning permission should be granted for the
development; ground (b), that the matters in the enforcement notice have not occurred, and
ground (c) that there had not been a breach of planning control.
The Inspector confirmed that the appeal under ground (b) and (c) should fail.
In assessing the appeal under ground (a) the Inspector identified the main issue as the effect
of the development on the character and appearance of the area.
He stated that the completion of the stonework on the outside of the building was essential as
the current state of the building, with blue render and concrete blocks, was not appropriate.
With a slate roof and stone cladding he considered that that the building would have a
vernacular appearance respecting its Dartmoor setting.
In terms of the use the Inspector noted that in the past there may have been some domestic
storage but that at the time of his visit there were bales of straw stacked up to the rafters. He
went on to say that the use of the building could be controlled by a planning condition
specifying agricultural use.
He concluded, therefore, that subject to conditions, the appeal scheme would conserve the
landscape and scenic beauty of the area and thus not conflict with the statutory purpose of the
National Parks.
Accordingly he held that the ground (a) appeal should succeed and the enforcement notice be
quashed subject to conditions that the barn would be stone clad within 12 months of the date
of the decision and that the barn shall only be used for agricultural purposes. Should the barn
not be stone clad within the time allowed it should be demolished within 3 months of the date
of failure to meet that requirement.

The appeal was made in respect of the unauthorised creation of two tracks on Land to the
north-west of Bowdley Plantation, Druid, Ashburton.
The Enforcement Notice that the appeal related to required that both of the tracks were
removed from the Land, (including all materials, spoil and debris comprised in the creation of
the tracks and their removal) and that the Land was restored to its former condition prior to the
development.
The appellant appealed under ground (a) – that planning permission should be granted for the
development; ground (c) – that there had not been a breach of planning control and ground (f)
– that the notice goes further than is necessary to remedy the breach of planning control. The
Inspector also identified a “hidden ground”, under ground (b) – that the alleged breach had not
occurred as a matter of fact.
In dealing with the appeal under ground (a) the Inspector noted that the main issues to assess
were the effect of the development on the character and appearance of the area and whether
there was a demonstrable need for the tracks, that is proportionate to the use of the land. With
regard to the first point, he stated that the development harms the character and appearance
of the area. However, having considered whether there was a need for the tracks, the
Inspector determined that on balance a need for a single track had been demonstrated, but
that a second track would be disproportionate to the use that is made of the land.
Planning permission was therefore granted for the track which originates in the southern
corner of the site and which runs approximately three quarters of the length of the southeastern boundary, but not for the other.
Under ground (c) the appellant claimed that the works to create the tracks were permitted
development due to the fact that the current planning legislation permits engineering
operations (amongst other things), which are reasonably necessary for the purposes of
agriculture within that unit to be carried out on holdings which are smaller than 5 hectares.
However, the Inspector noted that the appellant had not successfully proved that the land is
less than 5 hectares. It was therefore concluded that the works that had been carried out
constituted development requiring the benefit of formal planning permission and as such; the
ground (c) element of the appeal failed.
On ground (f) of the appeal the Inspector found that the requirements of the Notice had been
marginally excessive in that some of the stone that had been used in the creation of the tracks
had originated from the appeal site and that it was therefore disproportionate to expect this to
be removed from the land. The requirements of the enforcement notice were therefore
amended to ensure that the road planings which were used to top the tracks were removed
from the land, but that the stone sourced from within the site was returned to where it had
originated from.
Finally, the Inspector found that the appellant had failed to demonstrate that the alleged
breach had not occurred as a matter of fact and therefore the landowner’s “hidden” appeal
under ground (b) failed.
In conclusion, the appeal was allowed in part, and the notice varied. Planning permission was
granted for one of the tracks, subject to conditions requiring it to be grass seeded in order to
mitigate its visual impact . However, the enforcement notice was upheld with some variations
and requires the removal of the second track from the land.
