Crafter/Seller (Vendor) Contract
1. This agreement is between Totts Gap Arts Institute (TGAI) and the undersigned Vendor.
2. Totts Gap Arts Institute’s Annual Arts Fair (Event) is a day-long festival that features an outdoor craft show and
direct sales on TGAI grounds, along with TGAI food concession and activities. TGAI’s Annual Arts Fair will be advertised
in several outlets, e.g.: Blue Valley Times, Discover Lehigh Valley, local radio stations, various signs/postings throughout
The Slate Belt, as well as Internet sites relating to craft shows and community events.
3. A fee of $25.00/outdoor space, $50.00/indoor space per each requested vendor space (Space) should be
submitted to TGAI along with a fully completed and signed application by Saturday, April 23, 2016 to be considered
for acceptance. A limited number of outdoor Spaces with electricity (~120v, ~100w, AC) are available for an
additional $10.00 per Space. All outdoor spaces are located on TGAI lawn and parking lot suitable for a standard
10 feet wide by 10 feet deep tent. Eight indoor spaces, electricity included, are available on a first come, first served
basis.
4. Upon receipt of your completed application and payment, you will receive an e-mail confirming your Space. Please
bring it with you when you check-in at the registration table upon your arrival.
5. The Event will be held rain or shine, and no canopy, coverings or other furnishings will be provided by TGAI.
Vendors may use their own canopy/tent within the allotted Space and are solely responsible for providing, setting up
and taking down all coverings, furnishings, displays, supplies and equipment.
6. You must check in at the registration table and confirm your Space upon arrival. Set-up time is 8:30 am and takedown time 4:00 pm on the day of the Event. Vendors must remain set up for duration of the Event.
7. All crafts placed for show and sale must be HANDCRAFTED BY YOU. No commercially made items may be shown or
sold. All merchandise must be original, of good quality and be attractively displayed.
8. Vendor shall remove all items they brought onto TGAI grounds, and will restore Space(s) to original clean and
orderly condition by the conclusion of the Event.
9. Vendor may not sell any food or beverage items intended for consumption at Event. Selling items such as mixes and
spices, etc. is allowed.

10. No alcoholic beverages or illegal substances shall be brought onto TGAI grounds or facilities by any Vendor or
associated person.
11. TGAI reserves the right to evict Vendor from Event grounds if any of the provisions of this agreement are not met,
or for any other reason or situation believed by TGAI (in its sole discretion) necessary to maintain a wholesome family
environment. TGAI also reserves the right to require Vendor to remove any items TGAI finds objectionable. No refund
will be made as a result of any eviction or item removal.
12. While TGAI encourages creative art making, please respect the other vendors and patrons by not fabricating
while on site, any work that involves solvents, dust or other airborne irritants.
13. Inappropriate behavior will not be tolerated. This includes foul language and harassing other individuals. If you or
any members of your team are found to be acting inappropriately, it will result in removal of the individual from the
Event and closure of your booth without refund.
14. Spaces are reserved on a first-come first-served basis. A waiting list will be established when TGAI determines full
capacity. Vendor applicants should note if they want to be placed on the waiting list, and the lead-time they then
request for being informed of an opening. TGAI will contact wait-listed applicants if/when it determines an opening.
Please do not show up at the Event unless and until TGAI has confirmed your Space availability.
15. Vendors are invited to donate one item from their stock to be used in Event drawing(s). Please feel free to attach a
business card or information to the item to promote your sales!
16. No overnight campers, vans, trailers, etc., are allowed on TGAI property. Vendors will park in assigned places
after set-up.
17. TGAI is not liable for any damages, injuries or loss during the Event. VENDOR ASSUMES ALL RISK OF LOSS,
AND/OR DAMAGES. Vendor further agrees to defend, indemnify and hold harmless TGAI and its employees and
representatives against damages, injury or loss of any type under any circumstance, including loss, expense or
judgment for injuries or damages of any type to any person or property (directly or indirectly) arising out of or caused
by the acts or omissions (negligent or otherwise) of Vendor or their employees or representatives in connection with the
Vendor’s use of TGAI grounds and/or facilities.
18. Any and all matters pertaining to required sales tax (e.g., collection, reporting, and/or remittance to taxing
authorities), and/or licensing for products sold, are solely the responsibility of Vendor.

TGAI will notify Vendor of their Space application status. If accepted, a copy of this agreement and any other additional Event
information will be returned to Vendor (or provided at Event check-in). Acceptance of any application is at the sole discretion of
TGAI; once accepted, application fees are non-refundable (except as noted below).
If a “full capacity” situation occurs and Vendor applicant has not indicated a desire to be placed on a waiting-list, Vendor’s
application will be withdrawn from further consideration and their submitted fee will be returned, otherwise both will continue to be
held until such time as a Space may become available. If no Space becomes available or the requested lead-time for same has
passed without an opening (or for any other pre-event reason as may be solely determined by TGAI), Vendor’s application will be
withdrawn from further consideration and their fee will be returned.
