Paradise Lost at Paradise Island Resort?
A Paradise Island resort has filed legal action against nearly 100 timeshare owners in a Virginia
court in an effort to secure fees from disgruntled owners. According to reports published in the
two Bahamian newspapers, Freeport News and Guardian Business, Club Land’or is embroiled
in no less than 96 pending cases in Henrico County, Virginia, (where parent company Land’or
International is located) as the resort’s response to an ongoing dispute between the resort and
its timeshare owners. The cases are expected to be concluded early in 2013.
One owner told a Bahamian newspaper that the lawsuits stem from a growing number of American timeshare owners that refuse to pay fees. “This is just getting bigger by the day. People are refusing to pay them
for not taking care of the resort.”
Timeshare owners at Club Land’or have often
made their distaste known concerning high fees with
what they call little or no results for the property.
There are numerous online comments by Club Land’or
owners on timeshare forums about the lack of proper
maintenance and special assessments to pay for improvements that are not made.
One owner was reportedly successful in a recent lawsuit
against the resort involving its right to impose the special assessments.
Club Land’or’s financial problems have been well documented for a number of years, including persistent rumors on its
impending sale. A year ago, the resort faced the threat of legal
action related to thousands of dollars in employee salary deductions allegedly taken, but never deposited in their credit union.
Last year, executives at the resort told Guardian Business
that it had completed a number of upgrades recently that justify
the high fees.
Some owners have recently received letters from Club
Land’or which requests that the owner transfer a large lump
payment to the resort and then be relieved of future maintenance
fees and special assessments.
In one particular letter, dated June 18, 2012, Club Land’or requests more than $30,000 from a timeshare member in exchange
for no financial obligations until 2043. Owners are still given
access to the resort despite opting out of financial obligations.
“Again, I just want to state that at the moment of payment
you are released of all financial obligations to Club Land’or. This
is for a limited time only and not available for a payment plan
offer,” the letter stated.
A spokesperson for timeshare owners told Guardian Business, “What we have seen are people being given the option to
be bought out by Club Land’or. If you pay $30,000, for example,
you don’t have to pay any assessment fees or anything. It sounds
like a real desperate need for cash.”
“They keep imposing special assessment fees, and they keep
going up, and there is no accountability. They aren’t putting that
money into the resort and we think they are just taking the money.
A lot of people are just upset, many of whom have owned there
for 20 years.”

We urge timeshare owners to become engaged in their resorts’ governance and to
keep alert to the many fraudulent operators that are stealing tens of millions of dollars
each year from unsuspecting owners. Owning a timeshare is like owning a vacation
home. If your resort is serious financial challenges, think about protecting your invest­
ment.
What does being a proactive owner actually entail? The first thing you should do
is read. Start by pulling out the documents you signed when you first purchased your
timeshare and read through your obligations and the obligations of your elected HOA
Board of Directors. Read all communications from your resort. Many send out periodic
newsletters with details about the current situation, planned changes and upcoming
events. Does your resort have a website? Many resorts have an owners area that provides
important information online.
Know who is on your Board. Members generally serve on a part time voluntary
basis. Quite often, the resort may be in one state and one or more board members may
be living in another state. It’s likely that much of the day-to-day business of the resort
is being delegated to the onsite resort manager or through the services of a professional
management company. If you have experience that could benefit the resort, consider
running for election to fill upcoming vacancies on the board. Learn the process of getting
elected. Keep in touch with your board and resort manager to provide feedback. It’s
important for them to know what is going well as much as any concerns you may have.
Attend owners meetings. Check with the resort about scheduled meetings and be
sure to attend at least one meeting per year. This is one of the best ways to meet other
owners and to get a first hand status report from the resort’s management. Many resorts
have the attorney for the HOA participate at one or more meetings.
Know the financial condition of the resort. You should read the operating budgets
to see how reserves are being maintained, the trend in revenues being generated from
maintenance fees, resales and rentals. Inquire about delinquency rates from non-paying
owners and the steps being taken to assure collection policies are being enforced. Pay your maintenance fee obligations. It’s costly for resorts to pursue collections
from delinquent owners. Each owner has an obligation to pay maintenance fees to help
maintain the resort in good condition. Not doing so places an unfair burden on the other
owners who are paying.
Report scams. Timeshare owners are prime targets for scam operators. If you be­
come aware of a fraudulent solicitation, notify your resort with the details. The resort
can then post notices about the scam to help prevent fraud before it occurs. Our Spot­
light on Scams article on page 14 highlights the counterfeit-bank-check scam that has
resurfaced in recent months. Make sure your resort manager puts a notice about this
in the resort’s newsletter Pictured below is a copy of a counterfeit check sent to the
editor, who communicated with the scammers so he could make a copy of the check.
Contribute bright ideas. If you become aware of a tip that could help save the resort
money or increase revenues, share it with the resort. Many resorts are “going green” so
that’s an area that’s ripe for reducing costs.
Keep your contact information current. You can help your resort save money by
notifying them on a timely basis about any changes in your mailing address, anticipated
changes in your ownership and your email address.

Loves Wyndham
points, but...
We experienced the exact situation as
the Zeiders in “Disappointed and Disillusioned.” Our experience was at Shawnee
Village in the Poconos instead of Florida
but the “Member Services Rep” could
have been reading from the same script.
Wyndham management has to know this
is going on; it can’t just be coincidence
that reps in two different places tell the
same lies.
We truly enjoyed our Wyndham
membership until that point. The flexibility of the points to go so many places
and just reserve the size unit needed (we
have gone by ourselves, taken friends and
family at different times) have provided
us many memorable vacations.
We are out from the presidential
nightmare, but of course had to buy additional points to do so. We have twice
as many points as we can use. They say
to rent, but this has not proven to work
too well, and I rather resent the time
necessary to figure out when and where
to book to rent.
We are paying maintenance for points
we cannot use and completely lose out
when we book and then they don’t rent.
If we could get back to where we were
before Pennsylvania we would be happy
again - and much wiser.

Satisfied exchangers
We have been timeshare owners for
twenty plus years, subscribe to TimeSharing Today and love it. It is the only way to
vacation. I read the article in TimeSharing
Today about exchange companies and
wanted to let you know that we have used
RCI, II and Bluegreen. The best response
that we have received has always been
from II; we use them more than the others and the fees are a lot less than RCI.
Bluegreen would come in second as we
do internal exchanges with them, and RCI
when we do use it, (which is very seldom),
is a last resort.
We really like II because it is very,
very seldom if at all that we do not get
what we ask for. A lot of the time we forget
that we have to use by a certain date, but
we always get something that we like,
and it is usually within driving distance,
which is a bonus in and of itself. Thank
you for being in existence; we have been
subscribers for many, many years, have
learned a lot and will continue to subscribe
for many more years.

Editor’s note: In the last issue, Dave
M’s column stated, “As far as I know, there
are currently no lenders that will finance
a timeshare resale purchase.”
Two readers of TimeSharing Today
have read the latest installment of “Ask
Dave M” and have advised me about a
company that finances timeshares called
timesharelending.net. They lend only on
Marriott, Hilton, Hyatt, Disney, Starwood
and Four Seasons timeshares. The minimum loan amount is $5,000. Interest rates
are 12.9% or 13.9%, depending on the
amount of down payment and there typically is a loan fee payable. One person has
posted on another bulletin board that they
paid total closing costs of about $900. The
loans are secured by the timeshare deed,
thus making the borrower eligible to deduct the interest expense for tax purposes,
depending on the borrower’s tax situation.

My wife and I became owners in
timeshares about 8 years ago. We have
two properties with Marriott and we have
really enjoyed both of them.
When Marriott started their points
idea, we studied the idea very carefully,
and came to the conclusion: With the
points we can go to our Marriott owned
resorts any time we wanted instead of being set with the same time each year. We
can also roll over our properties for Bonus

Points and go on some nice package trips,
which we have done in the past.
Recently, we upgraded to the Destination Points, and are now considered
“Premier Members.” We found that being a Premier Member, we do not have to
worry about using all of our points before
we lose them after two years. We are now
using our Bonus Points, which we have
a lot, for a trip to Rome and staying in a
Marriott Hotel.
I have nothing against exchange companies, but I have not found any properties
better then Marriott (maybe the Donatello
in San Francisco and Playa Grande in
Cabo San Lucas,which we own.) We
have found that the points open up all of
the Marriott Resorts and gives us more
leeway on when and where to go to enjoy
new Marriott Resorts.
Conclusion: Study before you buy.
Make sure the programs are good for you
and not for the sales staff presenting the
program. We are happy with our choices
and do hope that you find the Marriott Resorts as nice as we have found then to be.

These specials have been published in
our newsletter twice in the fall of 2011 and
the spring of 2012 and will also appear in
the fall of 2012 newsletter. It would be of
great importance for our owners to read
these publications. We do have some very
pertinent information in them. We also
have brochures with this information at
rest stops, visitor’s centers and information booths.
We do buy units back from owners in
good standing who have maintenance fees
paid up to date. The charge is $1000.00
for red time and $2000.00 for white or
blue time.
It would not benefit the owners
association for these units to go into
foreclosure and then into our inventory
where there would be no income to run
our property. The units taken back that Ms.
Saum, speaks of, and agreed to as a board
member, are ones that we have received no
payment on for at least two years or more,
some are as many as five or more years
with no payment of maintenance fees.

the last that we will publish about Ronald

does not cross the line into being offensive

As a sometime writer whose work has
appeared in this and other places for years,
may I say a few words in defense of Ron
Helms and his long running “Ron’s Select
Holidays” feature.
TimeSharing Today, since its founding, has been the OTHER voice of
timesharing. Not the Rah-Rah-Cheering
section of the sales people. Not the TellYou-Just-About-Anything department of
the developers. Not the Yes-You-CanAlways-Get-The-Exchange-You-Want
fairy tale of the big exchange companies.

of us. The place for everyday owners

I would like to clarify the letter written by Marilyn Saum in the Sep/Oct issue
of TimeSharing Today. We do have a
rental program which our owners can use.
We do not refuse rental to those renters
that our owners rent to. We do provide the
service to our owners. It is true we charge
a fee of 15% or $50 (whichever is less)
of the total amount of the rental for staff
providing that service.
We do try to rent Homeowners
Association-owned units first that have
been foreclosed in order to supplement
income for not receiving maintenance
fees. This was okayed by our board on
which Marilyn Saum was the president.
We do have a resale program which
we are now running specials of $500.00
for owners in good standing. Another
program we are executing to move some
of the inventory that we have acquired
from scam companies is to sell white or
blue weeks: one week for $1000.00 and
a second week for $500.00 for a total
of $1500.00; a red week for $2000.00
and a second red week for an additional
$1000.00.

diversity of writing here on these pages.
Different people make different observations and comments.
Anyone who regularly reads my
pieces know I write from a kind of slightly
humorous working class perspective that
comes partly from my background. When
I pay $40 for a meal, it seems a lot and
I say so. For those readers who feel the
same way, then reading my work is useful
to them. But some people might think I’m
some kind of a Cretan who can’t appreciate fine dining.
Other readers may travel with a sense
of self important pomposity that seems
undeserved. We’ve all met these people
in the hot tub and listened to them say
they’re never coming here again because
the drapes are not double lined like at the
Marriot in Escondido Beach that they
foolishly traded in for this crappy place
(that we have loved for years). Who is
going to write for them if not Ron Helms.
I like Ron Helms’ writing. When I
get a new issue I first read a piece by me if
there is one, in part to check for errors or

weird editing, but in part because I always
agree with everything I say. The second
thing I read is Ron’s Select Holidays. Ron
has a perspective that is very different than
mine and he makes comments and observations that are different than I would have
made. This is interesting, helpful, useful
and often amusing.
Ron says he is a University Professor. I have no reason to doubt him and
will take him at his word. All the more
amusing then, when his highbrow writing style leads him to use words in funny
ways. Like a couple of years ago when
he wrote “exasperate” the situation, when
the correct word was exacerbate. Or in the
September issue when he wrote: “I often
ask my university students to estimate the
U.S. National Park that receives the most
visitors.” Really? “Estimate” instead of
‘choose’ or ‘select’ or ‘guess’ in the same
sentence as “my university students”.
When Ron Helms takes the time and
effort to craft a story about a trip and a
place, it is of the goodness of his heart
and for the benefit of all of us. Will we
all agree with everything he writes? No.
But if he helps bring a small smile to a

benefit the rest of us, then he has done us
all a good turn. I would not want to live in
a world where everyone is so sensitive that
we cannot enjoy a wide variety of materials from a diverse bunch of perspectives.
Sterling Hartman’s parody review of
Grand Timber Lodge in the July issue was
the perfect way to comment on the issue
and inject some humor into the process.
I hope Ron Helms keeps writing. And
I for one, will keep enjoying his work.

Ron’s most recent diatribe focused
on “Ft Meyers beach.” The name of the
municipality is the Town of Fort Myers
Beach...one “e” in Myers. Certainly Ron
can read a road sign, and from that road
sign, he could learn to use the proper spelling of the town’s name when putting pen
to paper in an article destined for a travel
related publication.
Additionally, his comment about feral
children was patently unacceptable.
Ron’s comments are not part of a civil
debate advancing a controversial viewpoint, they are insulting and derogatory.
Is Ron blackmailing you to keep
his article going? We can figure no other
reason.

continue to voice his opinion, whether
everybody agrees or not. Just remember,
not everyone thinks alike.

Four Weeks in South Africa: Part 1

Like many readers of this magazine, I’d bought a couple
of South African timeshares, sight-unseen, back about 10 years
ago. Although I’ve now sold both, last year we decided to visit
South Africa and spent four weeks in Gold Crown timeshares
in September and October 2011. This covers our first week, a
very enjoyable week in Cape Town and the Peninsula Hotel.
The Peninsula is an all suites hotel with a timeshare element. In every way, you are treated like a hotel guest. There is
a tour desk and a timeshare sales office, but neither contacted
us during our stay. A nice restaurant and bar are onsite. We had
one breakfast and one dinner and both were good. They have
free Wi-Fi on the ground floor; you can pay extra to have Wi-Fi
in your room. A nice Exercise Room is on the first floor. Secure
parking is available for a small extra charge. Security at the hotel
seemed very good. They have a lawn area with grills for guest
use and a heated pool. A shuttle van can take you to most major
spots around town, but needs to be booked ahead, as they stayed
quite busy during our stay. The hop-on, hop-off, double-decker
sightseeing bus stops across the street; taxis are readily available.
After an 11-hour flight from Amsterdam, we were met by
the hotel-arranged limo and got to the hotel around midnight.
Check in was fast and efficient. Assigned initially to unit 302,
it turned out that housekeeping had missed the unit and it was
still dirty, so we were quickly switched to unit 702, Both were
two-bedroom, two-bath units.
The floor plans vary, so I can only comment on the “02”
rooms. You entered into a long hall, with the first door being the
second bedroom with two twin beds. Then came a bath with a
door both off the hall and from the second bedroom. Next was
the kitchen with door to the master bedroom with a king bed.
The kitchen was separated from the living room by a large
counter with four bar stools, but no dining table. Both the living
room and master bedroom opened on to a large balcony with
great views of the ocean just across the street. The balcony
was equipped with a table and chairs and two chaise lounges.
The kitchen was well equipped and had a full size stove, oven,
fridge, microwave, toaster, and granite counter tops, but lacked
a dishwasher and a coffee maker. (It did have an electric teapot
for hot water.)
The living room had a convertible sofa and two comfortable
chairs, and large flat screen TV with CNN, Sky News, and several
South African channels. The master bedroom had a small flatscreen TV, comfortable king bed, a chair and desk, and a window
seat (which we found was a good spot to store our luggage.)
The floor is tile, except for the carpeted bedrooms. There was
daily maid service. Laundry service is priced by the piece, but
we used an outside laundry on the same block that prices by the
pound. There is a Super Spar supermarket about a block away.
The resort sits right on the boundary between the Sea Point and
Bantry Bay neighborhoods.
We loved the city and the people of Cape Town. The city
sits on the Atlantic, backed up by dramatic mountains. We did a
couple of guided tours, two days on the hop-on/hop-off bus, and
picked up a car for day trips the last few days. The sightseeing
highlights included Table Mountain, Robben Island, a township
tour, the beautiful Kirstenbosch botanical gardens, the V&A
Waterfront for both lunch and dinner, lunch at Grote Constancia
Vineyards, high tea at the Mount Nelson Hotel, a walking tour
of the downtown area, and visits to the very tony beach towns
of Clifton and Camps Bay. Robben Island tours are canceled if
winds or large swells make getting into the harbor there difficult.
Our last two days in town, we got a rental car and visited the
Cape of Good Hope, including a visit to the penguins at Boulder’s Beach and the very pretty Chapman’s Peak Drive; and the
Winelands. The people here, of all races, seemed to have a real
love of life and optimism about the future; we didn’t find that
everywhere in South Africa.
A few things we didn’t appreciate about the Peninsula until
we stayed in three other resorts here: the only resort to provide
washcloths, the only resort with free Wi-Fi, the only resort with
international news channels on the TV, and the only one with a
racially diverse clientele. It was a great week and a very nice
resort.

Ron’s Select Holidays

My wife and I were students in
secondary school when Alaska became
a state on January 3, 1959, and when
Hawaii achieved statehood on August
21, 1959. We have personal memories
of the political, cultural, and economic
debates concerning these new U.S. states.
We certainly have always understood that
the concept “mainland” is acceptable to
Alaskan and to Hawaiian citizens; however, these Alaskan and Hawaiian citizens
are not very tolerant of the “mainlanders”
referring to the 48 states as the U.S. We
understand their rationale.
I have visited Alaska several times,
and timeshare visitation is not a viable
option if one intends to tour sections of
this great state. I was determined to fly
from Talkeentna and to land on Mount
Denali on my 49th birthday in honor of
Alaskan statehood.
While in our early twenties, we resolved that our youth, agility, strength,
courage would be devoted to sojourns
that required a degree of adventure and
risks; Hawaii would wait until our 60’s.
It is not that certain activities in Hawaii do
not require athletic ability. We knew that
Hawaii is a “walk in the park,” compared
to a number of other world travels that we
have enjoyed.
At age 60, we scheduled a Delta flight
from Cincinnati non-stop into O’ahu. We
discussed layovers in San Diego, Las Angeles, and San Francisco; but we wanted
a 16-day holiday in Hawaii. It is a bit
discouraging to realize that a vast majority of U.S. citizens have only rudimentary
knowledge of the geographic, religion,
history, and economics of the Hawaiian
Islands.
We exchanged our Delta Sky Miles
capital for two first class tickets from

Cincinnati to Honolulu; we are disappointed that Delta did not offer a business
class section. However, the first class
cabin and seating were very comfortable
for this flight. While there are pleasant
beaches and sights worth a visit on O’ahu,
examine a map of Honolulu, Pearl City,
Kaneohe,…, and there are just too many
similarities to southern California.
I planned to forego Waikiki Beach
and Honolulu altogether. We were spending the first week of our holiday on Maui
and the second week on Kaua’i. We had
no interest in the traffic and high rises
of Honolulu. Following deplaning, we
walked ten minutes through the open air
Honolulu airport and boarded a Hawaiian
airlines flight for the short hop to Maui. In
about the amount of time that it takes to
gather luggage and take a cab to Honolulu,

is poorly zoned. We are quickly driving
to the Sands of Kahana Vacation Club.
The following week we would fly to
Kaua’i, and reside at Marriott’s Waiohai
Beach Club at Kauai on the secluded
Poipu Beach.
Interval International lists 26 timeshare properties on Maui. There are
probably nearly 50 timeshares on Maui.
Ten million tourists visit Maui, and while
we had chosen the “off season,” I am
always concerned in locating two weeks
of premium properties. I really was not
certain about the difficulty of exchange
to Hawaii. I had the tools to determine
the premium beachfront properties, and
the Sands of Kahana Vacation Club was
a likely candidate.
While the Sands of Kahana Vacation
Club bears a Lahaina address, the beach
property is perhaps 15 miles north of
Lahaina, and Highway 30 bypasses this
pleasant tourist town.
In addition to reading the Interval
International description, I really value
the reviews in TimeSharing Today and
at RedWeek.com. The Sands of Kahana
Vacation Club is located near the Kaanapali coast, the west side of Maui, or as
is often expressed: “on the forehead of
the island’s head.” Navigation is simply
a matter of driving an excellent highway
30 to north of Lahaina. Here Highway 30
becomes a four-lane road. The drive from
the airport requires about 45 minutes; we
will be using Highway 30 frequently on
this holiday. Fortunately my wife is gifted

in language, and the pleasant Maui names
simply roll over her tongue.
We are staying at the Sands of Kahana Vacation Club; I emphasize this
because there are two other nearby resorts
that also bear the name, Kahana. Consolidated Resorts, Inc. manages all three
Kahana properties, and clearly specifies
that the Sands of Kahana Vacation Club is
their flagship resort, and is a “magnificent
jewel in paradise.”
We easily locate the Sands of Kahana
Vacation Club located very near other
eight story buildings (Kaua’i permits four
story buildings or buildings that do not
exceed the height of the ubiquitous palm
trees.) The general area is pleasant mix of
condos, family housing, restaurants, and
shops. Beachfront property is historically
at a premium in the Hawaiian Islands.
The Sands of Kahana Vacation Club
has an outstanding beach and directly
east, or behind us is the dramatic West
Maui Forest Reserve. One can only imagine the natural beauty of the Kaanapali
coast 100 years ago. But it is a quid pro
quo, concentrated civilization, and given
a little driving both oceanfront and jagged
mountain beauty. We realized long ago
that tent camping often provides much
more solitude; however, this premium
condo offers paradise as well.
The Sands of Kahana Vacation Club
offers the “strangest” check in procedure.
There is no lobby; instead a few young
women are gathered at a small outdoor
podium to greet guest, and to process
check in. The check in women seems

to function using a clipboard, but the
procedure is smooth enough, and we have
distinct directions to the parking area,
condo, and correct elevator.
I always take jpegs and convert the
jpegs into a PowerPoint for later reference. The Sands of Kahana Vacation Club
provides larger units than most premium
resorts. The master bedroom has floor to
ceiling three-light sliding doors that open
to a large deck. The master bedroom also
has a large folding wall that opens to the
living area and another wall of windows.
This arrangement maximizes the ocean
front view. While the Sands of Kahana
Vacation Club from the access road seems
to be in a congested area, the interior
design of each condo provides an excellent marriage of nature with a modern,
beautiful condo.
The landscaping of the grounds has
been provided the detail that is expected
in a tropical paradise. The kitchen is large
and functional; we discovered a “takeout
deli” within walking distance of the
condo. The client reviews of the Sands of
Kahana Vacation Club vary from extreme
affection to “miserable.” The Sands of

Kahana Vacation Club has all of the
amenities that a premium resort has, except the vital air conditioning. Perhaps,
the mixed reviews are a function of two
variables. The first is the famous Trade
Winds; if the Trade Winds are blowing,
this natural breeze will provide comfort.
The second is that parts of certain buildings are blocked from the Trade Winds,
and these two reasons seem to account
for several visitors’ complaints of the unit
being like an “oven at night.” On the
other hand, several owners and visitors
used phrases like “fabulous, fantastic,
wonderful, and highly recommend.”
We almost never waste our precious
holiday time with a “sales pitch.” However, since we were on site, we knew
we could hold the resort to a 90-minute
presentation. The scheduling person
presented our gift two days prior to the
sales presentation. We decided that
we really should spend an evening at
a Hawaiian luau (even though we had
experienced several luaus on the mainland.) We were given $100.00 per person
tickets to attend. The outdoor tropical
setting with the ocean was encouraging;
our “premium seating” permitted us to
by pass the regular line, and provided
front row seats. Luau food is not noted
as gourmet food, and Maui luau food is
deserving of a buffet reputation; an open
bar was available. The performance was
stunning.
Two days later, as we met with our
sales person, the requisite question about
timeshares was posed. I responded that
we own ten weeks of timeshares; all of
which have been purchased on the “secondary market.” This answer befuddled
the sales person, and he excused us from
the rest of the presentation because “we
were not eligible.” If my answer brings
this result (following the receipt of the
“gift,”) we may be more open to tenminute presentations.
Spending a week on Maui is an
epiphany of tropical natural splendor.
We enjoyed the quaintness of Lahaina;
however, the tropical beauty of the
ocean, the forest, the culture, and the
people are an invaluable experience. We
recommend reading several Maui specific tourist books; the outdoors person
will simply be overwhelmed.

Haleakala National Park and the
Road to Hana are always highly recommended. Several locals recommended
against driving the Road to Hana. If “617
curves, 54 one lane bridges” sound like a
day of fun, then go for it; My wife simply
cannot physically tolerate this “torture”
no matter ho beautiful the drive. We
also bypassed the 4:00AM rising time
to drive to Haleakala to see the sunrise;
however, I bet we would have insisted on
this experience in our twenties.
Maui is the kind of holiday that will
provide activities for everyone. Maui
deserves at least a week’s visit. We are
not certain that we would visit Maui in
the high season.
Most visitors will not have the time
(and or dollars) to engage in all the
possible activities that are available on
Maui. The tour books and select websites should be consulted for specifics on
the following Maui activities: Airplane
Tours, Airport Lei Greetings (The Lei
airport greeting for your wife must be
pre-planned and pre-paid), ATV Tour
Bike Tours, Day Cruises, Day Sailing,
Day Spa, Dolphin Encounters, Helicopter Tours, Hiking, Eco-Tours, Horseback
Riding, Inter-Island Tour (Molokini and
Molokai are nearby), Jet Ski, Kayaking, Luaus, Ocean Rafting, Parasailing,
Scuba Diving, Shows, Sightseeing,
Snorkeling, Sport Fishing, Submarine
tours, Sunset Cocktail Cruises, Sunset
Dinner Cruises, Surfing Lessons, Whale
Watching, Zipline Adventures, ….
At least one caveat is in order.
Many Web users may want to pre-pay
for certain activities; our observation
is that weather plays an important role
in most of these activities. The tourist
may save 10% on a day of snorkeling
by pre-booking, but if the waves are too
high, the trip is guaranteed to bring on
seasickness. It is prudent to wait until
one has a very good idea of the weather
conditions prior to driving to Haleakala
to see the sunrise if the day’s forecast is
rain and clouds. Remember Maui is not
“Disney.”
If one can be content with the natural beauty that abounds and is unique to
Maui, the price is often free and priceless.

Our Week at Port O’ Call on Hilton Head

ocean, it’s hard to imagine there
is anything wrong in the world.”
This quote comes from the book
Full Black by Brad Thor which I
was reading while vacationing on
Hilton Head Island (HHI), South
Carolina. It pretty much sums up
our vacation experience at Port
O’ Call on Shipyard Plantation.
Although the beach with the roaring waves is magnificent, the “quiet” side
of the island is not to be missed either.
We had flown into Savannah the day
before our week started so as not to waste
one precious moment of our vacation. Our
day got off to a great start when we were
told our car rental company had run out of
cars and they needed to upgrade us — at
no charge. We left quite happily with a
Lincoln Town Car, a luxury we wouldn’t
have afforded ourselves otherwise. After
having breakfast at Goose Feathers (awesome), visiting the Thomas Kincade Gallery, buying spices at The Salt Table, and
wandering around Savannah, we headed
for HHI.
Check-in was easy and fast. After unpacking, we had to go to the beach - indescribable, priceless. After dinner at Market
Street (very good) in Coligny Plaza, we
went back to the beach, The public beach
access at Coligny is very impressive. It
is busier than the private access
at Port O’Call, but can be more
interesting (like kite-flying).
There are several public beach
accesses on the island.
Sunday was the 10th Anniversary of 9-11. Flags were
at half-mast. Churches were
having special services. Appropriately enough, we stumbled
on the Veterans’ Memorial Park
(Shelter Cove). This is a beautiful park on the water, as is the
Shelter Cove Community Park
right next door.
We had the first of several meals at
one of our favorite restaurants — Fiesta
Fresh Mexican Grill. Whether breakfast,
lunch, or dinner, you would be hardpressed to get a better meal for the money
anywhere on the island. Back to the beach
for more “swimming” (actually bobbing
and floating). The water temperature is
around 83 degrees.
Port O’ Call is a great place to stay.
Our unit had two bedrooms, a full kitchen,
whirlpool tub, deck outside the living
room, washer, dryer, and two televisions.
Activities include tennis, golf, pools,
walking and biking paths, and picnic
areas. Private beach access is only a few
blocks away. If you keep your eyes open
you might spot the resident alligators!
Although rain had been predicted for
almost every day, it did not rain once. We
had 90’s every day except the last two. After going to a complimentary breakfast by
the pool and finding out about a few activities, we decided to get our owner update
out of the way. Remember, Just Say No.
Unfortunately we said “OK” and before
the day was over we had converted from
weeks to points and sold our Bluegreen
points; two days later we cancelled.
Needing to relax after that ordeal, we
bought two mini-beach chairs at Walmart
(which miraculously fit in my suitcase
on the way home) and went to the beach.
Jellyfish, sand dollars, and shells were in
abundance that evening. We strolled very
carefully as the sting of a jellyfish can be
very painful, as can stepping on broken
shells. The sand dollars are a protected
species on the island.

Dunes), Flatbread Grill (Coligny Plaza),
Salty Dog Café (South Beach/Sea Pines
Plantation), Nicks’ Steak & Seafood, Giuseppi’s (Shelter Cove Mall), Steamers
(Coligny Plaza), and our farewell breakfast at Southern Coney (Circle Center). It
is difficult to decide where to eat with the
abundance of magazines and coupons.
Every meal was at least very good!
HHI has come along way since my
first visit many years ago. It may look
like you are in the Garden of Eden, but
just about everything you could want or
need is hidden behind the beautiful land-

scaping.
Again, with so
much advertising and
so many activities to
pick from, it is hard
to narrow down the
choices, especially if
you have never been
to the island. Thankfully we have been here
several times (feeling
less like tourists and
more like locals), so we
were looking mainly for
things we had not done on previous trips
(aside from the beach, of course). We did
the required shopping ,with many stores
having sales since the “season is over.”
September, aside from being hurricane season, is the best time to visit. The
ocean has been warming up all summer,
the crowds are down, and the sales are up.
The Costal Discovery Museum (Honey
Horn Road) is a must see. As luck would
have it, they had a Farmer’s Market (Friday mornings) by the museum. I encourage you to arrange your visit to HHI so
you can visit the Farmers Market before

your vacation starts to get fresh fruits and
vegetables, free samples, and other helpful
information about restaurants and catering
companies.
Next time we go, we want to make
a better effort on knowing what is going
on before we get there. Everywhere are
racks and racks of free brochures and
magazines, making one’s head spin..
Some of the best things occur only once
during the week (like the Farmers Market
or the Jazz Festival or Wheelchair Tennis
Tournament) and sometimes you find out
too late, if at all.
I won’t say that Port O’Call is our
best exchange, but certainly one of them.
Hilton Head Island is the place you go
when you not only want to go on vacation,
but when you need to go on vacation. I
recommend two weeks if you have never
been there, especially if you take time to
play golf and tennis. That way you can
enjoy HHI at a relaxing pace and not be
concerned how many times the beach
beckons you, how often you sit on the
deck or by the pool reading your favorite
book, or close your eyes listening to the
quiet (and the seagulls, of course!)

Fake bank check scam
resurfaces
A scam that was common several
years ago has resurfaced, with the scammers probably relying on victims’ not
remembering about this particular scam.
The first warning would be if you
get an email, such as below, addressed to
“undisclosed recipients.”:
“Could you please provide more
information about your timeshare? I hope
it is still available for sale? Please let me
know your last annual maintenance fee
amount.
Kind regards,
Karen Hodson”
Or simply:
“Is your timeshare still available for
sale? Please advise.
Regards,
Frank Tesoro”
“He asks if you are the owner and
then tells you he is a buyer representing
himself. He asked a few questions and I
said to please call me with any questions.
He tells you he is hearing impaired and
will use the computer. . . . He comes
back with an offer and tells you that First
American Title will handle the closing
and he’ll pay all the fees notify the association and will be dealing through his
broker.. . . I decided about 30 minutes later
to google Frank Tesoro on the computer
and his name sure came up. Apparently
this is his usual way of doing things. It is
worth the read.”
“When it comes time to conclude
the deal, he says that he will send you a
check for more than the amount you are to
receive, and request that you deposit the
check to your account, then wire transfer
the excess to the “broker.” The check you
receive will be bogus, but it will take a
couple of months for the check to bounce
back to your bank through the international banking system. In the meantime,
you will be out the money you wired to
the “broker” accomplice.”
Reader Linda Bass writes about a
letter from “Daniel Dobrin” which said
“I have mailed out to you a cashiers check
for $2900. Upon receipt, I would need
you to deposit the check; funds should be
available immediately, I would need you

to deduct the ernest deposit of $500. Then,
forward the balance $2400 to my broker,
Mr Samuel, as his fees”
Another reader got a check from
“Daniel Dobrin and says, “I took the
check to my bank knowing it was bogus
and at first glance, my banker said it was
the ‘worst fake check he has ever seen.’ ”
The names in this article (Karen
Hodson, Frank Tesoro, Daniel Dobrin)
are some of the ones used during the past
few months and are sure to be changed, or
may have already been changed.
Don’t accept any check for more
than the selling price, no matter how
genuine it may look, and then send the
“excess” on to a third party.
We-have-a-buyer scam
From Alexandra Danea:
The fraud that everyone should know
about is the calls from management companies stating that they have a corporation
that wants to buy your timeshare and
always for $10,000 more than you would
sell it for. They send you an email to sign
and return saying you are interested and
then you receive a contract. This has happen to me 5 times in 6 months. One out
of Utah called Meritage Management. A
group in West Covina, CA, uses the names
of licensed real estate people so you start
thinking this could be real. They are using names and 800#’s but they are not the
realtors with the real license.
I told each to send a contract that no
fees are paid by me and commission is
paid after the money is wired; all stated
that would be the case. Each contract asks
you to put the fees in an escrow (not a real
company but has a website) and they will
repay that.. When I told them they could
just reduce the price to the client that I
would accept $5,000 less, they hung up.
Mortgage payoff scam
Federal officials in New Jersey and
South Carolina recently announced the indictments of 16 people defraud more than
200 timeshare owners through a former
company they operated called Vacation
Ownership Group, or VO Group LLC,
according to the U.S. District Attorneys
Office in New Jersey.

The principals of the company are
charged with wire and mail fraud, conspiracy to commit wire and mail fraud and
conspiracy to commit money laundering.
“The trickery described in these complaints underscores the lengths to which
people can go to swindle their unsuspecting victims,” First Assistant U.S. Attorney
Gil Childers said after the arrests “That
the victims in many cases were elderly
makes these alleged crimes particularly
offensive.”
Law enforcement officers began
investigating the company in July 2010
and found that from March 2009 to Sept.
1, 2011, the defendants participated in a
fraud scheme to call owners of timeshare
properties purchased from Flagship Resort
Development, Wyndham Vacation Resorts
Inc. and other timeshare developers. They
convinced owners to submit money to
the VO Group, purportedly to pay off the
owners’ mortgages on their vacation units,
the complaint states.
The VO Group claimed that the
timeshare owner could pay off the mortgage balance at a substantially reduced
amount - often as much as 50 percent of
the amount of the original mortgage - by
mailing payment to the VO Group at a post
office box in Pleasantville, N.J., according
to federal investigators.
“The VO Group representatives
also got timeshare owners to send the
VO Group money purportedly to have
timeshares canceled or sold. After receipt
of payments for the VO Group’s service,
the conspirators caused those payments
to be deposited into a bank account in
the name of the VO Group,” the federal
complaint states.
“Rather than paying off the timeshare
owner’s mortgage, canceling the owner’s
timeshare or selling the timeshare, the
conspirators used the timeshare owner’s
money for their personal use,” the complaint alleges.

The fraudulent telemarketing operation preyed on timeshare owners, inducing them to fork over closing fees for
what they were told was the impending
sale of their timeshare, according to the
complaint.
“There were neither closings nor
purchases of any timeshares as promised
by the telemarketers in their telephone
calls and contracts,” the complaint alleges.
“Virtually all of the money received by the
scheme was pocketed by the organizers
and telemarketers.”
The defendants are accused of conspiring to commit mail and wire fraud in
connection with the alleged scam. Each
charge brings a maximum of 20 years in
prison.
The complaint details how the scam
played out:
Telemarketers referred to as “openers” or “fronters” would contact the
timeshare owners by phone and coax the
owners to sell their timeshare. Callers
would claim that their company was either
prepared to buy the timeshare, or that they
had arranged a buyer for the timeshare.
If the victim showed interest, they
would be forwarded to a “closer,” whose
job was to negotiate the “sale” and close
the deal. The closer would discuss the
terms of the contract and upfront fees, then
send a fraudulent contract by mail, e-mail
or fax to the victim.
At this point, the victims were instructed to mail or transmit their “upfront
fees.” They were told that the closing
would occur in a few weeks.
“The conspirators frequently changed
the name of the company after just a few
months,” alleges the complaint. “This
change of name aided their evasion of law
enforcement scrutiny.”

Two of the defendants allegedly
tried to sound more credible by identifying themselves as the “director of sales.”
Others mentioned that the company used
Royal Title Services, which, investigators
said, was actually a “fictitious company
created by co-conspirators.”
The manager of a similar resale telemarketing scam that bilked 22,000 victims
of $30 million was recently sentenced to
14 years in prison, five years of supervised
release, fined $1,000 and ordered to pay a

Hawaii: Our Best Exchange Ever

I don’t usually have a tough time
writing, but this topic had me twisting
in the wind for a while. Best? Really?
How to choose? Where to start? Out
of so many fantastic and life changing
(mostly) family experiences....which one
to pick? One week I was swimming with
my wife at Annini Beach on Kauai. Reef
protected, coral sand, warm, beautiful,
azure sky. This half mile stretch is one
of the most beautiful spots on earth yet
rarely populated by even a dozen people,
and this story began to write itself in the
warm Hawaiian sun.
Our best exchange ever was in 1989.
Not because of the resort, or the grounds,
or the friends we met or any of the normal reasons others writing for this series
will tell you about. But because it took
us to a place that previously was only
in our dreams. It exposed us to someplace magical, almost spiritual. And we
learned not only the wonders of Hawaii,
but also how to return, again and again.
And that changed our lives forever.
After owning our first timeshare for
a few years, and learning the exchange
process through experience, we would
sometimes peruse the thick RCI Vacation
Catalogue and imagine going places with
our then young family. Back then the
RCI system always had a huge surplus
of weeks; people would deposit weeks
and then not go anywhere. And back
then, they only put the weeks back into
the hands of members. Two for one,
bonus weeks, extra vacations, RCI did
everything it could think of to get rid
of this surplus. With a little flexibility
you could go anywhere...except Hawaii.
Marketers of Hawaiian timeshares used
official looking RCI graphs showing supply and demand, and showing demand
ten times supply. Word on the street was
that to trade into Hawaii, you had to bank
Hawaii. When we got the serendipitous
chance to go to the Bay Club on the Big
Island of Hawaii, we were overjoyed.
We scratched around for some way
to extend the trip because the flight was
so long, this was hard to do before the
internet, but we found that the developer
of Shearwater on the island of Kauai had
a rental special, with timeshare tour of
course, showcasing this brand new resort.
We learned which airlines flew to Hawaii
and from what cities and of Aloha, the
inter island airline. Altogether we booked

a total of 28 flights for the four of us, on
three airlines.
Mr. Timeshare deserves an award.
Timeshare has stepped in and saved more
failed hotels and condo developments
than anyone realizes. The Bay Club
started out as high end all year condos,
built by a Japanese developer for Japanese buyers. By the time it was done
Japan was heading into what the Japanese
called the “lost decade” - An economic
stagnation of high debt and slow growth.
With no buyers, it languished until a new
developer turned it into timeshare.
We were in an original Japanese unit
with interesting counter heights and door
sizes. We took the tour of a refurbished
unit and were blown away. First class.

They needed top dollar for these units,
and with small children, it was too rich
for us at the time. At the end of the week
it was a short hop back to Oahu then
another on to Kauai.
Shearwater’s developer was Pahio,
run by David Walters. When he left the
mainland for Kauai he began building
condos and later timeshares. He built an
organization that had a real “part of the
family” feel to it, and we loved it. There
was a timeshare resale office in nearby
Hanelea, and the realtor had a few weeks
in Ka Eo Kai, Pahio’s original resort, built
about 1980. We liked the Pahio group
better than any other developer and we

liked this resort much better than any
other in the Pahio group.
The upper units in the phase two
section had vaulted twenty foot ceilings,
giant windows and sliding doors oriented
to catch the tradewinds, and wrap around
1,000 square foot lanais, the giant Hawaiian version of a front porch. First class
units, first class organization and a first
class location on Kauai, Hawaii’s Garden
Island. It is more beautiful than I can
describe. I won’t even try. Suffice to
say the nearby rainforest includes waterfall covered mountains overspread with
vegetation that doesn’t even look real.
Armed with the resale price, we went
to see Charles Ng, head of sales at Pahio.
After a few minutes hearing his deal, we
told him ours: We could buy the resale
week or we could buy from him at the
same price. We would rather buy from
him but we didn’t care. All of the onus
passed from one side to the other and
the pressure was now on him. We knew
they were taking back a few Ka Eo Kai
weeks as trades to facilitate sales at the
new Shearwater and he had to get rid of
them. He then did us a huge favor and
explained the types of units, A-ground
floor, B-second floor and in Phase 3, Cthird floor. We really liked the top floor
units in phase two, and the resale we
were looking at was a different unit. He
talked us up a little, and sold us the unit
he knew we wanted.
Of course we’ve been back. And
gone lots of other places too. But somehow Hawaii never really leaves us or we
never really leave Hawaii. We feel much
more kama’aina than haole, more native
than immigrant, in the resurgent Hawaiian language. And it all started back with
our Best Exchange Ever.
I started this story on my laptop overlooking a beautiful Hawaiian garden and
wrote some more last year back on the
mainland. And the real point of sharing
our best exchange could lead to your best
exchange. People pay $14,000, $18,000
even $30,000 for timeshare weeks in
Hawaii. We’ve even heard of weeks
at the nearby Westin going for $50,000
and more!
And yet with the bad economy
comes opportunity. Wyndham, who
took over from David Walters when he
became ill, is too busy selling marvellous

program at the Pahio Resorts. But with
the economy what it is, and some internet
savvy, you can find a few weeks kicking
around auction and resale sites, as low as
a few thousand, sometimes even a few
hundred dollars. We just bought a second
week for ourselves through a realtor on
Kauaii. Everything was done by phone,
internet and mail.
Hawaii’s islands are so different
from each other that one could be just
right for you. Ever dreamed of a place
in Hawaii? This could be you. Hawaii
awaits!
Disclosures and Reality: Hawaii
is a little more expensive than most of
the mainland for everyday items and
groceries. Flights are a real cost, but
are seasonally cheaper certain times of
the year and cheaper at off peak hours
and days. So scheduling can make a big
difference and there is no “off season”
in Hawaii. Maintenance fees are on
average higher than the mainland. Each
island is so completely different from the
others you would doubt they’re in the
same archipelago. Desert dry sunny to
rainforest and ultra quiet to party central.
If Hawaii beckons, do your research,
pick a resort and then take advantage of
the opportunity. We found frequent eBay
listings and also MyResortNet.com has a
customizable search feature that is useful
and there are many other places to look.
Epilogue: Earlier I said that I began
this story on Kauaii, wrote some more
last year back on the mainland, but did
not complete the story until now. That’s
because it turns out that even with a little
internet savvy, some of the owner-listed
units I found just seemed to disappear

once I asked careful questions or to see
the deeds or took the first steps to buy
them. Maybe they were already sold,
maybe people changed their minds. Maybe they were scams. Be careful. Only
pursue your dream of a week in Hawaii
through a licenced Hawaiian based real
estate agent. After a few false starts my
new week was ultimately found this way
and is currently in escrow. Our best exchange ever changed our lives. Perhaps
our story can change yours.

Trump sells Vegas condos
for use as timeshares

Vegas.”
The 64-story tower, located on
Fashion Show Drive near East Desert
Inn Road, opened in March 2008. It’s
encased in 24-karat gold glass and includes 1,232 suites and 50 penthouses.
Prices for the condominium units start
at $300,000 for a studio and climb to
more than $3.5 million for the largest
penthouse. Hilton has not announced
prices for the timeshare units.
The property has had its share of legal problems. About 300 investors who
put down deposits in 2005 and 2006
sued in January 2011, alleging they were
induced into buying the condo units at
inflated prices. A federal judge rejected
their claims last August.
Diamond Resorts acquires
company with five resorts
Donald Trump’s gold-colored
high-rise near the Las Vegas Strip will
no longer be just a condo/hotel tower:
It’s now a condo/hotel/timeshare tower.
Trump International Hotel Las
Vegas has sold approximately 300 condominium units to Hilton Grand Vacations, the timeshare division of Hilton
Worldwide, and Hilton.
Hilton will use the units as timeshare accommodations starting next
spring and will be responsible for selling the timeshare intervals. The Trump
Organization, which is based in New
York, will still manage the building.
“We are confident that this relationship will not only add to the tremendous appeal of Trump Las Vegas but
also will provide great benefit to our
existing owners,” said Donald Trump,
chairman and president of the Trump
Organization.

likely be layoffs by Westgate if Obama
were to be re-elected, while extolling his
virtues as a hard working entrepreneur
who has created jobs and should not be
subjected to tax increases.
Wyndham takes over Shell
Vacation Club
Wyndham Vacation Ownership, has
acquired privately held Shell Vacations
LLC and its subsidiaries. Shell is one of
the largest independent vacation ownership club and property management
groups, serving approximately 115,000
members and 19 managed resorts in
North America. The purchase price for
the equity of Shell is approximately $102
million in cash. The acquisition also
includes $153 million of debt, which
is primarily related to consumer loan
receivables.
Under the terms of the agreement,
Wyndham assumes property management operations at 19 Shell resort locations in Hawaii, California, Arizona,
Nevada, Oregon, Wisconsin, Texas, New
Hampshire and Canada. Wyndham will

now also operate Shell Vacations Club
and assumes management of all Shell
marketing, sales and financial services
activities.

Salespeople charged with
state tax evasion
Four time-share agents who work
for the same Hilton Head Island company have been arrested and charged
with evasion of South Carolina state
income taxes.
The arrests followed routine audits
by the Department of Revenue, according to public information officer
Samantha Cheek. The discovery has
prompted a “big, ongoing investigation
in the area,” into tax evasion and fraud,
said Cheek, who would not offer further
details.
The agents, Stephen Deutsch, Leigh
Hoppe, Robert Lauderman and Freda
McKinney, all worked for Sunrise Vacation Properties of Hilton Head.
The four agents earned a total of
$1,562,912 during 2006 through 2010
and failed to pay a total of $75,524 in
taxes. If convicted, they could face fines
totalling more than $200,000 and jail
terms up to six years.

White Point Vacation
Club, Nova Scotia

In September we joined friends
from Ontario for a week at White Point
Vacation Club, a RCI Gold Crown resort on the Atlantic side of Nova Scotia.
The nearest town is Liverpool. There
are three ways to get to the resort - drive
across from New Brunswick and down
the coast, fly to Halifax and rent a car,
or take the ferry from Saint John, NB.
Ferries from Boston and Bar Harbor
have been discontinued.
We crossed the Canadian border
and spent the night at Blair House, a delightful and convenient bed and breakfast. in St. Stephen. Tea and cookies
are served in the afternoon. Luckily we
had made reservations early, as it was
filled. A one and a half-hour drive took
us to St. John to catch the noon ferry,
which we preferred to the midnight
departure. Along this route is the Bay
of Fundy with its 14-foot tides and the
Hopewell Rocks “flower pots” which
we had toured before when traveling in
our motor home.
After a three-hour ferry ride across
the Bay of Fundy to Digby and a twohour 98-mile drive to the “South Shore”
on the Atlantic side we arrived at the
resort. Check-in at the lodge was easy
and the staff very friendly. We were
given a map to get to the timeshare units
about a half mile away over a bumpy
dirt road.
There are twelve timeshare cottages each surrounded by woods. We
had the best unit, 411, which has a direct view of the ocean through the glass
front and the inlet to the side.. This is
the unit pictured in the RCI directory
with the authentic old beacon light atop
a large rock in front. A switch in the unit
controls the light.
Flower lovers would love this
place. Flower boxes on all the windows
and around the unit had blooming
flowers that seem to
blend with the surroundings. The wide
opening to the ocean
lined with roses and
other flowers also led
to a walkway across
an inlet and then to
the lodge. One other
unit faced the inlet but
the other ten were each
isolated by trees.
Our cottage had three bedrooms,
two baths, and a large L-shaped living, dining and kitchen area. The big
room has a flat screen television and
rock fireplace ready to light. Extra
wood, kindling and paper were beside
the fireplace and also in a box on the
side porch.
Lots of glass gave us a good view
from inside and a large porch across the
front had a unusually generous amount
of furniture with two sets of tables and
chairs and also two Adirondack chairs.
All the furnishings in the cottage were
in good condition, but the floor badly
needed refinishing. Both the wives
are cooks and found everything they
needed in the kitchen except for a rectangular baking dish. Being resourceful

they fashioned one with aluminum foil
inside the roaster pan. That is why we
married them.
Crossing over the inlet was a path
along the picturesque rocky shore to
the lodge. The lodge overlooks the
ocean and long wide sandy surfing
beach and many small rental cottages. Above the lodge are other rental
rooms. The lodge has a gift shop,
restaurant (which we didn’t try,) nice
large indoor pool, exercise room, and
activity room with large screen. Sports
equipment is available. Outside was
a very small pool with badly peeling
paint on the bottom but it was the end
of the season.
There were no weekday activities;
entertainment is provided on Friday
and Saturday nights. Children’s activities are provided on Saturday and
Sunday.
This resort is a good base for
exploring the “South Shore” of Nova
Scotia. Groceries and shopping are
only a few miles away in Liverpool.
Here we saw the lighthouse and small
museum dedicated to Liverpool Privateers of the Revolutionary period.

To the south is the Yarmouth light
and museum which had just closed the
week before on September 15. At the
gift shop, get directions to Mern’s for
plenty of delicious seafood for lunch.
An interesting stop on the way back
was the old woolen mill in Barrington.
During the week we went as far
north as Lunenburg, a picturesque
old seaport town. Here are a marine
museum and buildings dating back to
1754 and you can watch the rebuilding of Bluenose II, a wooden schooner
named Queen of the North Atlantic
fishing fleet. Not far from Lunenburg
is Mahone Bay, a smaller interesting
town with its Three Churches. We
were just a little too early for their
Scarecrow Festival. You can watch
the spinning and casting processes
involved in making pewter objects at
Amos Pewter on Main Street.
This resort is very good and
likely the best resort in the area but,
compared to the many resorts we have
visited, we would not give it the top
rating of Gold Crown. We enjoyed our
week here and recommend the resort.

Escapes! to the Gulf at Orange Beach, AL

We exchanged our two-bedroom home unit in North Carolina
for a one-bedroom unit at Escapes! to the Gulf at Orange Beach,
Alabama, through Interval International.
Our stay was in September, which is low season. This is good
since there are very few tourists at the beach, but bad because
the water temperature is beginning to cool off, which brings the
moon jellyfish into shore. We arrived driving through Pensacola,
Florida, and would recommend an alternate route for others if
possible. The traffic is very slow. We arrived at around 2:50pm
(check in is officially at 3pm) and had our room and keys in
about 10 minutes.
There are four buildings (A-D); we were in A on the fourth
floor. There are both stairs and an elevator to get to the different
floors. The unit was wonderful, with a kitchen, dining area, small
living room, large bedroom and a very large bathroom with both
a walk in shower and a Jacuzzi. There are TVs (not flat screens)
in both the living room and bedroom, and included VHS and
DVD players.
The unit came with one single use laundry detergent packet
to be used with the washer and dryer, two packages of coffee (inside a filter) ready for use, several dishwasher tabs, dishwashing
liquid, and bars of bath soap. The kitchen is fully stocked. There
is no maid service but the unit came with a set of 8 towels and
washcloths. We had a balcony that could be accessed from the
living room or bedroom, giving views of one of the pool areas
and the beach. Although the wireless access code was only for
owners, the room did have a Ethernet cable to access the internet.
The resort has two pools and a small fitness room. The pools
are in the middle of the four buildings. The pool gates remain
locked until 9am so there’s no opportunity for an early morning
swim. However, both pools were kept immaculately clean during
our week stay. The fitness room is actually a weight room with
two big nautilus-like machines, two benches and a set of free
weights. Within a few miles from the resort, are many restaurants
and shops in Orange Beach. To buy groceries, you can choose
from Walmart Market, Winn Dixie or Publix. In the other direction from the resort will take you into Gulf Shores.
Restaurants
The first night, we ate at Wintzell’s Oyster House on Rte
182, Perdido Key. They have a large outdoor seating area. We
would highly recommend the baked Creole crawfish pie - YUM!
One day we visited Hopes Cheesecakes in Gulf Shores off
Rte 59. If you are a cheesecake lover, it’s definitely worth a visit.
There are many varieties available by the slice or you can buy a
whole pie. You can also order her cheesecakes over the internet.
We tried three varieties since we couldn’t make up our mind Kahlua Chocolate, Bailey’s White Chocolate, and Blueberry.
All were delicious.

Oyster House on Rte 59 in
Gulf Shores. In addition to the
restaurant, there is a boardwalk with several shops and a
small marsh that you can walk
around.
For breakfast one morning
we visited the Beignets Café on
Rte 180 and 59 in Gulf Shores.
It’s very similar to Café du
Monde in New Orleans, but
without the atmosphere. This
café is located in a strip mall,
but the beignets were very good
and the gentleman baking was very nice
and talkative. There’s another Beignets
Café located in the Winn Dixie shopping
area in Orange Beach.
Another restaurant we visited was
Bubba’s, heading toward Orange Beach.
The portions are big and the atmosphere
fun. Their menu was similar to the other
restaurants in the area.
If you drive to Pensacola Beach
across the three-mile bridge, we recommend stopping at Peg Leg Pete’s on Ft.
Pickens Road for a meal. It’s got a huge
outdoor eating area, live music several
nights a week and lots of atmosphere.
The food was very good and the prices
reasonable.
A good place for breakfast is Hazel’s,
only a few miles up the road toward Orange Beach. It was listed in the 2010 list
of 10 Places to Eat in Alabama Before You
Die. For about $9.00 you can get a breakfast buffet that includes bacon, sausage,
hash browns, biscuits, gravy, pancakes,
French toast, fresh fruit, hash, and a omelet station. On the weekends, the buffet
switches over to a brunch type menu.
On our last night we ate at Lulu’s, off
Rte 59. This is Lucy Buffet’s restaurant
and is much more than just a place to get
food. The entire restaurant is open-sided
with several bars both under cover and
outside. In addition, there are several
play areas for the kids and a “mountain of
youth” rope climbing activity for adults.
There’s live music and a large gift shop,
with ladies-friendly T-shirts and such. The
food is good with reasonable portions (not
oversized). Highly recommend the Krispy
Kreme bread pudding. Yum!
Activities
There are plenty of souvenir shops
that line Route 182 in Orange Beach. The
same shops are located down the road in

Gulf Shores at the intersection of Routes
182 and 59. They all sell the same stuff.
One day we drove a few miles up
the road and walked on a series of paved
paths ranging in mileage from 1 to 2.75
miles in the Gulf State Park. The trails
are called Hugh S. Branyon Back Country Trail. There are benches and wooden
swings throughout that have been donated
by people. There is also a restroom in the
center of where all the paths meet. One of
the trails can be accessed directly across
the street from the resort.
A nice day trip would be to go to Fort
Morgan, about 30 miles from the resort.
There’s a small museum at the Fort, as
well as some original buildings. There,
you can also take the car ferry to Dauphin
Island. Although we didn’t stop, it looks
like there was some kind of a fort structure
there as well. We took the ferry over and
then continued driving on to Biloxi, MS
where we visited all 8 casinos. We took
I-110 to I-10 back to Orange Beach; the
drive took about two hours. There are
eight casinos in Biloxi, all within a few
miles of each other., but far enough apart
that you’ll need to drive.
A bike and pedestrian path line
Beach Rd, Rte 182, being very safe for
walkers, runners and bikers. If you run
from the resort toward Orange Beach, the
road remains well lit from all the hotels
and condos. From the resort down to the
Waffle House is 2.5 miles.
Another nearby activity is to drive to
the Gulf Shores Pier. It costs $2 a person to
just sightsee and more if you want to fish.
They even rent fishing poles, etc. and you
can buy your license right there. We took
a walk one evening and watched a couple
fisherman catch fish called Jack Crevalle,
a fish known for its poor taste and fighting
prowess on the fishing line. Both weighed

in over 15 pounds.
A full day can be spent in
Pensacola. We visited the National Naval Aviation Museum,
the Pensacola Lighthouse, and
Fort Barrancas, all located on
the Pensacola Naval Air Station. The aviation museum is
fantastic and 4-5 hours could be
spent looking at all the planes
suspended from the ceiling and
on the floor, as well as viewing the many video clips in the
various displays. On the day of
our visit, the museum was dedicating the
helicopter used by President Nixon.
Nearby off Rte 59, is the Gulf Shores
Zoo, worthy of a quick visit. Further
down Rte 59 is the town of Foley, notable
for Lamberts Restaurant, home of the
“throwedroll” and also a Tanger Outlet.
This was a great beach week, and all
the negative reviews about this property
were totally unfounded in our opinion. We
would recommend this resort for adults
and older children, as there are not many
activities around for smaller kids.

The Real Cypress Pointe Resort
While purporting to be about Cypress Pointe Resort, an article in your Jul/Aug issue is in fact is about a stay at the resort
across the street, the recently renamed Grande Villas Resort.
While the two resorts do share common areas, they are owned
and operated completely independently by separate Associations
and management.
The name change in September 2011 for the former Cypress
Pointe Grande Villas was done in part to clear up the confusion
for owners and guests. The article that you printed is an example
of a stay that is incorrectly identified as being at Cypress Pointe
Resort , when in fact the guests stayed at Grande Villas Resort
next door.
The two resorts are very different in unit quality, design and
features. It is both misleading and unfair to speak of the conditions and features of one resort as applying to the other. While
Cypress Pointe Resort has the older buildings, Cypress Pointe
Resort also has a long term commitment to renovations and
upgrades to keep it fresh and competitive with even the finest
of newer resorts. Our long standing RCI Silver Crown status,
as well as AAA ranking, speak to the quality and great vacation
experiences offered at Cypress Pointe Resort. While it is a nice
resort, Grande Villas Resort does not have any award rankings
with RCI or AAA.
The owners and their Board of Directors at Cypress Pointe
Resort are dedicated to their resort and its never ending improvements. The long list of recent upgrades include all new built-in

cabinets, new granite counter tops, new tile flooring, installing
privacy doors on the formerly open bath areas, flat screen HDTV’s
and much more. Despite their age, Cypress Pointe Resort’s units
have virtually every feature a modern resort offers. In addition,
Cypress Pointe Resort’s common areas have a large new recreation area, children’s dinosaur-themed playground, brand new
ADA compliant interactive play fountain and a new Porte Cochere
entryway. It’s signature Volcano-themed pool has just been upgraded to meet all Federal and State ADA laws. More upgrades
to every Cypress Pointe Resort unit will begin in January 2013.
We strongly urge owners, their guests and exchangers to
visit the one and only Cypress Pointe Resort and discover for
themselves what an Owner controlled and operated resort in the
very heart of the Orlando Entertainment area has to offer. We do
not want owners or guests to confuse our resort with the operation
at Grande Villas Resort as they are two very different resorts.

Positives and Negatives
at Sands Ocean Club

Sands Ocean Club Resort at North
Myrtle Beach, SC had positive and negatives relative to our stay.
The hotel visitors are greeted and
registered at a large counter right inside the doorway, whereas timeshare
owners are directed to a smaller office
off to the side of the main registration.
The registration was handled quickly
and efficiently. A hotel attendant took
our luggage and extras to the timeshare
unit. There was a hotel in addition to
the timeshare building plus individual
owners, for a total of three (3) buildings
which were attached to one another.
The buildings appeared old and needed
exterior updates and painting.
Our exchange was for a two-bedroom. The accommodation was adequate
and served our purpose for one week;
however, we were disappointed and
would never exchange to the Sands
Ocean again.
The housekeeping staff skipped
some areas and there was visible dust.
Some basics were missing, like hot pads,
dish towels and dish clothes. I called the
timeshare office and the missing basics
were quickly delivered to our unit. Bath
towels and wash cloths were thin. There
was a slight lingering odor, like the exterminator had sprayed before our arrival,
and this aggravated my allergies.
On a positive note, the bed was very
comfortable. That in itself was a positive
because we have had timeshare exchanges where we experienced uncomfortable
beds for sleeping. It appeared that there
had been some updating of the unit where
we stayed. The furniture was newer as
well as the appliances.
The second bedroom was too small
and there was not room for even a
dresser. The room consisted of two twin
beds lined up against the wall in an
“L” shape and one night stand with no
lamp. The only light in the room was a
ceiling light that was accessible with a
wall switch when you entered the room.
There were two bathrooms; one with a
shower only and the other with tub and

shower. These were not large bathrooms
but served our purpose and functioned
with no problems.
Washer and dryers were on the
premises but not in the unit. The laundry
fees were rather costly with a fee of $2
to wash a load and it took $4 to dry the
load because it took two uses ($2 a use)
to get the clothes dry.
Sands Ocean Club was located right
on the beach, which was a super location.
There was an outdoor pool (unheated)
and a very small outdoor lazy river with
an ample amount of pool chairs; pool
towels were available. The indoor pool
need updating. It was made of tile and
although the water was clean, it gave a
reflection of being dirty. The first step
into the pool was high and the railing was
not very sturdy, thus it was difficult for a
person with a knee problem to climb out
of the pool. Also the pool area was dimly
lit at night and this presented a safety
issue. There was an outdoor lounge and
music by the pool area. Each evening
there was music at the outdoor bar located beach-side The music was enjoyable to hear and to sit outside socialize
and have food and drink.
The hotel area offered Ocean Annie’s bar and restaurant and a bar and
lounge with entertainment and karaoke.
The Carolina Opry was a great show
to see. It was a two hour performance
with good entertainment. If you like
a variety type show, you would really
enjoy this and the talent is outstanding
with great singing, dancing, music and

comedy. It is located at the Gilmore Auditorium in Myrtle Beach. I recommend
this; it was well worth the money to see
the show.
Another relaxing time was when
we took a one and a half hour boat ride
on the Barefoot Princess. You can park
your car by the Greg Norman Grill. The
two-deck boat went on the intercostal
waterway. A singer/guitarist entertained
us. We boarded the boat at the Barefoot
Landing, where there were some quaint
shops and we enjoyed a leisure walk
through the Landing. We stopped and
bought some good ice cream at Maggie
Moos Ice cream shop.
One evening we drove to the Boardwalk. There was a huge ferris wheel;
those of you who enjoy ferris wheels and
high ones would certainly like that one.
It is over 20 stories high.
We had dinner at Sea Captain’s
Restaurant. This was located on North
Ocean Blvd, close to the boardwalk and
overlooked the ocean. As we walked up
to the restaurant, it looked like we were
being invited into someone’s home.

Price-wise it was a little above average;
however, the food was very good and
we enjoyed a nice meal with a view of
the ocean. Service was also good. I had
stuffed founder with crab meat and my
husband had deep fried shrimp.
If you enjoy the gambling boats,
Myrtle Beach had that too.
The positives were things we could
do outside of the timeshare unit and,
also, the comfort of the bed. The negatives outweighed the positives. The
second bedroom was so small I wouldn’t
even call it a bedroom and, thankfully,

we had not invited anyone to use the
two-bedroom. The housekeeping was
not the best with visible dust and basic
essentials missing. The laundry was on
another floor plus it was expensive to
use with the total cost of $6 to wash and
dry a load of clothes ($2 wash - $4 dry).
Towels were thin.
Even with the negatives we did have
an enjoyable week’s vacation; however,
we would never stay at the Sands Ocean
again.

Blue Tree Resort: It’s done well for years

I have been a TimeShare Today subscriber for many years. During that time,
I have read many horror stories about
timeshares gone bad due to developer or
management companies problems.
Has anyone talked about those that
have done well for years?
Blue Tree Resort was converted
from an apartment complex to a timeshare property in 1989. My wife and I
purchased a two-bedroom deluxe unit
in 1994. Blue Tree was originally designated as a five-star resort by Interval
International. However, as the original
owner sold most of the units and as the
units aged, like so many other timeshare
properties, it started to become run down
and we lost our five-star rating.
However, to my relief, the Blue Tree
Owners Association took full charge and
after a search retained the services of
SPM Resorts Inc. to take over association
management in 2002. Since that time,
there has been a total transformation of
the property. All furnishings have been
replaced, appliances, kitchen cabinets and
counter tops, washer and dryers, televisions, beds--I mean everything. The great
thing is that there have been no special
assessments, I might add, and we have
built up a reserve of over $1,000,000. Our
maintenance fees have gone from $315 in
1994 to about $547 today
Again, I need to thank our board who
picked the right property management
company, and who was willing to commit
tens of thousands of dollars of our dues
to fight the takeover from Westgate when
they bought the remaining developer units
after the original owner filed for bankruptcy. After several years of litigation
with Westgate, we finally won. There are
394 individual units, of which Blue Tree
Owners Association owns 275, meaning
we own about 70% of the property. .
Westgate does have one member on our
board of directors. .
One of the problems we have, as with
all timeshares, is delinquency. Rather than
foreclosing on the owners not paying their
dues, our association has elected to work
with them and rent out the delinquent
weeks. In this way, the association is
recovering fees that would be lost, saving
on attorney fees to foreclose, which then
goes right to the bottom line.
I am writing this while I am at the
property and have just completed a visual
inspection. For a property over 20 years
old, the units look spectacular. Everything
has been freshly painted with almost all
units upgraded. In addition, they are
constantly looking for ways to improve.
They just updated two public laundry
facilities (only Deluxe units have washer
and dryers in them) where the washers
and dryers notify you by phone or email
when your clothes are done!
To those of you experiencing problems with your property management
company, I urge you to support your association’s board of directors. Secondly,
send in your proxies to your association so
that they may represent you, and so they
can conduct business. Lastly, be informed
and speak up if you think things are not
going right. Your timeshare can keep its
original luster when run correctly.

Canalboating in England: Out on the Canals

We have just spent another great
week at one of our timeshare properties, Schooner Landing, on the central
Oregon coast. While there I happened
to read the July/August 2012 edition of
your magazine and was most taken with
the article “Canaltime; Our Most Memorable Exchange.” We also had our most
memorable experience in September of
2004 on a canalboat.
Let me get back to the year 2000
when we were spending a week in London. On several occasions we took the
trains to see the stones at Avebury and
the potteries at Stoke-on-Trent. Riding
the train we could not help but see the
numbers of canals and the colorful boats
on them. After returning to the US we
began some research and learned what
we could about canalboating. We were
fascinated enough to plan our next trip to
the UK around 10 nights on the canals.
We chose to “hire” a boat from
Middlewich boats because their location
gave us a good look at central England
and a small part of Wales and because RCI
could not arrange a trade. It just happened
to be that this is one of the more popular
boating routes in the UK.
If there was a single downside to the
10 days it was that we chose a “traditional”
boat as it seemed quaint, rather than a
“modern” one. Think boating here in the
US today in a partially restored 1940 ‘s era
boat as opposed to a modern cruiser. The
older boat was a very small price to pay for
cruising the canals, meeting fellow travelers at every bridge and locks, lunch at one
pub, touring the small canal-side villages
and dinner at a different pub every night.
There were two couples of us, having traveled together for the past 30 years.
Just as in the above article, we also had
a two-bed, two-bath 56 foot boat. In the
total of about 120 miles that we traveled
from Middlewich to Llangollen, Wales
and return, we probably passed thru 40
locks, and raised 30 bridges. Both wives
are about 5 feet tall and could easily do the
locks and bridges without aid if need be.
As these boats were originally put
to use in the years before steam engines
they were pulled by horses and the original “tow paths” are well maintained and
make great hiking trails for both us boaters
and the locals alike. The boats have a top
speed of 3 miles per hour and with stops
for lunch, sightseeing, dinner, locks and
bridges, we averaged a whole 12 miles
per day! At almost any time, some of us
were walking the tow path while someone
brought the boat along.
Other than the camaraderie and getting to meet so many folks, the highlight
of the trip was the passage of the boat
over the Pontcysyllte Aquaduct. This is
a bridge to carry the canal over the River
Dee and it is about 125 feet high and about
1000 feet long, the highest and longest
of about 20 bridges that carried the canal
over roads, streams and the railroads. We
even went thru several tunnels, one about
1200 feet long!
Sorry to say, those that spent their
week tied up in a marina missed the main
part of the trip.

The Florida Timeshare Owners Group will meet on Sunday
afternoon, November 11th, 1:00p.m. to 5:00p.m., at the Palm
Aire Country Club, Sarasota, FL.
Representatives of various timeshare exchange companies
will attend, and present updates on their program benefits.
This will present our Members with an opportunity to learn
how to better arrange their exchange requests to their maximum
advantage.
Mr. Neil Kolton, Interval International’s Director of Sales
and Service, will attend this meeting for the purposes of an indepth discussion involving their new Points Program. A question
and answer session will follow.
In addition, Mr. Gary Prado, CMO, Redweek.com, will discuss his company’s new full-service resales and rentals program,
utilizing a telephone toll-free customer support center processing operation, which will be fully initiated in November, 2012.

Report from Cabo San Lucas

A four-week visit to Los Cabos,
Mexico (Cabo San Lucas specifically)
starting the end of January revealed several changes from our last visit of two
years ago. Most noticeable were the many
storefront vacancies in Cabo San Lucas as
well as nearly all of the second floor of the
Puerta Paraisa Mall on the northeast end
of the Cabo docks.
But first, it is worthy to explain the
experience you find at the airport once
you have cleared Mexican Customs. We
were greeted by the usual “helpful agents”
who had refined their approach and gave
the impression they wanted to help us get
to our final destination after asking where
we were staying. We were directed to a
nearby kiosk and introduced to a very
friendly man who seemed to ask the right
questions and provide the right answers.
However, I soon realized it was the same
old game of trying to get you signed up
for a visit to another area timeshare with
the bait of providing 2500 pesos (about
$270.00) for the one and half hour visit.
At first I thought we might do it, until he
said we would need to pay $100.00 that
would be refunded after the visit was
completed. At that point, I said no thanks,
and we walked on outside where we found
our pre-arranged van waiting.
Our experience on arrival at the Playa
Grande Resort counter when we checked
in from our last September arranged fourweek reservation was quite upsetting, as
we were told we had a reservation for one
night. Of course, the language barrier is
most always a challenge, and it took some
time before the trainee who started with
us brought forward a regular employee
who explained it was for one night only
because of their space limitations and
we would be moved the following day
to another unit, not the one we “own”.
At this point I said to myself. “welcome
to Mexico and their management style.”
Two days later, I arranged for a meeting with the salesman who had “sold”
us our unit to try to determine why we
experienced the arrival difficulty and also
to determine what we could expect for the
remainder of our stay. Whether he was
able to get everything properly arranged
or not I cannot be sure, but three days
later, we were advised that our original
unit would be ready after lunch, so the
third and final move was made.
As far as Playa Grande is concerned,
we didn’t observe much in the way of
change. They still push for a sit down
with one of their sales reps to have either a
breakfast or lunch to discuss their present
programs, answer any questions and then
tour their newest complex, the “Grand
Solmar” as it is now being promoted.
The old Solmar is gradually being torn
down and replaced with three multi story
complexes, new pools and a new high end
restaurant.
By completing the tour, you are then
given a coupon that offers a relatively
small discount for several activities and
if you wish, a $50.00 coupon that applies
to one of their restaurants. At the wrap up

of the Grand Solmar tour, we were then
solicited to consider trading in our Playa
Grande unit for a new Grand Solmar, one
of similar size and once all discounts (?)
were given, the cost for the new contract
would be for 40 years and cost approximately $26,000.00. With our advanced
ages, we had no interest in such a plan.
Playa Grande still has most of the
usual special night food, drink and entertainment packages that include Mexican
Fiesta Night, Beach Party Night, Asian
Night and Grill Night. Costs vary but
range from $32.00 per person to $39.00
for all you can eat or drink. Prices in their
restaurants are what one probably would
consider as being modest; however, everyone has their own standard as to how
reasonable menu prices might be.
As far as Cabo is concerned, it continues to be a desirable place to visit with
its many shops and restaurants. Never
at any time did we feel insecure as we
walked day or early evening in all of the
major areas, main street, side streets or
the marina. The police are present most
of the time with several in any given area.
Taxis are always available and cost 70 to

10 pesos for most of the local ordinary
trips. Or one can try the bicycle-taxis that
are easily found in the core area and, of
course, there are always the public buses
that run on a very constant schedule; be
sure you check the windshield to know the
locations that each is going to.
Now finally, if staying long enough
to need groceries if you plan to do some
cooking or food preparation in your unit,
the grocery store in the Super Plaza that
has been the mainstay for many years remains, though it is evident the large super
stores such as Wal-Mart and Cosco are
taking their toll. The Super Plaza store has
a reduced offering, though it basically still
has what one might need. The next door
pharmacy showed a decided reduction in
its offerings.
Any comments on Cabo would not be
complete without mentioning about whale
watching, fishing and cruise ship visits.
The whales were very much present as in
past years and from comments we heard,
the fishing wasn’t quite as good this past
few weeks as in the past times. The cruise
ships are continuing to make Cabo a port
stop even though they now are avoiding

some of the other Mexican stops due to
the increased crime level. Some days we
observed two ships in port, though most
of the time we only saw one.
There is construction taking place
in Cabo on the docks toward the Medina
area that is huge. We were told it is a Le
Meridian property. Also, keep in mind
that in June the G20 International Nations conference will take place in a new
convention center now under construction
near San Jose, so the whole area will buzz
with the increased activity of thousands of
visitors from all over the world.
