ROLLING OAKS ESTATES NEWSLETTER 2015
Architectural Control Committee (ROACC)
Rolling Oaks Estates has grown considerably in the past
twenty five years. The ROACC is a volunteer group of
property owners who coordinate community activities,
review construction requests, and respond to alleged
violations of the deed restrictions. The ROACC issues this
annual newsletter, meets bi-monthly and performs various
functions, including: funding and overseeing the maintenance
and lighting of the entry area; coordinating county mowing
activities; requesting and monitoring county repair and
replacement of road surfaces, traffic directional signs, speed
limit/stop signs; and hosting the annual Christmas Parade and
Neighborhood Night Out events.

Deed Restriction Renewal
If any property owner is interested in serving on The Rolling
Oaks Estates Architectural Control Committee or being put on
the list for the spring and fall cleanups, call 867-8323.
We’re circulating ballots for renewal of the Unit 1 thru 5 Deed
Restrictions currently effective through 2020. This applies to
all properties except Unit 6 (N. Rolling View, S. Rolling View
and their side streets). These Deed Restrictions define the
minimum standards and prohibited activities established to
protect the value of our properties and community. While
future potential City Ordinances will supplement these
restrictions, they remain a critical tool to ensure that Rolling
Oaks maintains its acreage residential character and property
value. No new or altered restrictions are created by this
renewal, simply an additional 10 year extension. Please mail,
scan and email or call 867-8323 for pick up an attached
completed ballot if you have not already done so.

annual activities, and fulfill the Covenant duties including
occasional legal assistance. We ask each property owner to
donate fifty dollars ($50.00) annually. This is our only source

The purpose of the Covenants and Deed Restrictions is to
protect the value and character of each property in Rolling
Oaks Estates. These covenants provide specific conditions,
restrictions, and reservations that apply to every lot, and
every property owner is legally bound by these covenants.
The ROACC does not actively search out violations nor does it
inspect estate lots looking for covenant compliance problems.
Rather, the committee responds to any and all inquiries and
complaints received from property owners. Wherever
possible, the ROACC endeavors to resolve covenant problems
at the lowest level and with the minimum cost to all
concerned. Such problems can usually be resolved through
discussion with the subject property owner. However, the
ROACC has pursued more aggressive enforcement actions
when needed. Occasionally we must seek legal assistance
because of the nature of a specific violation or problem. Our
goal always remains to protect the value of all properties
within the subdivision.
Rolling Oaks has a web site!
We have a website http://www.roaccsa.com. The site
includes a discussion forum, Construction Approval Request
form, a ‘Contact Us’ link, and helpful community information.
We do not use this site for advertising or commercial
contractor endorsements.
City of San Antonio Annexation
Rolling Oaks Estates is now included in the City of San
Antonio’s 2016 planned annexation area. We should be
zoned Residential Estates (RE), protecting our single-family
acreage neighborhood character. We will continue to use our
wells and septic systems, and receive other basic services
(police, fire, roadway maintenance, etc.) once annexed. The
ROACC will monitor this process closely to ensure that the

Oak Wilt
The Covenants and Deed Restrictions present typical and
reasonable requirements and restrictions for Rolling Oaks. A
few of the most relevant include: 1) All properties are for
residential purposes. No commercial businesses are allowed;
2) No sign or advertising display is allowed unless it is for the
sale of the property; 3) All fence construction which fronts or
borders county roads must be approved by the ROACC
(Rolling Oaks Estates streets are county roads;) 4) All homes
are for single family use and must be approved by the ROACC
before construction; 5) All new home construction must be
completed within six months after the laying of the
foundation; 6) Trash, garbage and other waste will be kept in
sanitary containers. (Use a garbage can when you put out
garbage for pickup.); 7) Abandoned and junk vehicles may not
be stored on lots. The complete Deed Restrictions can be
downloaded from the website.
Be aware there is actually an intruder that wants to steal
some of your most valuable property - your oak trees! This
intruder is a beetle. These beetles spread the lethal oak wilt
disease from a diseased tree to a fresh cut on another tree.
Oak wilt also spreads from tree to tree through
interconnected root systems. Once the disease takes hold,
you might as well consider that tree (and any trees that share
a root system with the infected tree) as dead. And remember
that your neighbors' trees may share that root system! This
intruder beetle can be stopped in its trucks by simply
covering all wounds on oaks with pruning paint. Remember,
there is no 100% safe time of year when oak tree cuts don't
need to be painted immediately.
Taking Care of Rolling Oaks
Rolling Oaks Estates has grown considerably in the past
twenty five years. From approximately fifty homes in 1988 to
over 300 homes today with several more now under
construction. Most property owners are committed to
maintaining their property to the standards reflected in the
Covenants and Deed Restrictions, and these covenants reflect
common sense rules of country living and courtesy to our
neighbors. We all want to avoid problems like junk cars,
poorly maintained fences, trash, loose pets and unapproved
outbuildings that detract from the neighborhood. The ROACC
will respond to these problems when reported, and our
intent is not to harass property owners but rather to
consistently and fairly maintain Rolling Oaks Estates' high
standards and to protect your property values.
Fire Safety
Fire is the biggest danger to our homes. Please use common
sense, remember burn-ban rules and atmospheric conditions
and do not burn without the Bexar County Fire Marshall's
prior approval. Call 335-0300 (between 9 AM and 5 PM) for
permission to burn. Your burn site must be a minimum of 300
ft. from your neighbor's house or WRITTEN permission from
your neighbor is required.
Protect Our Children-Slow Down!
Watch for children and people walking and observe the
posted speed limits and stop signs throughout the
subdivision. Saving a few minutes of drive time is not worth a
child's life. Children should not be allowed to drive ATVs on
public streets, (it is illegal), or on other peoples' property.
Pets
We occasionally receive complaints about loose dogs in the
neighborhood. It is each owner's responsibility to keep their
pets under control, contained on their property and properly
vaccinated, with rubies tags displayed. Don't allow them to
roam the County roads or on another person's property.
Bexar County Animal Control, 210-737-1442, will pick up stray
dogs that have been captured and contained by a property
owner. Bexar County ordinance prohibits loose pets.
Fences
Fences along the front of our lots are the first things you see
when you drive down the subdivision roads. Broken down
fences and fences in need of replacement and repair are
violations of deed restrictions, detract from the subdivision
and lower property values. The Deed Restrictions state "All
fences along a property line which front or border a county
road must be approved by the ROACC before construction. All
fences will be well maintained and not allowed to detract
from the property."
Bexar County Alarm Registration, False Alarm Fee
Ordinance
This permitting and fine system went into effect on Jan. 1,
2005. Monitored alarm system owners in unincorporated
areas of Bexar County are required to obtain a permit for
their alarm systems. The ordinance requires permits for
monitored residential systems at a cost of $25. Renewals are
$15 for residential alarms. Non-registered alarms can be fined
$75 according to the Bexar County Sheriff's Office, and a fine
system has been implemented for false alarms. The alarm

Rolling Oaks Estates Units 1–5 Covenants and Deed Restrictions require recurring 10 year term renewals, currently in
effect through 2020. Please complete and return this ballot to support that renewal. Completed ballots may be mailed to

complete your Unit and Lot number if desired. Please complete at least your street address, signature and date.

WHEREAS, the COVENANTS, CONDITIONS, EASEMENTS AND RESTRICTIONS OF ROLLING OAKS ESTATES SUBDIVISION,
UNITS 1-5 were established for the purpose of protecting the value and desirability of the homeowners and subdivision,
and which run with the real property and are binding upon all parties having right, title or interest in or to the above
described property, or any part thereof, and their heirs, successors and assigns.
WHEREAS, said COVENANTS, CONDITIONS, EASEMENTS AND RESTRICTIONS OF ROLLING OAKS ESTATES SUBDIVISION,
UNITS 1-5 were extended through June 1, 2020 by a Declaration of Extension recorded with the Bexar County Real
Property Records (Vol 6387, Pg 1978-1983).
WHERAS, said COVENANTS, CONDITIONS, EASEMENTS AND RESTRICTIONS OF ROLLING OAKS ESTATES SUBDIVISION,
UNITS 1-5 were established to be thereafter renewed by a majority confirmation vote of the Property Owners of Rolling
Oaks Estates Subdivision.
NOW, THEREFORE, it is my desire and election as a Property Owner of Rolling Oaks Estates Subdivision that the
COVENANTS, CONDITIONS, EASEMENTS AND RESTRICTIONS OF ROLLING OAKS ESTATES SUBDIVISION, UNITS 1-5 be
extended for an additional ten (10) years thereafter, to be effective through June 1, 2030.
