The August 2011 Board of Directors & AHPA Charities Meeting was
called to order at 0900 hours by President Jimmy Chavez at the
Phoenix Mountain Preserve & Conference Center located at 1431
East Dunlap, Phoenix, Arizona. President Chavez began the
meeting with the Pledge of Allegiance.

DEATHS - FAMILY:
Mrs. Melva R. Walker, Mother-in-Law of Nate Moore, Badge #4985,
passed away on August 8th.
Mr. Dana Yount, brother of Emily Ryan, Badge #2634, passed away
on July 19th.
Mr. Paul Leroy Nelson, father of Ken Nelson, Badge #2078, and
grandfather of Doug Jennings, Badge #6090, passed away on July
20th.
Retiree Bob Stocksdale, his wife Roberta, grandson Zak were
killed in a motorcycle collision.

DEATHS - LINE OF DUTY:
This year one hundred fifteen Police Officers have died in the
line of duty. This is ten more than this time last year. Fourteen
have died since the last meeting:
Five were killed by gunfire.
Five were killed in automobile collisions.
Two were killed in drownings.
One succumbed to a duty related illness.
One was killed by vehicular assault.
Seven were from Municipal Agencies.
Four were from County Agencies.
Three were from State Agencies (Louisiana Dept. of Public Safety
Police, North Carolina Dept. of Corrections, & Missouri State
Highway Patrol).
Thirteen were male.
One was female.

A MOMENT OF SILENCE WAS HELD.
CONSENT AGENDA:
Correction to last month minutes:
Debbie U. Luevano, Badge #4147, was listed as a rejoined member
which was incorrect.

3. Approval to destroy July 2011 meeting audio tape.
Motion made by Dave Schroder, seconded by David Stopke, to accept
the consent agenda. Motion carried.
EXECUTIVE BOARD REPORT: President Jimmy Chavez
 Attended emergency meeting with Arizona Police Association
discussion on litigation vs. legislative action on
personnel reforms.
 Failed litigation could result in the plaintiffs’ being
responsible for the States legal fees.
 Support from the Legislative leadership is changing on
possible changes to the reforms.
 Looking at all Pros and Cons on any and all litigations.
 Biggest issue is the legislation for PSPRS employees:
o A.R.S. 38-844.01 Vested Rights to benefits
A member of the system does not have vested rights to benefits
under the system, except as provided in section 38-854, until
he/she files an application for benefits and is found eligible
for those benefits as provided in this article. An eligible
claimant’s rights to benefits vest on the date of his/her
application for those benefits or his/her last day of employment
under the system, whichever occurs first.

Three issues the Association would like to have fixed:
o De escalator clause back into legislation. This would
allow our employee contributions to decline once the
fund is healthy again.
o Fix the new overtime/sick leave bill adding civilians.
o The new DROP system needs to be fixed for those who
enter after January 1, 2012. Employees will be making
contributions into a system that they will not get
back.

This will be a negative hiring incentive issue
for new employees.
President Chavez was meeting with Senate President Russell
Pearce tonight on issues.
Meeting with House President Andy Tobin has been on hold
due to his being out-of-town.

LEGAL REPORT: Greg Robinson
 New Shoulder patch
o Contacted Trademark office for copyright protection.
o $425.00 for application, government mandated fee is
incorporated.
o Copyright would allow the Association to use shoulder
patch without Department’s permission for promotions.
Motion made by Jim Stanton to copyright new shoulder patch.
Seconded by Brian Kolb. Motion carried.
Motion was amended to copyright the patch with the approval from
the Executive Staff. Amended motion was voted and passed.
EXECUTIVE STAFF: Lt. Col. Jack Hegarty
 Department had a meeting with ADOT on two issues:
o Construction work zones:
 Starting October 1, 2011, all new work zones on
State highway will have DPS Officers working.
 If jobs can not be filled by DPS Officers, other
agencies will be asked to fill positions.
 These will be off duty broker projects, where
Officers will be paid by the broker.
 Officers will not be covered by Workman’s Comp.
 Old work zones will still have outside agencies
until work is completed.
 Department will be trying to work with ADOT in
getting Officers covered the same as wide loads.
 Hope to have these issues completed by October
1st.
o ADOT Compliance Units:
 Sworn officers were hired to fill attrition on
their specialty positions.
 Hope to have several Port of Entries open 24/7.
 Enforcement will be centered on permits, weight
violations, and fees.
 Uniforms
o Transition date is October 1, 2011. Wearing of new
uniforms with new shoulder patches is not authorized
until that date. New uniforms with old patches are
OK.
o Sleeve hash marks are authorized for new uniforms.

Lt. Col. would like to go to black and silver
lettering for baseball hats.
Old jackets are OK with new shoulder patch.
Uniform committee looking at changing the Class C
uniforms to black polo shirts and black cargo pants.
Load carrying vests would be used.
MFF went to green uniforms, with arrest teams and
other support teams being in black.
Taser X-3
o District 9 and other squads will wear test the new
tasers from Sept 1 to November 1. Survey will be done
and sent to training.
o Training will look at survey results and make decision
for entire state.
o X-3 have already been purchased from funds from last
year.
 Hiring
o Internal agency budget decision.
 Director would like to bring our employees up
to market value first.
 Executive Staff will be working with
Legislators on upcoming session on this issue.
 TRACS 10
o Yesterday marking the end of the settlement period
regarding the 5-year contact data.
o Department received an award for criminal
interdiction.
o Problems with the old TRACS 7.3 system still need to
be fixed.
Discussion was held on MDC’s,CAD program, and other electronic
equipment.
FINANCIAL REPORT: Jeff Munister
 Market has been going up and down due to other countries’
markets.
 Short term rates will not be changed by the Feds for 2 year
period.
 Corporation earnings are up.
PUBLIC RELEATIONS REPORT: Stacey Dillion
 Would like to see the Association go ahead with copyright
of patch.
 Hacking
o no information on our members were leaked from her
files.
o Public perception is that the hackers were caught and
it is over.

Several groups are still out there trying to obtain
information.
o Redact your information if you have not done so.
Law Enforcement deaths are up 20% across the nation. Clint
Eastwood is the new spokesman for the national Law
Enforcement Monument.
Pension issues, public will see it as being greedy.
Feds just moved all employees into 401K system. If they
can why can the state not do it?
Regarding the Russell Pearce recall, stay out of this
issue.
Regarding the 962a this morning, received several hits on
the move-over-law.
Will be working on civilian personnel reforms this year at
for the legislative session.
PSAs will highlight the role of our civilians and the
effect on the agency as a whole. Will be sent to
legislators.
Have starting working on a KID HERO award for the public
who contacted a dispatcher when they reported a critical
incident.
AHPA Twitter account received an email from Lenoran
Nicolays on how DPS Major Larry Scarber saved her life 24
years ago in a traffic collision in Provo Utah, and was
looking at reconnecting with him.
Comfort Bear Program
o Ford dealerships will not be able to be the drop off
points this year.
o Two new businesses have stepped up for this:
 U-Swirl Yogurt located in Mesa, Deer Valley, and
Scottsdale.
 Venetia Pizza located in Mesa, Gilbert, and Tempe.
LEGAL SERVICES REPORT: Dale Norris
 Have been in contact with the attorneys concerning the
lawsuit to Senate Bill 1609. Waiting for court ruling
before any other action being taken.
 Several groups of employees concerning PSPRS issues:
o Employees hired or retired before 1983
o Employees hired after 1983
o Employees hired after April 2011
 PSPRS has a vesting law A.R.S. §38-844.01 that
states that the State can change your benefits
until the time you retire or file an
application for retirement and is accepted.
This could be a challenge for sworn employees.
 Looking for second opinion from Constutional attorney
on this issue.

REPRESENTATIVE REPORTS:
District Four – Eddie Simpson
 Wellton Highway Patrol office will be closing next
week.
 Monument for Officer Crowe located in front of the old
Task force building will be moved due to the building
being sold.
 Request was made if the Association would support
members working off duty regardless of rank.
(Association has not opposed it in the past).
Monument for Officer Juan Cruz will have to be moved due to
construction on Interstate 10. Some family members have asked
that it be moved permanently to the Tucson office, others have
asked that once the construction is completed, the monument be
moved back if possible.
OLD BUSINESS:
 Insurance Carve-out
o Waiting for ADOA to provide information for actuary
study.
o ADOA states there are HIPPA concerns/issues. They can
only release stat’s nothing name related.
o We could use information obtained through Pacific
Design.
 Discussion was held on personnel system reforms.
Association will request information from HR regarding the
differences between the hiring process of our civilians and
other state agencies.
o Would show the difference in the type of information our
civilian employees handle vs. other state agencies.
NEW BUSINESS:
 Association was asked if we would invest in new mattresses
for the cabin.
 ACE Uniforms providing 20% off DPS uniforms,15% off Bianchi
and Safariland until September 30.

 Civilian Employee Issues
o Discussion was held to add a Civilian Vice President
position to the AHPA Executive Board.
 AHPA By-Laws Article 3 Section 4 would have to be
changed to allow this position.
 Motion was made by Raul Garcia Jr, to amend the
by-laws allowing this position. Motion was
seconded by David Stopke. EBlast containing this
motion will be sent out 10 days prior to next
months meeting which would allow the AHPA Board
of Directors to vote.

If the motion passes then the Board of Directors
would ask for nominations to fill the position.
Civilian reps will be meeting with Association lobbyist to
discuss civilian issues for next session.
Mike Sloneker briefed the Board on the Employee Morale
Survey committee.
They have met two times with five more
meetings set.
They will present their recommendations to
the department.
PSAs were suggested for unsafe driving issues.
Both
civilian and sworn employees would be used on the PSAs.
California Casualty is looking at the way our membership
receives their mail from them.
They would like to use an
outside source they use instead of sending their mailings
to Colleen who then mails it to our membership. President
Chavez requested more information on their outside source
before changing the system.
Treasurer Dave Schroder, in compliance with our member loan
policy, advised the Board that Ofelia Flores is overdue on
her loan payments for the fifth time since 2007.

Next meeting will be held on September 21, 2011, at the Phoenix Mountain
Preserve & Conference Center located at 1431 East Dunlap, Phoenix,
Arizona. Meeting will start at 0900 hours.
