SCHEDULE 01
In Span Handover Link
1.
Definitions
1.1
In this Schedule, a reference to a paragraph, unless stated otherwise, is to a paragraph
of this Schedule. Words and expressions have the meaning given in Annex D.
2.
Description of Service
2.1
BT shall provide each Point of Handover on a public highway or, unless otherwise
agreed, on a prospectively maintainable public highway, with BT’s portion of the Line
System being provided by BT on its side of the Point of Handover. The Operator shall
provide its portion of the Line System on its side of the Point of Handover.
2.2
The Point of Handover shall be outside a Cable Station or outside an ITC, as specified
by the Operator in its order for an ISH Link.
2.3
The Point of Handover is the point where the Operator’s duct is joined to the wall of
the BT jointing chamber.
2.4
The Point of Handover shall not be located at such distance from the relevant BT
building such that signal regeneration is required to be carried out by BT.
2.5
The Point of Handover shall be established by the Operator installing its cable to the
BT jointing chamber at, subject to paragraph 2.6, a precise physical location agreed
between the Parties where it shall be:-
2.5.1
jointed to the BT cable in the jointing chamber; or
2.5.2
handed over to BT to be drawn by BT into:
(a)
a BT building; or
(b)
another jointing chamber
if the Operator’s cable meets the Cable Specification.
2.6
If the Parties locate the jointing chamber at a distance which is greater than 100 metres
from the curtilage of the BT building, the Operator shall pay duct charges in
accordance with BT’s Retail Price List.
2.7

2.7.1
the jointing chamber shall be provided, owned and maintained by BT at its own
expense; and
2.7.2
BT shall provide, own, maintain and be responsible for all ducting, plant and
equipment and will bear its own costs for the ducting, cabling, and maintenance
of the Line System on its side of the Point of Handover and the Operator shall
do likewise in relation to the Line System on its side of the Point of Handover;
and
2.7.3
if continuous cable is used, the Operator agrees that ownership of that part of the
cable on the BT side of the Point of Handover passes to BT.
2.8
Diagrams A and B are diagrammatic representations of the In Span Handover
arrangements and are included in this schedule for illustration purposes only.
3.
Path Protection
3.1
The Operator may request, whereupon BT shall provide, Path Protection between the
Cable Station and the Point of Handover or between the ITC and the Point of
Handover, as the case may be, using:
(a)
a single BT jointing chamber with a single cable and two separate pairs of fibre
in that cable; or
(b)
a single BT jointing chamber with two separate cables; or
(c)
two separate BT jointing chambers with two separate cables into those BT
jointing chambers;
and a suitable transmission switching mechanism without a change to the cable or
cables.
3.2
If the Operator requests Path Protection as referred to in paragraph 3.1 using two
jointing chambers, BT shall endeavour to use a suitable existing jointing chamber (the
“protection jointing chamber”).
3.3
At the Operator’s request, BT shall provide a written quotation for the installation by
BT of a protection jointing chamber if a suitable existing protection jointing chamber
cannot be identified or used.
3.4
If the quotation referred to in paragraph 3.3 is accepted, BT shall install the protection
jointing chamber for the second cable.
3.5
For the avoidance of doubt, the protection jointing chamber shall be installed, owned
and maintained by BT.

4.
Charging
4.1
For services under this Schedule, the Operator shall pay to BT the appropriate charges
for multiplexor, Line System and Path Protection (if applicable) specified from time to
time in the Carrier Price List.
4.2
The connection and rental charges shall be payable by the Due Date. Rental charges
shall be payable quarterly in advance.
4.3
BT shall be entitled to charge for any Point of Handover independently of whether the
charge for any Cross Connection ordered under Schedule 02 shall have become due
and payable unless the scheduled Ready for Test Date for both services is the same
and there is delay in the provision of the Cross Connection due to no fault of the
Operator.
4.4
In addition to the charges specified from time to time in the Carrier Price List, each
Party shall, if applicable, make the additional payments specified in Appendix B of
Annex A.
4.5
Path Protection charges shall be the sum of the relevant charges specified in the
Carrier Price List. Each cable splice required for the provision of Path Protection has
a separate charge. Connection and rental charges shall be payable for each ISH Link
used for Path Protection. Rental shall be payable for a minimum of 12 months.
Subject to payment being made for the then current minimum period of 12 months,
rental charges shall be payable until the Operator requests BT in writing to cease that
Path Protection.
5.
Term
5.1
The minimum period of service for any ISH Link shall be 12 months commencing on
the Ready for Service Date.
5.2
Any ISH Link Augmentation shall be subject to its own minimum period of service of
12 months commencing on the Ready for Service Date.
5.3
The Operator may terminate, within 6 weeks of notification of an increase in BT’s
charges, any ISH Link by 3 months’ notice in writing provided such an increase in
BT’s charges is greater than RPI.
5.4
The Operator may terminate any ISH Link by 3 months’ notice in writing expiring on
or after the end of the minimum period of service applicable to such ISH Link.
5.5
If the Operator terminates any ISH Link because of any increase greater than RPI in
the charge payable for service, no increase in such charge shall become effective
during any period of notice properly given under paragraph 4.4.

5.6 BT may terminate any ISH Link by 3 months’ notice in writing expiring on the scheduled
expiry of the life of the Cable System as notified by the person who owns or controls the
submarine cable capacity in the Cable System.
