BE IT RESOLVED, by the Lorain County Board of Commissioners that we hereby authorize Purchase of Service agreements between
Lorain County Department of Job and Family Services and various transportation companies to provide non-emergency medical transportation
services for state fiscal year 2014.
Said agreements are considered a part hereof to this resolution and by reference thereto and can be found on file in the
Commissioners/Purchasing Department and Lorain County Department of Job and Family Services. These agreements are effective from July 1,
2013 through June 30, 2014.
1)
Provide A Ride, Cleveland, Ohio in an amount not to exceed $400,000.00.
2)
LifeCare Wheelchair Services, Elyria, Ohio in an amount not to exceed $650,000.00.
FURTHER BE IT RESOLVED, we hereby authorize the Director of Lorain County Department of Job and Family Services to execute
this agreement and amend this agreement for changes in the programming content and to increase the value of this agreement on behalf of the
Lorain County Commissioners.
BE IT FURTHER RESOLVED, we hereby authorize said payments for services to be made within the amount set above for contracts
and/or subcontracts.

In the matter of approving the contract agreement between )
the Board of Commissioners and Trinity Services Division )
(“Trinity”) to provide food service for the Lorain County )
Detention Homes and Residential Complex
)
June 5, 2013
BE IT RESOLVED, by the Lorain County Board of Commissioners that that we hereby approve and enter into a one year renewal
agreement between the Board of Commissioners and Trinity Services Division (“Trinity”) to provide food service for the Detention Home and
Residential Complex.
FURTHER BE IT RESOLVED, this is a renewal agreement is for one (1) year effective July 1, 2013 and contains a ninety (90) day
written cancellation clause. The price per meal is set on the number of meals served as specified on the sliding scale attached. The price of the
resident meals has been increased 2.7% based upon an inflationary food price index & increased whole wheat, fruit and vegetable requirements
set by the state. The Food Service Contract for the Lorain County Detention Homes (Boys & Girls) and Residential Facilities shall be paid from
the contract service line item. This Agreement shall be effective July 1, 2013, and shall continue through June 30, 2014.

In the matter of approving and entering into an LPA )
Agreement with the Ohio Department of Transportation)
for the Jones Road Bridge Replacement Project
)
June 5, 2013
WHEREAS, Ken Carney, Lorain County Engineer by letter dated May 28, 2013 submitted the following:
“In December of 2011, the Lorain County Commissioners adopted Resolution No. 11-830 which authorized the County Engineer to
submit an application to the North East Ohio Areawide Coordinating Agency (NOACA) for the Jones Road Bridge Replacement. The purpose
of this application was to request NOACA Governing Board Approval so that federal LBR funds approved by the County Engineer’s
Association of Ohio could be utilized to fund the construction. This request was approved by the NOACA Governing Board in June of 2012 and
the County Engineer’s office is currently in the process of beginning to prepare detailed engineering and environmental studies.
At this time, the County Engineer’s Office is requesting approval to enter into an LPA Federal Local-Let Project Agreement with the
Ohio Department of Transportation to administer the design, qualification of bidders, competitive bid letting, construction and inspection of this
project. This agreement sets forth the requirements associated with the Federal funds available for the project and establishes the responsibilities
for the local administration of the project.
Please take the necessary action to authorize the County Engineer to execute the LPA Federal Local-Let Agreement with the Ohio
Department of Transportation. If you should have any questions, please feel free to contact this office.”;
NOW, THEREFORE, BE IT RESOLVED by the Lorain County Board of Commissioners based upon the letter dated May 28, 2013
from Ken Carney, Lorain County Engineer we hereby approve and enter into an LPA Agreement between the Lorain County Engineer and the
Ohio Department of Transportation to administer the design, qualification of bidders, competitive bid letting, construction and inspection of the
project. The agreement sets forth the requirements associated with the federal funds available for the project and establishes the responsibilities
for the local administration of the project.
BE IT FURTHER RESOLVED, this project is being paid for by federal funding assistance from the Northeast Ohio Areawide
Coordinating Agency (NOACA). The Agreement with ODOT is hereby considered a part hereof to this resolution by reference thereto can be
found on file with ODOT and Lorain County Commissioners Offices. The County Engineer is hereby authorize to execute documents on behalf
of the Board.

WHEREAS, Ken Carney, Lorain County Engineer by letter dated May 28, 2013 submitted the following:
“In March of 2013, Burgess & Niple was selected by the Lorain County Engineers’ Office to provide final environmental studies,
detailed design services and right-of-way plans for the Jones Road Bridge Replacement in Penfield Township. The selection was based on
Letters of Interest received from nine firms that responded to the LPA Posting on the Ohio Department of Transportation Website.
Burgess & Niple will provide the above listed services for the lump sum fee of $215,200.

NOTICE TO CONTRACTORS
Sealed bids will be accepted until 2:00 P.M. on June 25, 2013 in the office of the Lorain County Commissioners, Purchasing
Department, 4th Floor, 226 Middle Avenue, Elyria, Ohio 44035 for providing of all labor, material, and equipment for construction of the
Cowley Road Resurfacing Project Re-bid, using various materials, in accordance with the specifications now on file in the office of the Lorain
County Engineer, 247 Hadaway Street, Elyria, Ohio 44035. All material and equipment must meet the specifications of the Ohio Department of
Transportation, and shall include all signs, lights, watchmen, barricades, etc., and work performed shall be under the supervision of the Lorain
County Engineer.
The project consists of asphalt resurfacing of a 2.67 mile section of Cowley Road from State Route 82 to Crocker Road. The work
includes pavement and shoulder widening, repairs, resurfacing, repair of drainage structures and pavement markings.
Bidders must be listed on the ODOT pre-qualified list for highway construction. Bidders shall submit a list of available equipment, and
labor shall be paid not less than the prevailing wage rate as determined by the U.S. Department of Labor for Lorain County.
Specifications can be obtained at the office of the Lorain County Engineer, 247 Hadaway Street, Elyria, Ohio 44035 between the hours
of 8:00 A.M. and 4:00 P.M., Monday thru Friday. Each bidder is required to furnish with its proposal, a Bid Guaranty and Contract Bond in
accordance with Section 153.54 of the Ohio Revised Code. Bid security furnished in Bond form, shall be issued by a Surety Company or
Corporation licensed in the State of Ohio to provide said Surety. Should any bid be rejected, such instrument will be forthwith returned upon
the execution of a contract.
Each bid shall contain the full name or names of persons and company submitting the bid, and shall be enclosed in a sealed envelope and
marked “Cowley Road”. A non-refundable deposit of $75.00 is required for each set of bidding documents.
The Board of County Commissioners reserves the right to reject any and all bids, and to waive any informalities, if it is in the best
interest of Lorain County to do so. Any exceptions to the specifications shall be made in writing to the Office of the Lorain County

DOMESTIC RELATIONS HEARING ROOMS
June 5, 2013
Jody Barilla, Court Administrator stated Domestic Relations is in needed of additional hearing rooms on the 2nd floor of Justice Center.
There are 10 hearing rooms with 11 magistrates, plus another magistrate for detention home which creates a difficultly in scheduling and hearing
matters in the time constraints dictated by Ohio Supreme Court. She indicated that Common Pleas is seeking to relocate foreclosure magistrate
and administration assistant to make room for court administration and discussing whether both of their needs can be met by additional built out
on 2nd floor. There could be 14 magistrates with only 10 rooms. She has asked to seek bids to determine cost to build out space available.
Commissioner Kalo asked why there were so many magistrates. Ms. Barilla indicated that the new judges are using the magistrates in
different capacities, each judge has 3 magistrates and 3 court magistrates, 1 dh magistrate and 2 csea magistrates and they all have full time
dockets.
Commissioner Kalo asked about Common Pleas cooperative, Ms. Barilla said the build out would include 3 rooms for them and could
have possible funds.
Commissioner Williams said rather than building out why not use the old courthouse there is space there since the people want to move
from gas building and just consolidate. Ms. Barilla said could review but this could cost more because staff would have to be relocated.
County Administrator Cordes said Karen Davis, Special Projects Manager is reviewing and said old courthouse is good idea but not
might be feasible with the technology because the county’s technology does need to be updated and voicemail will be cut off in 2014. He stated
he will get some quotes and get in contact with the courts.

VETERANS SERVICE COMMISSION BUDGET
Terry Stone, Executive Director, Lorain County Veterans Service Commission submitted a budget in amount of $1,851,565 for 2014
Commissioner Kalo reviewed budget and questioned the following:
1)
Furniture and Fixtures line item was increased, should be deleted. Mr. Stone stated in order to purchase new office furniture in
case of relocation. County Administrator Cordes said the furniture the office has now belongs to the county and this could be
used and some probably would be needed
2)
Contract Services line item was increased. Mr. Stone said due to demand in providing transportation for medical appointments
and hopes to have enough to cover this year
3)
Professional Services was increased for preparation and workings of the Veterans Court and stated this would be taken care of
by county and probate, so delete
4)
Relief Allowance was increased. Mr. Stone said yes due to troops coming home and also looking at to offer dental services
which is not provided by VA
5)
Conference Expense added for outreach programs. Mr. Stone said this is for session to inform the veterans on services offered to
include renting hall, providing snacks, etc.
6)
Building Lease/Office Leasing added. Mr. Stone said in case there is a relocation. Commissioner Kalo said there is a global
account for rent and should be deleted
Commissioner Williams said delete furniture and fixture because if there is a relocation they can come back at that time
Commissioner Williams said contract services needs to be decreased. Mr. Stone indicated that are going to do an aggressive
campaign to get the word out on services, Commissioner Williams said then more money should be in printing/advertising and indicated
the track form has been changed in order to see where the inquires come from and what areas need to be targeted.
Commissioner Kokoski said what about advertising through the posts. Mr. Stone said they have been going to Rotary’s and
Nursing Homes.
Commissioner Williams said the increase for board members should be deleted, no one else on a board receives compensation.
Commissioner Kokoski said it seems under Mr. Stone’s leadership that more veterans are being served rather than the funds
going to administration . Commissioner Williams said when Mr. Bates was there he saw him do a lot of outreach work
Robert Mackin, President, Veterans Service Commissioner said he is concerned that there would be enough money in the relief account
due to the war ending and the more outreach they are doing which included Lions Club not Rotary. On June 19 will be at Senior Center,
Lorain
Commissioner Williams said the Veterans Services is allowed up to ½ inside millage for veterans but have to show cause.
Veterans Services Commissioner and Mr. Stone agreed that some items can be deleted and if money is needed they can come
back as discussed above but relief needs to stay.

Tracey Slagle, 911 Director said this is another collaboration with the Sheriff, like dispatching. The warrant unit will be housed at 911
and will give immediate access to the dispatcher and deputy and should be all in place on June 18. She thanked the Commissioners,
Administrator Cordes, Sheriff Stammitti, Chief Executive Cavanaugh, Captain Hammond, Karen Davis, Sgt Canfield and Sgt. Scarbrough.
County Administrator Cordes said he is very proud of the collaboration between the Sheriff and 911 and there was a space that was renovated at
911 with a drive up window. Ms. Slagle said this will save time for the deputies.

County Administrator Cordes spoke with Joe Calabreeze, RTA and said residents will be able to transfer but not after public square and
he is not sure that he would recommend the Triskett due to some timing issues.
Commissioner Kalo asked about current ridership, Mrs. Novak said for the month of May there were about 800 trips
Commissioner Williams asked how much money did it cost, Mrs. Novak said from September – May it was around $131,000.
County Administrator Cordes said when the county returned the money to the state because there was no cash match available, all
surrounding communities benefits from us and it will continue to happen.
Commissioner Williams said this service was suppose to be a 6 month trial and in his opinion has been a flop and would like to see the
money that is given here given back to the in-house routes, it is nice to get to a park and ride to catch RTA or other transportation but it would be
nice for our residents to get around, especially at the college these people are trying to make a better life and don’t have transportation.
Commissioner Kalo asked Mrs. Novak to work out the figures of the $53,000 for Cleveland run and put into local and bring back a
report for next week.
Commissioner Kokoski said she will review both routes because right now there are not a lot of jobs in this county, therefore residents
have to go elsewhere.
County Administrator Cordes said residents are not fully buying into the program because it is not consistent and stated there was a large
employee in the southern part of the county that wanted to import people that had no transportation but transit was unable to provide service in
accordance with the regulations.
David Ashenhurst, Oberlin said the transit levy did pass in Oberlin and Lorain, but only lost by 38 in Elyria so there is need in these
areas. County Administrator Cordes said Commissioner Williams has approached the issue of doing transit districts and will review all data
before another issue is placed before the voters. Commissioner Williams said a district for Lorain, Elyria and Oberlin definitely for people to get
to doctors and stores, do you need in Rochester, probably not, College yes.
Commissioner Kalo said there needs to be a citizens group that will advocate and submit the levy in order for this to be a success.
Commissioner Kokoski said various county departments use to buy bus tickets. County Administrator Cordes said yes but no one wanted
to put up cash
Commissioner Kokoski said Goodwill looking at wrapping bus, could use as match.

information that Lorain County sent to them and stated that Kaptur, Gibbs & Jordan will be sending letters of support and DeWine is also
looking at it for Jobs Ohio, there would be around 2-300 jobs and headquarters.
Commissioner Williams said there is another company that is possible looking to relocate here bringing 12 jobs.

Sam Felton, Jr., Commander DAV Chapter 20 and Chair Valor Home said he has concerns with the Veterans Commission and everyone
is quick to give Veterans Service Commission kudos for the increase in relief service but the outside Veterans Groups have made serious
suggestions in promoting the services that are provided. Mr. Felton said the progress that has been made was because of the dialogue between
the veterans committee and service commission, however this dialogue does not exist anymore. He stated yesterday they were going to have
dialogue with the commissioner, but Mr. Mackin walked out sitting there was no quorum so he left, but why could there have not been an
informal decision and with the removal of Mr. Childers the dialogue has been non existence. They questioned Mr. Childer’s presence in the
discussion and approval of the budget process when he no longer serves in this capacity. There is no accountable in this commission. Assistant
County Prosecutor Innes said yesterday there was to be a meeting but there was no quorum and even though Mr. Childers is no longer on the
board he did serve the year and gave information to the commission on the budget. Mr. Felton said retroactively it sounds great, morally not,
because when Mr. Don Bates was removed from his position he had to relinquish all his information and not allowed back in the building.
Assistant Prosecutor Innes said he meet with Mr. Childers and Mr. Mackin last Friday and during discussions he had to review information so
therefore he informed Mr. Childers and Mr. Mackin of this information and then indicated to Mr. Childers he was no longer his client due to his
removal. Mr. Felton said Mr. Mackin said he jumped up, was not going to argue and adjourned meeting and somewhere along the interpretation
of veterans service commission working for the veterans, has been thrown out the window or lost along the way because none of them came in
with a rowdy attitude just want to discuss some issues and Mr. Stone and Mr. Dickerson remained and there was a good adult dialogue with
some good points and question arose and Mr. Mackin chose not to indulge because there was no quorum could he have not a least afford the
veterans for whom he works for listen but he cited rules and regulations and violated the sunshine laws.
Commissioner Williams said can the board offer the Veterans Commission to utilize these meeting rooms in order to have recorded
meetings. Mr. Stone said they do have a recorder and the minutes are transcribed. Commissioner Williams asked about video recording, Mr.
Stone said they do not do this. County Administrator Cordes said they could use room a and record the room.
Don Attie, 4584 Apple Ave., Lorain, Jr. Vice Commander DAV 20 and Chairman of Fundraiser & Finance of Valor Home and has
concerns and the way they are being represented at the Veterans Commission is not right, people are hiding, people are having meeting without
consulting veterans or being public and yesterday they showed up to the meeting, they did not have a meeting they were just talking and then put
in the minutes they were going over litigation for Mr. Childers, this is just a tip of an iceberg and when the meetings use to start when they first
attended, there was an executive meeting prior to the board meeting and now it is general and break into executive meeting and with the outreach
to the veterans is not there the veterans groups implicated the $270 adverting was a drop in the bucket and did not even cover outside of Lorain.
Outreach needs to be done with $4-8,000, put a full spread in the newspapers, etc. and there are some veterans that it still will not reach or are
not concerned but the point is getting it out there and the board members need to represent their organizations is not out there. He has asked
since last year and continue to see the budget and has never received, the Veterans Commission says it has been sent in, this is a public record
they work for them and they tell them that the Commissioners will not allow things and the only thing the Commissioners do is review the
budget and as long as it is a viable and legal situation for the veteran then it should be approved. He said he has requested money, a fundraiser
for the Valor Home which is a viable situation to help veterans and their families and this year a week before the event, they were told this could
not be done, there is no money and they looked in ORC 5901 and there is no stipulation for this request. Mr. Attie said you will not find it
spelled out in 5901 it is simple, as long as it is a legal and viable situation for the veterans it can be approved, this is just a pay back from the
Commission to the vets.
Commissioner Kokoski asked if they are saying this is not a legal expenditure. Mr. Attie asked who made this decision and he was a
told it was the board, it was done in the past. Mr. Stone said he was not here last year and was told by the Veterans Commission that it was not
allowed because it is not in accordance with the financial assistance or a program meeting the needs of a veteran. Assistant County Prosecutor
Innes said he will not give a legal opinion on incomplete information.
Commissioner Williams asked Mr. Stone about the record request that was made. Mr. Stone said there was no formal request they asked
if they could see it, he did not see a problem with that but they were not finished with a complete document at the point they had asked and it
should have been done at the meeting yesterday but there was no meeting due to a lack of a quorum. Commissioner Williams said a public
records request has to be complied with and a verbal request is ok.
Mr. Attie said he does not understand the response on request of funds is not for an individual veteran, this is for all county veterans, and it is a
fundraiser for an outreach. Commissioner Kalo said from a board standpoint, they may say this is not how they might not best to spend the
money. Mr. Attie said they don’t seem to get it that this is for all veterans and why do the veterans groups have to go there weekly and bump
heads when intelligent conversations could be held and share ideas and if they don’t like what is said the commission gets up and leaves. He
stated that Commissioner Williams had experience a situation himself and put them in check. Mr. Attie said we need to keep track of all the
sunshine law violations and record these meetings by video and audio because there is too much lip service and nothing being done and the
veterans groups get ridiculed because they fight for the veterans and all the ones that will be coming home and get the information out to them in
order to help them. He said he pounded along with other veterans numerous spaghetti dinners, sitting in front of store fronts to get the Vietnam
Veteran Memorial built honoring 98 men from this county that never had a chance for a family or do anything and he found out later that he
could have received assistance from the Veterans Service Commission for this.

Mr. Attie said everyone on this Commission sits in a comfort zone, collects a check and does the bare minimum.
Commissioner Kokoski said everyone should work together and the amount of money that is being spent on the veterans has increased due to the
voices of the veterans groups. She indicated that in the past the cost of doing business for the Veterans Service Commission was high rather than
giving money to the veterans and some hurdles or ego’s have to be set aside and work for the betterment of all veterans.
Mr. Attie said unfortunately some people don’t see this they don’t want to work it out and the Veteran groups just started listening when they
came to the meeting because you will not get anywhere if you act like full. He indicated that President Obama said the “Vietnam Veterans have
done more in the past decade” and they want to leave this legacy and not only today but the ones that are coming.
Mr. Stone said he does appreciate the comments today and he will ask Assistant County Prosecutor Innes if this expenditure is legal and
what account should this come from. Commissioner Williams said is it money for the fundraiser for the Valor Home or is it for the outreach of
the Valor Home. Assistant County Prosecutor Innes said he will review and the Veteran Service Commission is not permitted to fund another
organization, it is just like the uniform situation, even the Commissioners can not give money to any charitable organization. Mr. Attie said not
asking for money to support the Valor Home they are asking them to support a function that will support veterans and stated look at last year’s
records. Commissioner Kalo said it does not mean that it was legally done and there is a new director in place. Commissioner Williams said
like Solid Waste there is a marketing line account, Mr. Stone said there was no line account in their budget for marketing.
Mr. Attie asked if there was money placed in the budget for the move to the new site of the Valor Home because before it was stated that
there was no viable, suitable area for that which was St. Joes that was in dire need of repairs, now there is a beautiful building, good shape,
privacy. Commissioner Kalo said the rent was removed from the budget and the Commissioners were all there trying to save St. Joes facility and
said if Veterans Service moved there they would fund but St. Joes evaporated with the County writing a check for $850,000 to get out of this
loan from the State and the Veterans Service Commission sent a letter to the Board looking at other county owned facilities that does not cost
rent. Mr. Attie said if this money comes from the property tax with a certain mileage and Veterans Service Commission submits a budget like
$1.5 million, rather than the $3 million and it was stated the Veterans can come and get more if needed. Commissioner Kalo said under Ohio
Revised Code the Veterans Service Commission can get up to a ½ mill of property tax based on providing the services and everything that is
submitted the Commissioners can review and the budget is approved based on their request. Commissioner Kalo said if you look at the
breakdown of property taxes you see a general fund amount with various levies but there is not a separate line for Veterans it comes from Lorain
County’s inside mileage up to ½ mill to provide these services and with whatever money is unused from all departments come back and that is
what the carryover is and by law the Commissioners need to approve the Veterans budget by June while all other departments are done by
December. Mr. Attie said a levy should be created to have the money on hand. Commissioner Kalo said this would be a separate veteran’s issue.
Commissioner Kokoski said there is no inside mileage set aside for the veterans alone on the tax duplicate. Commissioner Williams said it
sounds like he is discussing a levy and if there is a need for more money because the services are increased and the need is there yes, the
Veterans Commission can come back to the Commissioners, he is not sure that a separate levy is needed. Commissioner Kalo said a levy would
give them more flexibility for funds.
Mr. Attie asked if the new vehicles purchased where they first turned over the VA. County Administrator Cordes said this is an answer
needed from Veterans Service Commission because the VA would have paid fro the maintenance and fuel. Mr. Stone said the two vans
purchased were before he became director and the bus is a county owned vehicle. County Administrator Cordes said he remembers the
discussions that the county would pay for the driver and VA would pick up the maintenance and fuel but he is not sure if this was done. Mr.
Stone said he will review.
Jessie Hill, Lorain – VFW 1079 & DAV 40 said there was no Veterans Service Commission meeting yesterday so how was the budget
authorized with Mr. Childres, Mr. Mackin, Martha Garreau and Mr. Stone. He heard Assistant Prosecutor Innes state that Mr. Childers was
requested in the discussions because of his past experience with the budget. This was not the response they received yesterday from Mr. Stone
was that Mr. Childers just happened to be in the building and they requested that he join the commission. He stated back in February before the
Veterans Service Commission meeting, Assistant Prosecutor Innes said in the meeting with them and Mr. Mackin came out and they would no
longer have the commission meeting before hand and stated this was illegal and then Mr. Mackin stated the next meeting would be at 1:30 and
be out of there by 2 pm, there are no notifications of said meetings because the meetings are to be on the 1st and 3rd Tuesdays.
Commissioner Williams said yesterday there was no meting and they went into executive session, how was decisions made. Mr. Hill
said Mr. Mackin stormed out and told secretary to record but his understanding was after they left Mr. Mackin, Mr. Dickerson, Mr. Childers and
Mr. Stone went into a meeting and not saying this was a violation of sunshine laws. Commissioner Williams said you can discuss things but no
decisions.
Mr. Felton said the lines of communications have eroded to the point that it is hard to understand what is going on and it is frustrating we
should all be on the same page to help all veterans and even Commissioner Kokoski indicted “egos”. Yes, the egos need to be taken out of the
equation and remember the prime purpose and goal is to help out our fellow veterans. He said Assistant Prosecutor Innes indicated that Mr.
Childers asked him a question and stated on his last day he could not represent him and if a question was asked why wasn’t it responded to at
that time, instead yesterday he answer Mr. Childers question and he was not part of the board, put yourself in their situation because when Mr.
Bates was relieved from his position he was not privy to anything and when private meetings are held it does not look dishonest, he does not see
Don walking around Commission office and he was just as knowledge as anyone sitting there today and no one ask him for advice. So when you
have Mr. Childers free run of the building, when he is just a private citizen and veteran like him. He said yesterday Mr. Childers was in Mr.
Stone’s office and Mr. Stones’ response was maybe he should have closed his door so statements like this, ego’s like this tend to erode their
confidence in their so called leaders in the Veterans Community and hope next time the meeting is here in open forum and video tapped.
Rick Piscone, West Ridge Road, Amherst Township said the bridge over the turnpike is being worked on and yesterday was held up by
15 minutes by a train and had to go down Murray Ridge and hopefully an emergency does not occur. He said he has worked years in the
veteran’s community and went down to the Veterans Service Commission to speak with Jerelyn, Investigator at Veterans Commission about a
situation for a veteran at the post. He spoke with Mr. Stone and the new employee Martha Garreau walked by and was introduced to her and
started to have an incidental, bs conversation and 1 month later he received a letter written by Mr. Childers from Veterans Service Commission
and referred to the Prosecutors Office and it stoned and amazed him, sucked the wind out of him and could not sleep for three days and
addressed as racial slurs towards this lady and she wrote a one page letter. He could not believe that she accused him of these things based on a
conversation they had and what really bothered him and upset him the most was that the incident took place on the 8th of February and incident
report was dated 22nd of February giving him 7 days to respond and postmarked the 12th day of March. He called Mr. Childers that was on
vacation in New Mexico and was told just to write a response and then he went to the Legion and spoke with Mr. Sam Betounes and when he
read the letter with the verbiage was used and how he was attacked he could not believe it and why Mr. Childers wrote the letter with Mr.
Mackin being the Chairman of the commission. He wrote a response and asked if Assistant Prosecutor received it. He said a matter this serious;
he has been part of various activities with the veterans and has not done things because he has not received an answer to his rebuttal letter so he
is not going down because he is not sure if this matter is settled. He read the letter, addressed to him, dated February 22, derogatory racial attack
on Veterans Service Administrative Assistant Martha Garreau on February 8, 2013. Dear Commander Piscone; The Board of Veterans Service
Commission had an opportunity on February 20, 2013 to review the incident referred to above. This very serious issue was discussed with
Director Stone as well as Martha Garreau and the position is that they are so applaud and disappointed that a true leader of our veteran
community could be so identically and tragically reckless. This sensitive disrespectful and offense to a fellow veteran who has served her
country throughout just because of her ethnicity and without question this disserving warrants a response from Commander Piscone and
hopefully a response made will preclude the board from having to take this matter to a higher level, please respond within 7 days. He stated he
did respond and spoke with several people and no one has told him if this is settled or not and sent it back on March 18. He will not go back
down there until, this girl and if you read the letter that she wrote and his rebuttal letter and he had to really think of how everything was taken

out of context, he is afraid to be near this girl. Truthfully if you read what she has an accused him of and he spoke with Mr. Stone and he agrees
but he is wanting for an answer. He has heard today from fellow veterans about the lines of communication, he does not come many of these
meetings but he thinks that Mr. Burge needs to look at removing more of the people from the board because it is so stagnant and it is upsetting to
the veteran community. The people have sat on this commission for years and only collect a paycheck, will he get a response, and is he going to
court. Commissioner Kokoski asked Assistant Prosecutor Innes who would respond. Assistant Prosecutor Innes said he does not recall Mr.
Piscone said he has taken this very serious and is ready to quit his work with the veterans with bullshit letters like this and he has probably given
half a lifetime in donated hours to the veteran community. Commissioner Kalo said Mr. Piscone probably should give the letter to Veterans
Commission with a copy to the Prosecutor Office and Commissioners and see what happens and then everyone would be aware of it. Assistant
Prosecutor Innes said this would be advisable. Mr. Piscone said he agrees with fellow Veterans of Lorain if you want to get something done you
have to knock on their door, have Mr. Burge remove more members; we need to voices, younger blood and people that are sincere in working
with the veterans.
Herman Burris, Lorain, DAV #20, said there are members that are this commission that have been there 25 years, falling asleep at
meetings it’s like a burden chore. It reminds him of Sudan Hassan, they don’t want change they want to hold these titles and do nothing for the
people. Commissioner Kokoski said the Commissioners do not appoint it is the Judge. County Administrator Cordes said the organizations refer
members to serve and then the Judge appoints. Commissioner Kokoski said the various posts need to be made aware of the situation and then
people can run for position. Mr. Felton said each post submits three names and then the Judge selects the person to serve.
Commissioner Kokoski said Mr. Bates might have submitted his name but Mr. Childers was elected to serve by the Judge. Mr. Felton said then
why do the post submit names if the Judge continues to elect the same people.
Barb Gersna, 2853 Jaycox, Avon said the veterans are to get .5 mill. Commissioner Kalo said it is up to $3 million that is what a ½ mill
equates too. She asked why the funds are restricted in the amount that is given when vital programs are necessary. Commissioner Kokoski said
the mileage is part of the county’s inside mileage and it is up to ½ mill but a budget has to reflect the spending and within the code there are
restrictions.
Bob Childers, 255 Harrison Street, Elyria said he applied to serve on the Veterans Commission three times within the last 15 years and
was finally chosen to serve this organization and with respect to Mr. Attie he had only applied recently. The judge makes this appointment.
Assistant County Prosecutor Innes said wanted to explain the last two veterans meetings. He stated he met with Mr. Mackin and Mr.
Childers last Friday which were both his clients at that time and a question was asked and gave them a brief explanation but after further review
the answer had to be expounded upon therefore he did this on Tuesday and then found out that Mr. Childers was no longer on the board. But his
moral obligation was to correct the answer and Mr. Mackin and Mr. Childers and after that was explained, he indicated to Mr. Childers he was
no longer able to represent him and there would be no further discussion and then had a conversation with Mr. Mackin. Assistant County
Prosecutor Innes said he as county counsel represents the Veterans, Commissioners, etc and Veterans issues have been on going for several years
and he works with Directors and then they leave and have to start over again but at the February meeting there were several questions that arose
at the Veterans Service Commission and he stated that usually you would start a board meeting then proceed into an executive meeting. He also
stated that maybe the Veterans Commissioner should speak with the legislators on how the law is written and the money that is to be given to
them because nothing has been changed since WW2 and there is no real money set aside for the veterans like other levies. He also indicated that
anytime there is an issue they can call the Prosecutors Office and Prosecutor Will is a Veteran and would be happy to discuss.
Commissioner Williams said he had a good meeting with the Elyria Post and Senator Manning and looking into support for funds for
uniforms.
