Payment to be made in full before the puppy leaves the breeder. Definitions used herein include: “Breeder” shall herein be defined as: Canyon Court Labradoodles (CCL) “Buyer” shall herein be defined “Puppy or Dog” shall herein be defined as Canyon Court Companion Pet Puppy shall be understood to mean that the puppy is considered solely as a companion pet and not a breeding prospect. Puppy will be de-sexed. Buyer understands that the sale of this puppy is Pet only. Buyer Initials_______ Breeder Initials ______ 1 Breeder’s Responsibility: 1. The Breeder guarantees the puppy is in good health at the time of delivery. All dogs will be shipped in good health and free, to the best of Breeder’s knowledge, from genetic defect. Breeder has taken every reasonable precaution to ensure the physical soundness and temperament of the Dog. To the best of Breeder’s knowledge, the Dog’s Sire and Dam are free of hereditary defect. a. The Buyer has three days to take the puppy into a veterinarian for an examination. b. If the puppy is found to be of poor health, Buyer shall immediately provide Breeder with a written copy of said report from a licensed DVM. Breeder also retains the right to have a 2nd opinion at breeder’s expense. Buyer may return the Dog to the Breeder within two days of the veterinarian examination. Breeder will replace the Dog or refund the amount paid, at its option. Or, the Buyer has the option of keeping the puppy and the Breeder will reimburse for all documented veterinary costs, up to the purchase price, related to the pre-existing condition. However, the seller will not be responsible for any vet bills unless prior consent is given in writing. If you have any concerns please contact us immediately. c. If satisfied with the Veterinarian report, Buyer will retain possession of the Dog and, except as provided in Section 2 below, hold Breeder harmless and not liable for any further medical conditions of the Dog. 2. The Breeder provides a warranty for three years after the birth of the Dog against any serious genetic disorder that affects the dog's quality of life. Should a serious genetic disorder be discovered, the Breeder will offer a replacement puppy from the next available litter or refund 50% of the original purchase price (breeder’s choice). Your puppy does not need to be returned to us. All veterinary records must be supplied to the Breeder. In the case of HD the Buyer must provide documentation from PennHIP or OFA. In the case PRA the Buyer must provide documentation from a veterinary ophthalmologist. 3. The Breeder reserves the right, at the Breeder's expense, to have the dog checked by a veterinarian of the Breeder's choice before offering a replacement puppy or refund. Buyer's Responsibility: 1. The Buyer will provide the dog a caring loving and secure home. 2. The Buyer will take the dog to a veterinarian for an annual check-up and all preventative treatment recommended by the veterinarian will be followed. Buyer must provide veterinary records to Breeder when requesting a replacement or refund. Breeder reserves the right to have the Puppy examined by a veterinarian of the Breeder’s choice prior to replacement or refund. 3. The Buyer will feed the dog only a premium quality dog food or a wellresearched, balanced raw food diet. a. Premium quality dog foods are GRAIN FREE. Buyer Initials_______ Breeder Initials ______ 2 b. The Raw Meaty Bone Diet is recommended by Breeder, as described in Tom Lonsdale’s book: Work Wonders: Feed your dog raw meaty bones. This is a good place to begin research into a raw diet (www.rawmeatybones.com). c. Pet food sold in grocery stores does not constitute a premium pet food. The Buyer will not allow the dog to become overweight or allow repetitive, rigorous exercise during the first 18 months of development for standard size dogs, the first 12 months of development for smaller sizes. 5. Disregard for any of the above, voids any warranties under this Agreement. 4. General 1. SHIPPING AND PAYMENT Upon acceptance of an allocated Dog, Buyer will be notified of the Balance Due, which must be paid in cash or certified check within 10 days. (This will be when the puppy is approximately 6 weeks old). Credit Cards will be accepted with a 3% surcharge. If payment is not made in full (including shipping costs) within said 10 day period, Breeder will have the option to sell the dog to another Buyer and the Booking Fee will be forfeited. Dogs will be shipped when they are medically and emotionally ready (Usually between 9-12 weeks). Buyer is responsible for all shipping costs (airline fees and airport transportation), the cost of a crate, and the cost of a Health Certificate required for transportation of the dog, all of which will be added to the Balance Due. Buyer will either provide Breeder with a credit card (3% surcharge will not apply) which will be charged for the full amount of shipping and other costs required to be paid by Buyer or will, prior to shipment, prepay the estimated amount of these costs. Any over payment will be adjusted subsequent to shipping. 2. RISK OF LOSS: Title to the Dog transfers to the Buyer when it leaves the Breeder’s kennel. All risk of loss and injury after leaving the Breeder’s kennel is the responsibility of the Buyer. 3. HEALTH: All dogs will be shipped in good health and free, to the best of Breeder’s knowledge, from genetic defect. Breeder is not responsible for the development of any faults, diseases, or disorders, which are due to negligence and environmental factors. This guarantee is void if the following conditions are not met: a. The dog must be maintained at a healthy weight. b. Puppy must be allowed to set the pace in all activities and rest when needed during developmental stages of growth. c. Puppy under 18 months of age for Standard size dogs, and 12 months for smaller sizes, must not be taken on long walks (over one mile) or exposed to excessive exercise. c. Reasonably limit stair climbing and jumping until 10 months of age. d. Feed a high quality diet. Buyer Initials_______ Breeder Initials ______ 3 e. Puppy will be secured at all time and only be allowed off-leash in safely secured areas. BREEDER ASSUMES NO RESPONSIBILITY FOR ANY HEALTH RELATED ISSUES OR LOSS OF LIFE DUE TO REACTIONS CAUSED BY VACCINATIONS OR FLEA AND TICK PREPARATIONS ADMINISTERD EITHER ORALLY OR ON THE SKIN SURFACE. 4. DISPOSITION OF THE DOG: The Buyer agrees to never relinquish the Puppy to a shelter. The Breeder agrees to accept a return of the Puppy at any time and for any reason, for the life of the Puppy. Should Buyer decide to sell, relinquish or transfer Puppy, Buyer agrees to notify Breeder of Puppy’s new owner’s details and address. Buyer agrees to screen new owners before sale, release or transfer of Puppy. The Buyer will contact the Breeder immediately if the Buyer can no longer look after the dog at ANY point during the dog’s life. The Buyer may return the dog, however, Breeder will not offer a refund. Our return policy is as follows: For non-emergencies, Buyer agrees to retain Puppy until the Breeder can find a new home. This is so that the Puppy only need make one adjustment. For emergencies, Buyer will ship Puppy to Breeder at Buyer’s expense. All warranties in this contract are non-transferable and become void if ownership of the dog transfers. 5. LIMITATION OF LIABILITY: The parties agree that any damages suffered by the Buyer of any kind and however arising from any breach by the Breeder of any condition or warranty in this Agreement or implied by law shall be limited to the replacement of the Dog by the Breeder within a one-year period. 6. JURISDICITON: This Agreement will be construed in accordance with the laws of California. If any legal action is to be taken by either Buyer or Breeder venue shall be in San Diego County, California. 7. BINDING AGREEMENT: This Agreement will be binding upon receipt of the Booking Fee and by Breeder faxing or mailing a signed copy to the Buyer. This contract must be signed and post marked back to Canyon Court Labradoodles within 14 days upon receipt of the dog or all guarantees and this contract will be null and void (Please make a copy of this contract for your records and return original). All of the terms of the parties’ agreements are incorporated into this document. The parties expressly agree that this document constitutes the entire agreement between the parties and supercedes all previous negotiations and agreements in relation to this transaction. Any changes to this agreement must be in writing and signed by both parties.
