Pursuant to Article 21 of Physical Assets of the State and Local Government Act (Official
Gazette of the Republic of Slovenia, Nos. 86/10, 75/12, 47/13 – ZDU-1G and 50/14), Article 30
of Decree on Physical Assets of the State and Local Government (Official Gazette of the
Republic of Slovenia, Nos. 34/11, 42/12, 24/13 and 10/14), and Firearms Act (Official Gazette of
the Republic of Slovenia, Nos. 23/05 and 85/09), the Republic of Slovenia, Ministry of Defence,
Vojkova cesta 55, 1000 Ljubljana, hereby publishes the
Notice of public auction for sale of surplus weapons
1. Name and seat of auctioneer
Republika Slovenija, Ministrstvo za obrambo, Vojkova cesta 55, 1000 Ljubljana (in English:
Republic of Slovenia, Ministry of Defence, Vojkova cesta 55, 1000 Ljubljana). Public auction
will be conducted by the competent commission.
2. Subject of public auction, buyout price, lowest increment amount, and
registration deposit
The sale refers to the following lots of various types of surplus weapons:
weapons lot 1 (5790 pieces), minimum bid is € 367.056,00 and the amount of
deposit is € 37.000,00;
The sale refers to the following lots of various types of surplus weapons:
weapons lot 2 (5825 pieces), minimum bid is € 368.592,00 and the amount of
deposit is € 37.000,00;
The sale refers to the following lots of various types of surplus weapons:
weapons lot 3 (5856 pieces), minimum bid is € 422.028,00 and the amount of
deposit is € 43.000,00;
The sale refers to the following lots of various types of surplus weapons:
weapons lot 4 (5871 pieces), minimum bid is € 421.932,00and the amount of
deposit is € 43.000,00;
The sale refers to the following lots of various types of surplus weapons:
weapons lot 5 (5945 pieces), minimum bid is € 581.496,00 and the amount of
deposit is € 59.000,00;
The sale refers to the following lots of various types of surplus weapons:
weapons lot 6 (6019 pieces), minimum bid is € 587.868,00 and the amount of
deposit is € 59.000,00;
The sale refers to the following lots of various types of surplus weapons:
weapons lot 7 (6018 pieces), minimum bid is € 449.676,00 and the amount of
deposit is € 45.000,00;

The sale is carried out for each individual weapon lot. Individual bidders can also submit an
offer for several lots of auctioned items.
The lowest increment amount for individual lots is € 1.000,00.

3. Amount of registration deposit
Prior to the date of public auction, the bidders are required to pay registration deposit in the
amount as specified in Point 2 of this Notice to the transaction account of the Ministry of
Defence, No. 01100-6370191114, reference 00 201000-19022015, purpose code: GOVT
and payment purpose: registration deposit for the lot under sequence no.: (insert sequence

no.). By paying the deposit the bidder undertakes the obligation to attend the public
auction.
The paid deposit will be applied toward the purchase price of the winning bidder or withheld
should the bidder fail to conclude the contract. Non-winning bidders will be refunded their
deposit without the interest rate within 15 days upon completion of public auction to the
transaction account of the payer.
The deposit paid by the bidders not attending public auction will be withheld. The deposit
will also be withheld should the winning bidder fail to pay the purchase price.
4. Contract award term
The contract will be awarded to the best bidder within 15 days upon conclusion of public
auction.
5. Method and term of paying the purchase price
The buyer pays the purchase price on the basis of the seller's invoice no later than 15 days
after the issuing of the invoice. Pursuant to subparagraph 5 of Article 5 of Value Added Tax
Act (Official Gazette of the Republic of Slovenia, No. 13/11 – official consolidated text,
18/11, 78/11, 38/12 and 83/12), the price does not include VAT.
The payment of the whole purchase price for each, individual lot under the specified term is
a constituent element of the legal transaction.
6. Participation at public auction and applicable conditions (method, place and deadline
for submitting required documents) and inspection of items
Public auction is open to companies and business people that meet special conditions for
weapons trade under Firearms Act (traders), for which they must submit the required
business permission issued by the minister competent for internal affairs. The bidders
expressing interest are required to submit the following documents by the deadline specified
in this subparagraph:
 Permission issued by the minister competent for internal affairs for the required
business or for the foreign legal companies which must submit a certificate issued by
the authorities of their country that are equivalent to institutions responsible for
issuing certificates for The Weapons Trade;
– Certificate of paid registration deposit with the attached full number of transaction
account for a potential deposit refund;
– Representatives of legal and natural persons are required to submit a notarized
power of attorney for participation in the public auction;
– Certificate of paid taxes and charges not older than 30 days (foreign citizens must
submit a certificate issued by the authorities of their country that are equivalent to
institutions responsible for issuing certificates to Slovenian citizens. If such a
certificate cannot be obtained, they must submit a notarized personal statement
taken under criminal and material liability about the settlement of taxes and
charges), and
– A certificate that their transaction account has not been blocked in the past six
months (applies for legal persons and sole traders – foreign legal persons must
submit a certificate issued by the authorities of their country that are equivalent to
institutions responsible for issuing certificates to Slovenian citizens. If such a
certificate cannot be obtained, they must submit a notarized personal statement
taken under criminal and material liability that their transaction account has not been
blocked in the past six months). The VAT identification number, registration number,
e-address and telephone number must also be attached.
Public auctions can only be attended by the bidders who submit documents in a closed
envelope by Monday, 16 February 2015, 13:00 p.m., to the following address: Ministrstvo za
obrambo, Vojkova cesta 55, 1000 Ljubljana, by mail or personally to the mailroom.
The front side of the envelope must be furnished with the following information:

The back of the envelope must contain the name and address of the bidder.
Should the envelopes not contain all the required information, the organizer of public
auction will not be held responsible for any envelopes misplaced in the post.
The sale items will be sold according to the »as is« principle, and any complaints following
the conclusion of the agreement of sale will not be considered. Public auction will be
conducted orally in Slovene language. Any expenses related to transfer of ownership will be
covered by the buyer.
The auction will take place provided that all the criteria referred to above are met. Bidders
not meeting these criteria will be excluded from the proceedings based on a decision
reached by the commission conducting the public auction.
The inspection will be carried out for the bidders meeting the criteria under subparagraph 6
at the military post Vojašnica slovenske Terirorialne obrambe, Koščeva ulica 6 in Ljubljana,
on 10 and 11 February 2015, between 9:00 a.m. and 13:00 p.m. by prior appointment with
the point of contact Mr. Bojan Fritsch, tel. 01 581 35 04, at least one day in advance.
7. Selection of best bidder
The best bidder will be selected at the public auction. If there is only one bidder, the
auctioned item will be sold at a buyout price. The selected bidder is the one offering the
highest bid.
In case of two or more bidders offering the highest bid, the auctioned item will not be sold
unless one of the bidders increases the bid.
8. Date, time and place of public auction
Public auction will be held on Thursday, on 19 February 2015, at 10:00 a.m. in the premises
of the Ministry of Defence, Vojkova cesta 55 a (Auditory), 1000 Ljubljana.
9. Suspension of procedure
Until the completion of the legal transaction, the seller may suspend the sale procedure and
will refund the bidders all the expenses in the amount of declared cost for the acceptance of
documents related to the invitation.
