OF ELECTRICAL CONTRACTORS (PUBLIC SESSION)
DECEMBER 4, 2013
The Board Minutes of December 4, 2013, have not been formally approved and are
subject to change or modification by the Public Body at its next meeting of January 8,
2014, or soon thereafter as it may be considered. All requirements of the “Open Public
Meetings Act” have been complied with according to N.J.S.A. 10:4-6.
The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier
Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at
the office of the Secretary of State, Trenton, New Jersey.
Board meeting of December 4, 2013, was called to order at 9:00 A.M.

unanimously passed, to approve (67) Initial Licenses effective December 4, 2013 to
March 31, 2015.
Motion made by Mr. James H. Flaherty and seconded by Mr. Mitchell R. Malec, and
unanimously passed, to approve (51) Initial Business Permits effective December 4,
2013 to March 31, 2015.
Motion made by Mr. James H. Flaherty and seconded by Mr. Joseph F. Cantalupo, and
unanimously passed, to approve (6) Initial Business Permits Previously Expired
effective December 4, 2013 to March 31, 2015.

Two checks in the amount of $1,000.00 each received from Juan F. Vela, License
#9471, t/a Vela Electrical Contractor, as the first and final payment of a civil penalty
in the amount of $2,000.00 for violation of N.J.A.C. 13:31-3.5 and 13:31-3.3(b).
The Board accepted the payment.

Postal Money Order in the amount of $500.00 received from Rodolphe Schomberg,
License #11661, t/a RS Electrical Contracting, as the first installment of a civil penalty
in the amount of $2,500.00 for violation of N.J.S.A. 45:1-21(b). Balance due is
$2,000.00.
The Board accepted the payment.

Elite Electrical Contractors, LLC, as the first and final payment in the amount of
$500.00 for violation of N.J.S.A. 13:31-3.5.

The Board reviewed an application for Continuing Education Course/Seminar Approval
received from Marilyn Becker, Samson Electrical Supply, requesting approval of new
courses.
Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas,
and unanimously passed, to approve two (2) new courses and instructors.

The Board reviewed an application for Continuing Education Course/Seminar Approval
received from Andrew Topinka, Blu-Peach Education, LLC, Division of Technical Group
Services, requesting approval of new courses.
Motion made by Mr. James H. Flaherty and seconded by Mr. Arthur W. Jacobs, Sr., and
passed, to approve four (4) new courses and instructors. Mr. Topinka will be advised
that the course entitled “Energy and Atmosphere Conservation Overview” is not
approved as it does not meet the criteria of continuing education pursuant to N.J.A.C.
13:31-1.7.
Mr. Mitchell R. Malec and Mr. Constantinos Papademas opposed the motion.
Mr. Flaherty stated that the Continuing Education subcommittee works very hard on
reviewing the course submissions. Most of the time the Board members agree with the
committee’s recommendations; however, in this particular submission, the members
disagree.

Constantinos Papademas recused himself from the discussion and the motion as he is
listed as an instructor.
The Board reviewed an application for Continuing Education Course/Seminar Approval
received from Sarah Barton, Warshauer Electric Supply.
Motion made by Mr. Mitchell R. Malec and seconded by Mr. Joseph F. Cantalupo, and
passed, to approve Ms. Barton’s request to remove Bill Harris and add Constantinos
Papademas to teach the nine hours of code changes and the one hour of Laws, Rules
and Regulations.

The Board reviewed an application for Continuing Education Course/Seminar Approval
received from Dennis Campbell, Comprehensive Education Solutions, LLC.
Motion made by Mr. Mitchell R. Malec and seconded by Mr. Joseph F. Cantalupo, and
unanimously passed, to approve (10) new courses and instructors and previously
approved courses. Additionally, the Board approved Mr. Campbell’s request to approve
Mr. Geiter to teach new courses and the previously approved courses.

Mr. Campbell will also be advised that the course entitled “NJ Uniform Construction
Code” is not approved as it is not specific to electrical contractors. The course entitled
“Limited Energy Circuits” is being held in abeyance pending an explanation as to how
the instructor will cover all of the material indicated in the outline in two hours.

Letter received from Douglas Caruso requesting a second six-month continuance of
business under Permit #1544 according to N.J.S.A. 45:5A-14. The licensee, Robert
Caruso, died on March 14, 2013. The current extension expired on October 15, 2013.
Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Constantinos
Papademas, and unanimously passed, that the firm of Caruso Electrical Contractor be
granted a second and final six-month continuance of business under permit #1544
according to N.J.S.A. 45:5A-14. The Board approves Douglas Caruso to qualify the
business for the six-month period.

Letter received October 2, 2013, from Ronald Cavallo asking whether or not New
Jersey public schools are obligated to the same responsibilities implied in C.45:5A-11.1
et seq. with regard to personnel qualifications and the applicability of N.J.S.A. 45:5A18(l).
Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Constantinos
Papademas, and unanimously passed, that a letter be sent to Mr. Cavallo advising him
that public schools must abide by N.J.S.A. 45:5A-18(l) Installation, repair or
maintenance performed by regular employees of the State or of a municipality, county,
or school district on the premises or property owned or occupied by the State, a
municipality, county, or school district; provided that a regular employee of the State,
municipality, county or school district performing this work is a qualified journeyman
electrician registered pursuant to section 3 of P.L.2001, c.21 (C.45:5A-11.1), or holds
any civil service title with a job description which includes electrical work pursuant to
the "Civil Service Act," N.J.S.11A:1-1 et seq., or regulations adopted pursuant thereto,
or any employee of a State authority who has completed an apprenticeship training
program approved by the United States Department of Labor, Bureau of Apprenticeship
Training, that deals specifically with electrical work, and is of a minimum duration of
three years.

Response received from Christopher Paolello, License #11651, t/a Paolello Electric, to
the Provisional Order of Discipline filed October 2, 2013, ordering Mr. Paolello pay a
civil penalty in the amount of $3,000.00 ($1,000.00 for each triennial period Mr.
Paolello did not have an active business permit) for violation of N.J.S.A. 45:5A-9; issue
a public reprimand; and provide copies of Continuing Education Course certificates for
the triennial renewal periods of 2009 and 2012.
Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Mitchell R. Malec, and
unanimously passed, that this matter be discussed in Closed Session to receive advice
of counsel.
After review and discussion in Closed Session, the Board returned to Public Session for
the following motion:
Motion made by Mr. Mitchell R. Malec and seconded by Mr. Joseph F. Cantalupo, and
unanimously passed, that Deputy Attorney General Joseph Donofrio modify the
Provisional Order of Discipline and issue a Final Order of Discipline ordering Mr.
Paolello pay a civil penalty in the amount of $1,000.00 for violation of N.J.S.A.
45:5A-9. Mr. Paolello engaged in the business of electrical contracting during 2009 to
2012 when he did not have an active business permit. The Board found that there is
no evidence to substantiate that Mr. Paolello engaged in the business of electrical
contracting during the period of 2003 to 2009.

The Board reviewed applications for the written examination to be administered by
Thomson Prometric. Three (3) applications were approved.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas,
and unanimously passed, to go into Executive Closed Session to consider and to review
consumer complaints, investigative reports and other information received pursuant
to the Board’s investigative authority in order to determine whether violations of the
law, including Board regulations have occurred. The results of the deliberations will be
made known when and if the Board determines to initiate disciplinary action or other
law enforcement action.
