TO THE HONORABLE MAYOR AND COMMISSION REPORT TO: STILLWATER CITY COMMISSION No. CC-05-288 ISSUED BY THE CITY MANAGER - STILLWATER, OKLAHOMA Date of Meeting: December 5, 2005 Subject: Agreement for Loan of Fire Equipment between the City of Stillwater and Oklahoma State University Fire Service Training Purpose of Report: The purpose of the report is to seek City Commission approval of a agreement for loan of a surplus fire department fire engine to Fire Service Training at Oklahoma State University. Background: Fire Administration was contacted several weeks ago by Oklahoma State University Fire Service Training (OSU-FST) regarding a surplus fire engine they had on loan from the City of Stillwater since late 1997. State auditors conducted a physical inventory and audit of OSU-FST’s operations and equipment and discovered that no written documentation existed detailing the loan of the fire engine to OSU-FST. To correct the situation, OSU-FST generated an agreement and submitted it to Fire Administration for approval by the City Commission. The fire engine is a 1975 Boardman C-900 1000GPM pumper. The unit was in operation as a Reserve/Rescue until the City acquired the current 1997 Salisbury Rescue Truck in late 1997. The Boardman was then retired and preparations were made to dispose of the unit. In preparing this report, the Fire Administration researched all available City Commission agendas around the time the engine went to FST. No Commission report could be found. The Fire Administration contacted former Fire Chief Chris Neal who could not remember the details on the deployment of the engine with FST. Former Assistant Fire Chief Alvin Rains was contacted and indicated that he remembered the request being reviewed by then City Attorney Mary Ann Karns for any legal liability on the City’s behalf. Chief Rains stated he was sure the request went before the Commission for approval; however, the Fire Administration cannot locate any document to that end. As a last resort, Deputy City Clerk Clara Welch, performed a thorough search of records and could not locate any documents. Discussion: Apparently the engine has been located at FST for nearly ten years and still provides reliable pumping capability when firefighters are in training at the Professional Skills Center west of Stillwater. The fire truck itself is probably worth less than $3,000. Most of that value is contained in the motor and pump. The agreement requires OSU to be responsible for any maintenance and repairs. Further, the agreement holds the City harmless of any tort liability. Therefore, Fire Administration sees no reason not to allow FST to continue to use the engine and urges the Commission to approve the agreement. Budget Impact: This item has no budget impact. Alternatives: 1. Approve the agreement for loan of the 1975 Boardman C-900 to OSU Fire Service Training and authorize the Mayor to sign the agreement. 2. Deny approval and direct the Fire Department accordingly. Recommendation: The Fire Administration recommends Alternative #1: Approve the agreement for loan of the 1975 Boardman C-900 to OSU Fire Service Training and authorize the Mayor to sign the agreement.
