An Act to Amend "The Cotton Industry Act of 1923" in certain particulars. [ASSENTED TO 28TH OCTOBER, 1924.J by the King's Most Excellent Majesty, B E itbyenacted and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows;- Short title 1. This Act may be cited as " The Cotton IndustTY at 1924," and shall be read as one with *" The Cotton Industry Act at 1923," herein referred to as the Principal Act. This Act and the Principal Act may together be cited as " The Cotton Industry Acts, 1923 to 1924." a~!truction Act Amendment Act ~f Act. Amendments 2. The follows;- Amendm~mt (i. ) Before the definition of "Authorised agent" in section three, the following definition is inserted ;_ " Annual cotton"-Cotton obtained from the first growth of the cotton plant after planting; the term does not include ratoon cotton or tree cotton or any perennial cotton." ~cr.rincipa.l of B. 3. Annual cotton. Principal Act is hereby amended as In the definition of "Seed cotton" in section three, the words "obtained from the annual planting of the seed" are repealed. AmendmGnt of 8. 6•. In the first paragraph of subsection one of section six, the words "seed cotton" are repealed and the words "annual cotton" are inserted in lieu thereof; also after the word " State" the words " whether annual cotton or ratoon cotton" are inserted. of~. 7. (iii.) In subsection one of section seven, after the word " but" the words "in the case of annual cotton" are inserted. Amendment B. 9. (iv.) Cotton Industry Act Am,endment Act. ----------~ word "annual" is inserted; also, before the proviso to the said subsection one the following provision is inserted : "Such sum per pound as he may think fit for ratoon cotton obtained from the second growth of the cotton plant delivered at an authorised factory during the years ending respectively on the thirty-first day of July, one .thousand nine hundred and twenty-five, and the thirty-first day of .July, one thousand nine hundred and twenty-six." In the last paragraph of the said section the words "any of" are repealed. . (vi.) Section twenty-one is repealed and the following Amendment section is inserted in lieu thereof : of s. 21. " [21. ] (1.) On or before a date to be proclaimed by Cotton the Governor in Council in every year all cotton p1ants- b~~:~l~ay (i.) Which are the first growth after planting with shall either be destroyed or be cut down to annually. within six inches of the ground level ; (ii.) Which are not the first growth after planting shall be destroyed. (2.) On or before a date to be proclaimed by the Governor in Council in every year, all debris of cotton plants, whether arising from destruction or cutting-down thereof, and whether on any land or at any ginnery, shall be destroyed by fire. (3.) The dates referred to in subsections one and two hereof may be different for different districts or localities, having regard to climatic conditions or any other conditions or circumstances retarding the maturity and harvesting of the cotton crop in any of such districts or localities, and any date so proclaimed may be extended with respect to any particular district or locality. 10928 COTTOX. If upon any land whereon cotton is being grown or has been grown any cotton plant not so destroyed or cut down aR herein provided, or debris of cotton plants, is found after the said proclaimed date in any year, the person who is or was concerned in the growing of such cotton shall be guilty of an offence against this Act. (5.) An inspector may enter upon any land(a) Upon which mature or autumn-planted cotton plants are growing after the said proclaimed date in any year and cause them, in his discretion, either to be destroyed or cut down as aforesaid and the debris thereof to be destroyed by fire; (b) Upon which the debris of any cotton plants is found after the said date in any year, and cause the same to be destroyed by fire." (vii.) In paragraph (c) of section thirty-five, the words "cotton subject to this Act" are repealed and the words "annual cotton, or ratoon cotton obtained from the second growth of the cotton plant, or ratoon cotton subject to this Act, or that any debris found upon any land or at any ginnery after the date proclaimed in that behalf under section twenty-one of this Act in any year is debris of cotton plants subj ect to this Act, or that any cotton plants are or are not the first growth after planting" are inserted in lieu thereof; also after the words "under this Act" the words "or that any person is or was concerned in the growing of 'any cotton or is or is not registered under this Act" are inserted. (viii.) The following words are added to subsection one of section thirty-eight: --" the conditions upon which registrations may be granted, suspended, or revoked." In subsection two of the said section, the word seed" is repealed and the word "annua]" is inserted in lieu thereof. After subsection five of the said section the following subsection is inserted : " (,JA.) Conditions for the harvesting, ginning, marketing, or handling of any ratoon cotton separately from any other cotton." In subsection seven of the said section, the words " seed cotton" are repealed and the words " cotton seed" are inserted in lieu thereof. 10929 COTTON. -------------- ] 924. CottOI1 -----~-----~- I ndllstry Act Am,enclment Act. ----------~--- Subsection nine of the said section is repealed and the following subsection is inserted in lieu thereof : " (9.) Prescribing particulars which shall be furnished to the Under Secretary by cotton growers with respect to any matter arising under this Act." After subsection fourteen of the said section the following subsections are inserted : "(14A) Authorising the Minister or the Council of Agriculture from time to time to make and levy (after publication in the Gazette of the intention so to do) an assessment on every pOlmd of seed cotton received at a ginnery in such sum as the Minister on the recommendation of the Council of Agriculture may at any time determine: Provided that(a) No such regulations shall have any force or effect unless or until a poll of the registered cotton growers affected by the levy has been taken as prescribed, nor unless seventy-five per centum of such cotton growers have voted at such poll in favour of such levy. (b) Such assessment shall be borne by the cotton growers. Such assessment shall be paid by the owner of the ginnery to the Minister or the Council of Agriculture upon the first day of every month upon the actual number of pounds of seed cotton received at the ginnery during the preceding month. The amount of the assessment shall be a debt due from the owner of the ginnery to the Minister or Council of Agricult,ure and recoverable at the suit of the Minister or such Council accordingly~ but the owner of the ginnery may deduct from the price of the seed cotton each cotton grower's proportion of such assessment. (c) All assessments so levied shall be paid into a fund to be called the Cotton Growers' Fund. Such fund shall be administered by the Council of Agriculture or by a Board J0930 COTTON. No. 14, 1924. appointed by the Minister on the reCOlllmenda tion of the Council of Agriculture, and shall be audited from time to time by officers of the Department of the Auditor-General. Such fund may be applied by the Council of Agriculture or such Board to the purchase or erection and the maintenance and working of a cotton ginnery or ginneries, or to such other purposes as may be stated in the regulations authorising the levy. (14B) Providing for the establishment of cotton credits in favour of the cotton growers from whom any such levy has been collected and for the allotment of shares or other interests in any ginnery or other property purchased hereunder upon the basis of the amount of such credits." The following words are added to subsection fifteen of the said section :-" and for the suspension or revocation of any registration for any such breach." CROWN LAND. See LAND, CROWN.
