RAYAC is switching to a new online membership system which will be a
one-stop-shop for you. It will allow you to:

update your contact information

register for classes and events

receive and pay invoices

access members-only information

view an ongoing record of your
association activity – classes taken, invoices paid, etc.
With these new opportunities come change. The most notable change will
be that the association WILL NO LONGER be mailing paper invoices.
This starts with the lockbox invoice in June. From now on, you will
receive invoices via email and invoices may be paid online. Of cour se,
you may still pay invoices by mailing a check or visiting the RAYAC office
to pay by cash, check or credit card.

Treasurer’s Report
Treasurer Tony Thomas presented the financial statement for review. Steve Snell
reported that the association will be facing capital improvements for next year
including new phone system, carpet replacement and parking lot enhancements for
the building which will be
6-7 years old at the time of improvement. It will have to be determined whether to
budget for the expenses or use reserves to pay for the items.
Leadership Development Assignment
Each director was asked to provide two names for the Leadership Development
Committee to invite to the Board of Directors candidate information breakfast on
May 23. Leadership Development Committee Chair John LeCates also announced
that the committee will be reviewing applications for leadership programs.

From the Executive Officer
You Can’t Please All the People All the Time . . .

While I may not believe the unwritten part of that old saying (“all the people, some of the
time”), those of us on staff really do try to please all our members all of the time. We
know that might be a highly unrealistic goal, but we try nonetheless.
Of course, with 900+ REALTOR members and another 85 Affiliate members, there are
plenty of differing expectations of service, sometimes more than one per member. We are all individuals so why
should we expect unanimity?
Let me share a perfect illustration of this point. We are mid-way through the 6th cycle of our Ethics by Example
courses. The reviews of one of those recent classes were, overall, extremely good. Of the comments provided on
the evaluations of the April 24th session:
 3 questioned the frequency of this requirement
 26 provided very positive reviews (“I learned a lot,” “Excellent class. Very informative,” “Extremely
pleased,” “I thought this was the best so far!”)
 1 was very negative (“This class was one of the worst.”)
One could easily argue that evaluations can also reflect the individual member providing the review, as in the one
exception above. Sometimes attitude is everything.
You, our members, provide us with a challenge. We’ll try to be “up for” that challenge but we recognize that there
are a wide variety of members with a wide variety of opinions/perspectives. We hope you remember that too.

from the Robert Murphy Disaster
Relief Fund. The local

Oklahoma reported that at least 10
REALTORS lost everything during
the deadly tornadoes in May. The
funds will help rebuilding efforts in
Moore and surrounding Oklahoma
areas.

Habitat Committee Reaches Out
to New Families
During non-build years, RAYAC’s Habitat Committee is
reaching out to new Habitat families. They are helping families
in York and Adams counties ease into the transition of
homeownership by purchasing items for their Habitat homes.

Starting June 3:
 The duration of the annual MIP is increasing from a minimum of 5 years
to a minimum of 11 years or the term of the loan depending upon the
original loan to value percentage.
 The 15 year loans are no longer exempt from the annual MIP.

A deed scam continues to appear in our area. Please advise your clients that if
they receive a mailing that looks like a bill from Property Transfer Services
1000N West Street Suite 1200
Wilmington, Delaware
- it is a scam. The mailing states “Deed Processing Notice” to get a copy of
your current Grant Deed and property profile. It also includes a “compliance
response date with a document number” and county public information on
their property which make it appear legitimate. Advise them NOT to pay the
$83.00 fee to be sent to the same company in Thousand Oaks, California.

REALTORS® shall avoid exaggeration, misrepresentation, or concealment of pertinent facts relating to the
property or the transaction. REALTORS® shall not, however, be obligated to discover latent defects in the
property, to advise on matters outside the scope of their real estate license, or to disclose facts which are
confidential under the scope of agency or non-agency relationships as defined by state law. (Amended 1/00)
Case #2-2: Responsibility for Sales Associate’s Error
(Revised Case #9-5 May, 1988. Transferred to Article 2 November, 1994.)
REALTOR® A, a REALTOR® principal, was asked to list a neglected house that obviously needed a wide range
of repairs. He strongly advised the owner that it would be to his advantage to put the house in good repair before
offering it for sale, but the owner wanted it sold at once on an “as is” basis. REALTOR® A wrote a novel
advertisement offering a “clunker” in poor condition as a challenge to an ambitious do-it-yourself hobbyist.
A few days later, Sales Associate B, who was not a Board member, from REALTOR® A’s office showed the house
to a retired couple who liked the location and general features, and who had been attracted by the ad because the
husband was looking forward to applying his “fix-up” hobby to improving a home. The sale was made. Shortly
thereafter, REALTOR® A was charged by the buyer with having misrepresented the condition of the property.
REALTOR® A accompanied Sales Associate B to the hearing, armed with a
copy of his candid advertisement. The hearing established that the buyer fully
understood that the house was represented to be generally in poor condition,
but that while inspecting the house with a view to needed repairs, Sales
Associate B had commented that since the house was of concrete block and
stucco construction, there would be no termite worries since termites could
not enter that type of construction. Sales Associate B confirmed this and his
belief that the statement was correct. However, after the sale was made, the
buyer ripped out a sill to replace it and found it swarming with termites, with
termite damage to floors in evidence. Further questioning established that
there had been no evidence of termite infestation prior to the sale, and that the
Sales Associate had volunteered an assurance that he thought was well
grounded.
REALTOR® A, prior to the conclusion of the hearing, offered to pay the cost
of exterminating the building and the cost of lumber to repair termite damage
in view of Sales Associate B’s failure to recommend a termite inspection,
which was the usual and customary practice in this area. The complainant
stated that this would satisfy him completely. It was the Hearing Panel’s view
that while REALTOR® A’s actions were commendable, and would be taken
into account by the Hearing Panel, REALTOR® A was still responsible for
the errors and misstatements of the sales associates affiliated with him. The
Hearing Panel concluded that REALTOR® A was in violation of Article 2.

IDX Updates
Please note that if you have changed offices or web developers, RAYAC needs an updated IDX contract that
MUST be signed by your current broker. A copy of the contract is available in Paragon in the MLS Docs
section, and/or you may be hearing from either Lori or Rhonda if the contract RAYAC has on file needs to
be updated.
RAYAC is streamlining the IDX billing. Future IDX invoices will be due annually in August. To get
everyone on the same billing schedule, some agents have been or will be receiving a 2013 pro-rated invoice
($8.50/mo.) prior to the annual billing in August when the full yearly payment will be invoiced ($100/yr.).

Legislative Link
RPAC’s Support in Primary Election
Prior to providing support to candidates for public office, RAYAC appoints a Screening Committee to interview
those running. Decisions are not made on a partisan basis but are based on the positions espoused by the candidates
on real estate and homeownership issues.
In the primary held last month, the Candidate Screening Committee interviewed all three candidates for the special
election to fill the State House of Representatives seat vacated by Eugene DePasquale. The committee judged each
of them to be highly qualified and, therefore, recommended to Pennsylvania’s RPAC trustees that we stay out of that
race. Democrat Kevin Schreiber won the election and we feel confident we can work well with him.
On the local municipal level, RAYAC’s Political Affairs Committee determined that races for supervisor in three
townships warranted our involvement. As a result, the Screening Committee issued invitations to be interviewed to
all the candidates running in Dover Township, Manchester Township and Springettsbury Township. In each case, we
provided support to two candidates; one in each ultimately prevailed in the primary.

Manchester Township – Rodney Brandstedter

RAYAC Helps Wounded Corporal
at Shred Events
The Community Relations Committee raised over $2,000
for Cpl. Matthew Hanes at its shred events on May 18
(Armed Forces Day). Volunteers directed traffic, unloaded
boxes and collected donations at the Black Rose Antique
Mall in Hanover, HACC Campus in Gettysburg and the
RAYAC office in York.
Matthew was severely wounded in
Afghanistan and returned home in
March. Donations go to renovation
projects to make Matthew’s home
accessible during his extensive
rehabilitation.

Contributions to RPAC are voluntary and are used for political
purposes. The amount suggested is merely a guideline and you may
contribute more or less than the suggested amount. You may refuse to
contribute without reprisal and the National Association of
REALTORS® or any of its state associations or local boards will not
favor or disfavor any member because of the amount contributed. 70%
of each contribution is used by your state PAC to support state and
local political candidates. Until your state PAC reaches its RPAC goal
30% is sent to National RPAC to support federal candidates and is
charged against your limits under 2 U.S.C. 441a; after the state PAC
reaches its RPAC goal it may elect to retain your entire contribution for
use in supporting state and local candidates.”
