CRIMINAL PROCEDURE 508-007 Fall 2013 Adjunct Professor Clement McGovern clement.mcgovern@usdoj.gov work 202.305.0535 cell 301.325.5900 Introduction This course will focus on the Constitutional law that defines permissible police procedure in criminal investigations. The majority of the course will focus on the Fourth Amendment right to be free of unreasonable search and seizure and the Fifth Amendment privilege against self-incrimination. We will also discuss the Sixth amendment at the end of the semester. Criminal procedure is a fascinating area of the law with personal application and importance to anyone living in this country, and it is a particularly dynamic and relevant area of the law following the events of September 11, 2001. I look forward to exploring with you both the Supreme Court jurisprudence that has shaped this field as well as personal, political and current events that bring it to life. Casebook Joshua Dressler and George C. Thomas III, Criminal Procedure: Investigating Crime (West Publication, Fifth Edition). This paperback casebook is an unchanged reprint of the first ten chapters of a hardcover casebook, Criminal Procedure: Principles, Policies and Perspectives by the same authors. If you have access to the hardcover casebook or choose to purchase it, you may use it instead of the paperback version. Grading Grades in the class will be based on the final exam and class participation. The majority of your grade will derive from your performance on the final exam. Class participation will be considered in your final grade which may be adjusted to reflect your participation or lack thereof. Class participation will be graded on the quality of your participation and not quantity. For the exam, any topic assigned for reading, whether commented upon in class or not, is fair game, as is any issue discussed in class even if not contained within the reading. Attendance and Participation I expect you to attend class regularly and to be prepared to participate. I also realize that sometimes you cannot. If you fail to attend class with some frequency and without sufficient explanation, you may be precluded from taking the final exam. Laptops and the Internet At the outset, laptop computers will be permitted to be used during class. Use of the internet is forbidden once class starts. Obviously, this includes cell phones and other electronic media capable of accessing the internet. Your grade may be impacted for violation of this rule and I reserve the right to reconsider the use of laptops if this becomes an issue.
