UMALI (Date received: 17 May 2011) FOR: THE HONORABLE PRESIDING OFFICER -------------------------------------------------------------------------------------------------------------------------------Honorable Presiding Officer: On 19 May 2011, the subject Memorandum of Agreement was referred to the Committee on Laws, Ordinances and Legal Matters and Committee on Agriculture of the Sangguniang Panlalawigan for review and recommendation. Thus, upon careful discussion of the same, including all documents attached therewith, these Joint Committees have the honor to report before this Honorable Body the following: 1. Section 465, (b) (1) (vi) of the Local Government Code of 1991 grants power to the Provincial Governor to “Represent the province in all its business transactions and sign in its behalf all bonds, contracts, and obligations, and such other documents upon authority of the sangguniang panlalawigan or pursuant to law or ordinance”. 2. Section 17 of the Local Government Code of 1991 states that one of the basic services and facilities which the province must provide is the provision of agricultural extension and on-site research services and facilities which include the . . . animal breeding stations, among others, as well as the transfer of appropriate technology. 3. That, BFAR-Regional Field Office maintains an experimental station at Naujan, Oriental Mindoro, which can provide the needed bangus breeder for the proposed Central Bangus Hatchery at MinSCAT-Bongabong Campus that can supply the increasing demand for bangus fry fishpond operators in the area. 4. That, the Memorandum of Agreement should contain a stipulation that the Central Bangus Hatchery and all improvements that will be introduced by BFAR thereon during the entire duration of the MOA shall become the property of MinSCAT – Bongabong Campus after termination of the MOA. 5. That, aside from the provision of available resources and services that will ensure effective implementation of the hatchery project, the allocation of funds for the PGOM staff in providing technical assistance and other related activities thereon, and the provision of other equipment such as backhoe relevant to the construction and implementation of the project, no extra/additional fund shall be disbursed by the Provincial Government of Oriental Mindoro (PGOM) in the implementation of the subject MOA. 6. That, said Memorandum of Agreement (MOA) was reviewed by Atty. Kristine Grace L. Suarez, Provincial Legal Officer, and she certified that the same was in conformity with law, public order and public policy. Recommendation: Based on the above premises, these Joint Committees respectfully recommend to this August Body to pass and approve a RESOLUTION AUTHORIZING THE HONORABLE HUMERLITO A.
